SunnComm fixes 'Shift Key' embarrassment

SunnComm has at last fixed its most infamous flaw - the Shift Key break to its DRM (digital rights management) technology.
The company has started shipping an update to its MediaMax software that blocks users from employing the Shift Key attack discovered in 2003 by a student at Princeton University. The student realized that SunnComm's DRM technology could be disabled by holding the Shift Key down when inserting a new CD. This allowed users to do what they liked with the songs, undermining the entire point of SunnComm's software.
"The new technology, when embedded onto the optical medium, makes it even more difficult for the consumer to improperly use the CD without first installing the MediaMax software," SunnComm said in a statement. "Throughout the latest series of tests, this newest version of the copy management technology has proven to significantly improve protection for MediaMax-enhanced discs while remaining 100% playable in all consumer CD and DVD players."
SunnComm acknowledges that some people may still find a way to workaround its DRM, but it's convinced the MediaMax update makes the Shift Key issue a moot point. The average consumer is not going to take the time to try and break the technology. Let the researchers have at it - we're not worried about them.
SunnComm has been looking to sign up more big labels as customers of its technology and recently announced that Universal is considering MediaMax. The software places restrictions on how many times and to what devices a user can transfer music. Such technology is seen a must have for the record labels trying to block piracy. Many customers, however, dislike DRM technology, as it places new boundaries around once untainted products. ®

Update, June 21, 2004. Velvet Revolver's new release Contraband, which topped U.S. album sales charts this week, contains anti-copying software from SunnComm that is substantially similar to the earlier version of the technology described in this report. I have performed a preliminary inspection of the new system, and like its predecessor, it appears to provide only minimal protection against copying. It can be bypassed by holding the shift key every time the disc is inserted, turning off autorun before using the CD for the first time, or manually disabling the driver software as described below. I believe most of the information in this report is also applicable to the new release.
Note: The E.U. release of this album contains Macrovision CDS-200 copy prevention technology, not the SunnComm CD3 system described in this paper. The Japanese release does not appear to contain any copy protection.

I'm assuming we're talking about Regulation M b/c it is the most relevant rule of the 4 rules going into effect on Feb 15. This portion of Reg M sounds pretty significant:
The primary focus of Regulation M, and its predecessor Rule
10b-6, is (1) offerings that raise manipulative concerns, defined as
distributions; (2) persons who are likely to engage in manipulative
activity; and (3) the activities that likely could raise or support
the security's price. Securities Exchange Act Release No. 33924
(April 19, 1994), 59 FR 21681, 21684 (``Regulation M Concept
Release') (stating that a person contemplating or making a
distribution has an obvious incentive to artificially influence the
price of the securities in order to facilitate the distribution or

(December 20, 1996), 62 FR 520 (January 3, 1997) (``Regulation M

Because price integrity is essential during a securities offering,

Securities Offerings (Regulation M): Anti-Manipulation Rules
Would prohibit certain activities by underwriters and other distribution participants that can undermine the integrity and fairness of the offering process (particularly with respect to allocations of offered securities), enhance the transparency of syndicate covering bids (which may affect the aftermarket price and trading of an offered security), prohibit the use of penalty bids, update certain definitional and operational provisions in light of market developments since Regulation M's adoption, change certain recordkeeping requirements, and amend the disclosure rules under the Securities Act of 1933.

Linear vs. log charts...
I switched to linear charts last week, and I really didn't like the experience. I will use linear for higher-priced stocks, but I'm sticking to log for the pennies.
Sterling (of CMKx fame) is pumping CTKH.
R/S often split the o/s but leave the a/s untouched. With FRCP or whatever the new ticker is, I would still treat this like a .25 stock - higher pps doesn't mean management is any more credible.
What do you mean? this is the first I have heard of this.
I have a UPS, but it won't work as long as it's unplugged and in my closet.
