This is looking bad for Hodges plaintiffs, imo.
I understand the concern Shareholders have when a plaintiff makes an announcement offering some of their shares for sale. This action does not reflect what is going on with the present situation with Attorney Hodges and the funds. Attorney Hodges will notify the Shareholders.

Promoters explain that as democracy comes to Iraq, the expected peace will stimulate the Iraqi economy and the value of the dinar. What investors are not told is that the dinars can be redeemed only in Iraq and that the sellers already have doubled their money. Thus, the dinar would have to more than double in value and you would have to take a trip to Iraq to collect any profit.'

Try this - the next time you visit a site selling dinar, take a look at the disclaimer located at the bottom of their site; it's absolutely shocking! (the shocking stuff is usually in the first few lines of the disclaimer).
The new Iraqi Dinar is real and not a scam itself, it's the selling of the Dinar without telling the buyer that they are doubling the price and that it can only be redeemed in Iraq that is wrong. In fact, the central bank is reported to state that it's illegal to remove dinar from Iraq.
The only people making money on the Iraqi Dinar are internet dealers. They make a ton of money as soon as you buy dinar, may sell you fakes and will NOT buy back the currency. Once you buy the Dinar, you'll find it almost impossible to sell it back!
I should say that there is a remote possibility that you could buy Iraqi Dinar and make a good profit, but that possibility is so small, it's almost impossible to measure it; State government considers it risky enough to list, so why in the world would you consider it any different?
Oh, and if you see a site that is registered to sell Iraqi Dinar, don't be impressed. What they are not telling you is that they have registered with the government as a company dealing with money. It has NOTHING to do with the Iraqi Currency and does not mean they are trusted in any way. It simply says they filed a form informing the government that they are dealing with money. In fact, ANYONE can fill out this form and send it in and you'll get a statement saying you filed the form. Iraqi Dinar sellers use this to make themselves look legitimate so do not be mislead!
Remember, if you're going to look at the dinar as an investment, look at the disclaimer found on sites selling the dinar. Shocking!

I just received a call back from Gisela, of Mr. Stoecklein's office.
She said Mr. Stoecklein has not been involved in this stock since 2005 and knows NOTHING about any document that this person speaks of.
She said who is it anyway..i said Roger Stelma, she said..Oh.. yes, we know about that guy..
I said, does that mean that Mr. Stoecklein was involved with him..
she said no.. It just means that we know about him...
I offered to give him the info I have on Stelma, but she said that's OK, meaning I think they have it... I said this guy has been and still is referencing Mr. Stoecklein's name for years and I had to know the truth..
She was a lovely lady who said she really feels for the shareholders, knows that we have been through a lot and wishes us the best..
So it is all HORSE####, with a capital H....

I just called the Roger Glenn office in New Paltz, NY to try to get a fax number and Mr. Glenn answered the phone. I explained who I was and that I was surprised I got to talk to him. I said the reason I am calling was that a gentleman known as Roger Stelma, aka ACCA just posted on a message board that you and Urban Casavant had talked to him and that documents were supposed to be released by Oct 8, that would clarify and force this whole situation..
He said that is ABSOLUTELY NOT TRUE!!...He never talked to him.. and chuckled along the way.. meaning I guess.. how much of this stuff can I listen to. He said he hadn't talked to Urban since 2005 and the only conversation he has had about CMKX is with his lawyers.

The Securities and Exchanges Commission (the “SEC”) filed an amended complaint against
Stephen C. Sayre, Independent Financial Reports, Inc. (IFR), and Silver Screen Industries, Inc.
(the “Defendants”) alleging that Sayre made materially false and misleading statements in stock
recommendations issued through his company IFR about eConnect, whose stock at the time was
quoted on the Over-The-Counter Bulletin Board. The statements were further misleading, stating
that IFR held no eConnect stock and would not be compensated for its opinion. The amended
complaint also alleged that Sayre, the sole officer and director of IFR, purchased eConnect shares
before issuing the buy recommendations and sold them through Silver Screen brokerage
accounts at dramatically higher prices once the recommendations contributed to a substantial
increase in eConnect's stock price.
On April 8, 2000, the SEC obtained a temporary restraining order freezing the assets of
Defendants. The district court entered a final judgment against Sayre and IFR, permanently
enjoining them from future violations of Section 17(a) of the Securities Act of 1933 and Section
10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder and ordering Sayre to
pay a civil penalty. The district court also ordered Sayre, IFR, and Silver Screen Industries, Inc.
pay disgorgement with prejudgment interest. As a result, the SEC has created a fund of
approximately $987,333 includes disgorged profits, prejudgment interest and accrued interest.
This amount will be available for distribution to harmed investors who submit a completed and
timely claim form.
The Court appointed Gilardi and Co. LLC the Distribution Agent to distribute funds to eConnect
investors who qualify under a court-approved distribution plan.

All persons who purchased eConnect common stock between February 29, 2000 and March 10,
2000.

