I did not register with the Texas court website to pull the docket. I just found it late last night and decided to make a few calls and see what kind of information came in. Hope you do not mind that I asked you as a resource as well. You just seem to have covered alot of bases in regards to DD and I do appreciate you sharing what you have.
I agree that it is probably nothing significant. It was the first time I had come across it though and with a scheduled hearing next Monday which was a little suprise.
Perhaps they are trying to clean up old dirt stains on the books before becoming transparent, I do not know, just thinking along the lines of the recent PR and this being relational. Purely speculative guess though.
Well....time for the 1.5 hour commute home surrounded by people that must have learned to drive from my wife. If we ever happen to meet, this conversation never happened.

I left a message with Ron this morning. I assume if he is out of town that I will not get a call back until next week.
It does not look like anything of grave importance. I spoke to one of the executives at Romco to see if the hearing was related to Murphy since Elite Rentals also has a case prelim hearing vs. Romco. Romco said basically they were dragged into it because they are the supplier of the Volvo trucks rented out by Elite to Murphy.
It does not look like very big news one way or the other as these types of things happen to even the most touted reputable companies. It was just something new that I did not have and thought you might.
The questions I was going to ask were the nature of the dispute if it can be divulged, the amount of damages claimed, why it was filed in Texas when Murphy and Elite were located in LA. and why in Bankruptcy court.
I tried to call Elite rentals, but the number I found 225-673-4135 had no idea what I was talking about and knew of no John Arbo that ever worked there and nver heard of Elite Rental.
My assumption is that Elite Rentals no longer exists, has filed bankruptcy in the state where thier corperate offices were located. Have not had time to research much further yet, but am more so holding off until Ron calls.

If the gap does not fill, it would be a VERY small (like 5%) of my position that I would try and flip. I held all the way up from .029 to .128 and back down with other buys at .04, .06 and then averaged down again at .03 and .016. Had I flipped a small portion then, I would be sitting prettier now.
I will not chase it any more though. I am done with investing what I feel comfortable losing. I will hold at least 85% of my position for 2+ years. The other 15% will be used to cover when the PPS moves to that point. Or if the gap does not fill, 10% will be my cover and 5% will be a short position. If it does not work out and we never fill it, the 5% will not make a whole lot a difference in the whole scheme of things. Thanks for the advice though. I am long term, but there is nothing wrong with a small short position while we wait.

I was just about to post since I am a gap semi-believer now.
We filled it yesterday with a 7000 and 5000 order. Hopefully we will fill it today or if we dont by Monday, I will consider flipping a very small portion of my position and take the chance on us dropping to fill it between .032 and .034.

gand - truthfully, it would have taken me alot longer to find anything without monkey's post that included the address linked.
I usually start with the address first and not the name. It will sometimes give you a good indication of company name changes, maybe how long they have been there or how many companies are listed at that address. Starting with just the company name will more often than not flood yuo with info to scan. The more specific you can get, sometimes better the info and you can work towards the big pile of info by starting in the middle.

Mike2112 - Not really hung up about the profit numbers. I totally understand that it is an great purchase for us and a piece of hopefully a huge puzzle for you, me and everyone else involved over several years (sooner the better). It is the manner that it was presented to us that causes the problem for me.
Perception is a piece of the puzzle for our PPS too. If investors do not feel that management is totally forthcoming, part of that will be reflected and those of us that looked beyond it will suffer. The more seemingly misleading information that is released, the longer we will have to suffer.
I am not going to lie. I want a big pop soon. I want to sell 20% or less to cover my position and not have to look at the PPS for years. The plain truth is that just like any other pink sheet, it is risky. We all know that, we all have gambled and lost in other places.
What I have learned in dabling below the high cap stocks is that you MUST adhear to your exit strategy. At least 50% of my investment losses could have been avoided if I had done just that. The other 50% is just poor DD on my part.
Ok, Ok....I did just lie. I do not know if it is a 50/50 ratio, but it was the point of it that mattered.

Agreed. The 4 things that are disapointing to me are:
1. Gagged TA
2. The whole A/S mistake
3. Brass Bulls
4. The 190 million rev PR without letting us know in that same PR that profit was so slim
The gagged TA will hopefully be a non-issue soon. However, some rep damage has been done by insiders posting that it was gagged due to volume of calls and not because they were planning to dilute. Most of us knew what was going on.
The A/S mistake throws up another caution flag for me. There has been indication that it was only disapproved due to the fact that there was no vote on it and that shareholders must vote. It scares me that we "could" see a vote on it and the company would hold a majority of shares basically voiding out any vote other shareholders might have.
Brass Bulls - well the mistakes and the fact that it was not a better known firm.
The 190 million rev PR - I think most of us that speculate on pennies would understand if we purchased a low profit company with plans to turn it into a much more profitable company. After all, that is what Phoenix does right? It seemed a little misleading to present it to us in the manner it was presented. It just makes me play a little more "devils advocate" on the other aquisitions and projected earning of existing divisions.
I have no doubt that the company will do very well in coming years. The question here is will any of that be handed down to those of us that PLAN on being here for many of those years.
There are some that have been around since June of last year in reading posts. I would be totally happy with results they have had with almost trading at 10x what they probably bought in at. But as I have posted previously, to ask the company to blink and make us all millioniars is asking a bit much right now.

Big difference between the two grizzly. IGTN never had a chance to make the min. without a R/S. They did not have the revs, just speculation. Could it happen to PBLS, yes. IMHO highly unlikely. R/S are like IGTN are company with no other means of generating revenues in order to continue operations. PBLS has been going on this long without a reverse split and running in the black. They have real product, real revenues and real profit. Could we eventually make the minimum to get on the BB without a R/S, yes.
The only way you can compare the two is if everything PBLS puts out turns out to be uncredible or nothing said in PR's happens on time or even close to on time with absolutely no update to shareholders.

PS. Tell Asus on RB I did not sell a single share either. I will be making my second biggest and last purchase for a months in the morning. I budgeted out stocks for the first 6 months of 2006. We are gearing up to put %20 down on another house next year. I have 14 small cap stocks total which I am all long in so I do not see any more cash freeing up any time soon.

Good info. Thanks for posting. That is the type of outside company information that gets me a little excited. Still unanswered questions, so I can not be as excited as Ne14. It helps that much more on the path to feeling totally confident with this investment though.

We do not know what the float will be after the buyback. Some will come from repurchased restricted shares and some will be from the open market. We still do not know if any dilution has taken place either. The last PR on the subject stated that the float was 156 Million. So to answer your question, IF no dilution has occured and 50% or 50 million of the 100 million bought back shares came from the float, the buyback of the float would be 32%.
For all we know right now and as cheap as these prices seem, the company could buy back more. The company buy back could take as long as second quarter next year.

Even though it refers to offshore drilling.
I do not know enough about the oil industry to decifer if there is a huge difference in outputs between offshore wells and land wells. This is offshore in Texas.
