theory - thanks for your thoughts expanding on my comment and I agree with what you say tho likely without your specific experience in the relevant cohort. I think most accept as true the theory that management was planning to release TLD promptly then reflected on the wisdom of that and pursued a course involving publication of an article. Nothing in that supports the theory of a bad result (why be in a hurry to release, why publish an article announcing failure?). OTOH and IMO it is preposterous to say that the company took those actions to delay a negative announcement - spend money and time and professional status for that? Anyway we’ll know fairly soon I believe.
TLD in 2023? Isn’t it still March? Why is this a question? You can also ask if 2024 “is in play?” just as well. Have a great day if you’re not staying inside to avoid being struck by meteorites…
Mav: I do not claim to know specifics of what management have done and are doing. Like others I try to find a theory that fits known facts (see, IkeEsq post 452359). But I’m not calling out the two top NWBO executives by name (initials you used) and saying they have failed to be diligent and implying they are affirmatively inept. Which you have done with no more direct knowledge than I have.
Ike - Excellent post and while your religious analogy may draw some pushback IMO you explain it’s limitation and your assumptions. (At least, to people who accept scientific astrophysics rather than religious explanations of creation). #golawyers!! And yes for me, the delay has affected and is affecting life decisions. My path (which I have elected), but a far longer path than circumstantial explanations would reasonably have forecast. GLTA!

You have absolutely positively no idea that they have not been diligent and from what I know of and from them, I suspect their diligence, commitment and guts exceed most on this board. Flip there are means of extending patent expiration BP are expert maybe NWBO is consulting with those. Or maybe that would not be consistent with the Mission.

Viking I don’t think there are paid posters at all nor did I say or suggest that. I think the hold up is with an article. I’m questioning how long investors and patients must wait for TLD in light of past management declarations, PRs, and quotes provided to British newspapers. I’m saying - which is a certainty - that the delay is causing supporters to suffer

Viking/many others: I have not been here nearly as long as many but (1) investors invest and plan based on reasonable expectations of timing of events such as disclosure of TLD that are at this point within the control of management. And, (2) the perfect can be the enemy of the good. There are very management-loyal and respected posters whose positions have been eroded because it seems we are waiting for multiple developments to come together. Not to mention potential beneficiaries of an apparently efficacious treatment. Let’s get the show on the road already!

The length of time during which the SEC has not issued a final decision “on the merits” of the alleged violation would be an important factor the appellate court would consider in deciding whether to grant or deny issuance of a writ. NOTE tho that even if granted it is unlikely the court would indicate any opinion of the merits. It would only tell the SEC to issue a decision.
A quote from a recent mandamus case involving criminal procedural issues: A “writ of mandamus should issue only if: (1) “the party seeking issuance of the writ [has] no other adequate means to attain the relief he desires”; (2) “the petitioner [satisfies] the burden of showing that his right to issuance of the writ is clear and indisputable”; and (3) “the issuing court, in the exercise of its discretion, [is] satisfied that the writ is appropriate under the circumstances.” Cheney, 542 U.S. at 380–81

In the NMGX application the company is asking for an order directing another branch of government, the executive branch, to do something. So, since NMGX’s application implicates “the separation of powers [doctrine], the Court of Appeals must also ask [whether issuance of a writ would] constitute[] an unwarranted impairment of another branch in the performance of its constitutional duties.” Cheney, 542 U.S. at 390.
JC: mandamus is so unusual i and most never deal with this procedure. Also I think tho I could not confirm that most applications involve prisoners seeking relief so statistics about the frequency of success and timing would not likely be helpful. In comparison IMO the present case where an agency of the executive branch is simply not acting where it is required to make a ruling one way or another is the type of unusual situation where a writ might properly issue.
All courts run on their own schedule so predicting a result would be a guess or at least I would not be able to offer a meaningful estimate. See next post for more…