The SEC relies on the majority of defendants to fall on the sword without much of a struggle, and of course you have the cowards who completely ignore SEC complaints by defaulting. Delidog made enough cash to hire a decent attorney to fight round one challenging the SEC to the next level. Delidog's arrogance lead to the decision to resume selling certs, or so it has been reported. If true, Delidog is now in the position of not being able to claim ignorance of regulations.
If the case against Delidog intensifies we may see how others are eventually dragged into this situation. Now put yourself into Delidog's shoes. This could get very interesting. To repeat, this is one of the main reasons I would personally like to see the Hodges lawsuit go forward.
It is just amazing how some people who moan ad nauseum about the corruption on Wall Street and financial institutions in general, deem it perfectly acceptable for someone like Delidog to write his own set of rules. If the SEC or DOJ doesn't hold someone responsible we could have a situation of wannabe rogue brokers out there conning investors into who knows what.
Two points that irritate me most about this episode. That an insider could find a loophole to dump shares, also IF shares are being sold at THIS TIME they are being sold based on rumors.

“Exchange Act”) by acting as a securities broker-dealer without first registering with the SEC. See
15 U.S.C. § 77e(a), (c); id. § 78o(a). Glisson, however, contends that he did not act as a brokerdealer
in any unregistered securities transactions. Glisson also maintains that, in any event,
genuine issues of material fact exist regarding the scope of his securities transaction activities.
The SEC has now moved for summary judgment (#22, opposition #27, reply #33).
A grant of summary judgment is appropriate only where the moving party has
demonstrated through “the pleadings, the discovery and disclosure materials on file, and any
affidavits” that there is no genuine issue of material fact and that the moving party is entitled to
judgment as a matter of law. Fed. R. Civ. P. 56 (a), (c); Anderson v. Liberty Lobby, 477 U.S. 242,
248 (1986). All justifiable inferences must be viewed in the light most favorable to the nonmoving
party. County of Tuolumne v. Sonora Cmty. Hosp., 236 F.3d 1148, 1154 (9th Cir. 2001).

The moving party bears the initial burden of showing the absence of a genuine issue of material
fact. Fairbank v. Wunderman Cato Johnson, 212 F.3d 528, 531 (9th Cir. 2000). The burden then
shifts to the non-moving party to go beyond the pleadings and set forth specific facts
demonstrating there is a genuine issue for trial. Id. The party opposing summary judgment “must
cite to the record in support of the allegations made in the pleadings to demonstrate that a genuine
controversy requiring adjudication by a trier of fact exists.” Taybron v. City & County of San
Francisco, 341 F.3d 957, 960 (9th Cir. 2003). If the non-moving party meets its burden, summary
judgment must be denied. Fed. R. Civ. P. 56(c); Celotex Corp. v. Catrett, 477 U.S. 317, 324
(1986).
The SEC has failed to demonstrate that it is entitled to judgment as a matter of law and that
there are no genuine issues of material fact. The SEC alleges that Glisson violated Sections 5(a)
and 5(c) of the Securities Act by selling unregistered stock through the instrumentalities of
interstate commerce. See 15 U.S.C. § 77e(a), (c). These provisions of the Securities Act,
however, “shall not apply to . . . transactions by any person other than an issuer, underwriter, or
dealer.” Id. § 77d(1). The SEC accordingly maintains that Glisson “acted as and constituted a
‘dealer’ in accordance with the definition set forth in Section 3(a)(5) of the Exchange Act.” Pl.’s
Mot. for Summ. J. 14, ECF No. 22. The SEC, however, fails to present any analysis or allegation
that Glisson acted as and constituted a “dealer” in accordance with the definition set forth in
Section 2(a)(12) of the Securities Act. See 15 U.S.C. § 77b(a)(12). Furthermore, even assuming
that Glisson acted as a “dealer” as defined in the Securities Act, Glisson has raised a genuine issue
of material fact that his actions constituted the specific acts for which a “dealer” may be liable
under the Securities Act. See id. § 77d(3). The SEC also alleges that Glisson violated Section
15(a) of the Exchange Act by failing to register with the SEC or to associate with a registered
broker or dealer. See § 78o(a). The Exchange Act requires a “broker” or “dealer” of securities to
either register with the SEC or associate with a registered person or entity. Id. Under the
Case 2:09-cv-00104-LDG-GWF Document 36 Filed 09/24/10 Page 3 of 3
Exchange Act, a “broker” is “any person engaged in the business of effecting transactions in
securities for the account of others.” Id. § 78c(a)(4)(A). Also under the Exchange Act, a “dealer”
is “any person engaged in the business of buying and selling securities for such person's own
account through a broker or otherwise” unless that person “buys or sells securities for such
person's own account, either individually or in a fiduciary capacity, but not as a part of a regular
business.” Id. § 78c(a)(5)(A), (B). Genuine issues of material fact exist as to whether Glisson
engaged either “in the business of effecting transactions in securities for the account of others” or
“engaged in the business of buying and selling securities” as part of a “regular business.”
Therefore, the SEC has failed to demonstrate that it is entitled to judgment as a matter of law and
that there are no genuine issues of material fact. Accordingly,
THE COURT HEREBY ORDERS that the SEC’s Motion for Summary Judgment (#22) is
DENIED.

