I edited my last post to lowman to include what you posted...and it is explained here that the legend has to be OK'd by issurer to be removed by the TA.
Even if you have met the conditions of Rule 144, you can't sell your restricted securities to the public until you've gotten the legend removed from the certificate. Only a transfer agent can remove a restrictive legend. But the transfer agent won't remove the legend unless you've obtained the consent of the issuer—usually in the form of an opinion letter from the issuer's counsel—that the restricted legend can be removed. Unless this happens, the transfer agent doesn't have the authority to remove the legend and execute the trade in the marketplace.
To begin the process, an investor should contact the company that issued the securities, or the transfer agent of the company's securities, to ask about the procedures for removing a legend. Since removing the legend can be a complicated process, if you're considering buying or selling a restricted security, it would be wise for you to consult an attorney who specializes in securities law.

But none of those from a year ago were restricted...
And...evidently, the TA still has 54mm from "sometime" with a
legend on them...otherwise, float would be @ current O/S.
Edit: Just read what ElohimPerazim posted...could management have not yet given the TA the OK to lift the legend from those shares...therefore, as far as the TA is concerned...they are still restricted...no matter how many years they've been held? That would have to make them part of the original 175mm O/S from year before tho.
According to the filings...O/S EOFY 2010 was 175,000,000...
EOFY 2011 was 609,420,100...which is also current O/S...
175,000,000 + 434,420,100 (converted debt shares issued 07/19/11) = 609,420,100
debt shares were not restricted...if others were...they didn't make the filings...???...
but would have to be part of the 434,420,100 for O/S to be accurate...which is current
on OTC Markets.

Yep...he seems to be one helluva' "solutions" guy for our little
niche of the industry...which is of massive importance...
not sure about his "hardball" skills as an OTC CEO. I think those
have to be learned the hard way...like shareholders/traders have
learned coming up thru these expensive mine laden ranks. I'm
sure there is a degree of naivety involved...when the CEO is
actually honest. Sure was with me when I first started playing
in this lawless & seedy arena.
Regardless...he's doing what he does best...building a strong &
successful company...and I thank him for that.

Well...he's got access to more tools than we do to try and figure
out what's been happening over these past few months...
but I think his main priority has been to ramp up production/sales...
(which he seems to have accomplished...in spades)...and play the
watch & see what happens game. The last update of #s didn't break
the "whack-a-cycle"...so maybe...just maybe he's got another plan
for this update.
Shouldn't be long before we find out something...
according to IR anyway.

announced his buyback...(pps getting whacked hard @ .01 ish).
I'm guessing he changed his "strategery"...when it fell sub penny

Hey low...totally understand the frustration. Been playing in pinky/BB-land since before RB message board came online...and I would like to say I've seen it all...but...this one is surely an enigma...to say the least. Like I've said before tho...think about how the folks at overstock felt when they were putting out killer fins & they were just languishing in mediocrity as we are. It just defies logic...until the outside forces acting upon the stock were discovered...then, the realization that "it's not our fault" comes to light. Hopefully, we don't have the forces of that magnitude working against us...but we definitely know they were enough to bring us way lower than where we should've leveled off at after the first run...and then back down to these sub basement levels...for an agenda that is still not quite clear to many...I sure don't know the MO here...can just guess. And...I surely hope this isn't a result of any buy-back plan...as, in my humble opinion...that would be unethical for a CEO to deliberately do this to their shareholders...regardless of the eventual outcome.
Well...as the laws of physics dictate...water will eventually seek its own level...at least with the absence of outside forces.