As all are by now well aware, we have been battling a serious headwind, obtaining Economic Receipt. Although I have previously stated that I would not provide an “update” until we had confirmation of economic receipt or, I became convinced that payment to CMKX shareholders would not be forthcoming in a timely manner, I believe a further update is called for due to the status of the CMKX litigation and due to the unreasonable length of time resolution is taking. Please be advised as follows:
• As previously indicated, the August 2 Court hearing was utilized, in part, as a means of conveying to the Judge and to the defendants, some of the additional information which could be added to the originally filed Complaint; this information has now been included in a First Amended Complaint which, out of an abundance of caution, has been filed and served today, September 16, 2010. We will continue to aggressively pursue this matter until such time as all shareholders have been paid.
• It has been a very unreasonable period of time since we first began this litigation. Shortly after filing the original Complaint, I advised you of my opinion that resolution was imminent. I am confident that many of you are now convinced that I either don’t know the meaning of that word or am certifiably non compos mentis. Unfortunately, neither is the explanation; in point of fact we, and many others involved in bringing this matter to resolution, have been consistently lied to and ‘played’ by our own government.
I do remain convinced that we will prevail. I know that the SEC is anxious for this to be over; however, it is not particularly the SEC that has held things up, IMO. We are, like it or not, tied to the World Global Settlements payouts. Until that process has been concluded, I do not believe that you will receive your payment.
As always, inquiring minds want to know: what is our status; what has been going on; what is holding up economic receipt; when will our money be released; etc. etc.? I will try to address some of these concerns, to the extent I am able, separately:
1. Our Status – Our status remains pretty much the same as before. We remain literally on the thresh-hold. This means that the “work” remaining to be finished will not consume more hours than can be accomplished within one day; we have been at this point now for way too many months. However, progress in consummating the World Global Settlements has been made, which is a substantial improvement. I have now been advised that nearly all of the BASEL list items [some 20 in number] have been paid out; only one or two items remain IMO.
2. When is Release – The CMKX distribution funds will be released within a very short time after there is confirmation of Economic Receipt. What does that mean? There is in process a massive shift of wealth within the US and the world community which includes: pay-out of all the domestic prosperity settlements; institution of the US dollar re-funding project; pay-out of world settlements; and, distribution of funds to many other programs. This involves a total of more than $42 Trillion. Economic Receipt occurs when all trustees have access to all of the funds they are responsible for. When the last BASEL item is paid, we will have ER and the CMKX trustees can begin distribution, IMO.
3. Goings On – What’s been going on behind the scenes is a war. As I said before, there is an economic war raging in the background; this war is between those who have controlled this planet for the last hundred and fifty years, and we who think that it must stop. It is a war which, as much due to world circumstance as anything else IMHO, we seem slowly, inexorably winning. Because the naked corruption in D.C. is so endemic, it takes time. These miscreants are, in effect, fighting for their lives – at least that part of their lives that secures an environment in which they can continue to lie, cheat, steal, and mortgage your progeny’s lives, all for their personal gain. Accordingly, they will fight until the doors are all closed by a power that they cannot subvert. The good news is, we are winning the battle.
4. When - When will it be over, you ask; when will we get paid? I have suggested dates in the past, each of which was based upon information that I had received from the people on the scene and in the trenches. I am unwilling at this point to say anything more than I believe it will be soon: 1) because of the status of the World Global Settlements; 2) because I have received anecdotal information regarding movement of CMKX funds; and 3) because of additional information received concerning the status other related payments being made.
I again want to extend my heartfelt thanks to those of you who continue to demonstrate support and encouragement for our efforts; I am especially thankful for all of the IM good wishes and thank-you’s. I remain very optimistic for the long term; rest assured that the fight will continue until we succeed. We will prevail!

The SEC, DOJ, Tyler, shareholders, or any other entity has never found ANY evidence of claims sold to the three Chinese companies Hodges alleges. There was never an 8-K filing, news by the company, or a word from Urban.
Hodges neglects to provide the tiniest bit of credible evidence to give shareholders confidence that this lawsuit has merit. Naming the three Chinese companies that purchased the allege claims could easily be verified by the shareholders. There can be no possible explanation why Hodges can't reveal this public information, except one. Hodges is only interested in shareholders having blind faith in him. It is all his way or no way. Heck, he doesn't even respect his own clients. They are totally and unnecessarily kept in the dark. One of his clients believes he has a legal license at risk. All IMHO.
Now Treff is reportedly doubting if the "meeting" ever took place. ouch!!!
(very tired): does it bother anyone else that Al keep saying he would not file but did. And doesit bother anyone else that his new filing has no new information or new facts. Does it bother anyone else that this new filing will be thrown out just like the last one because it it no different than the last one.

Someone claims Hodges logged into the millionaire board this morning. The update thanked folks for the IMs, so Hodges was probably checking on what shareholders were thinking.
