AP17. This is also revealing you understand. CVSI’s registration for The New Harvest ™ Registration was sent to an examiner on February 27, 2019. It takes normally three months to be sent to an examiner because of backlogs and too many smoke breaks you understand. Within that three month period, New Harvest Pharms a llc. Lexington , Kentucky is located out of a house garage by one individual using the Internet to sell his snake oil had filed his registration with the USPTO without a patent and trademark attorney. The web site looks like a a sham in my opinion. That registration was sent to an examiner on May 14, 2019 within the three month period. Then one month later in June, New Harvest Foods filed their trademark registration. That company was formed in March 2019. Today was the last day that anyone including you Vandalay could file an objection or oppose the Plus + CBD OIL ™ registration. We should be getting a response from the USPTO examiner later this month concerning the New Harvest ™registration. New Harvest Foods filed their similar New Harvest trademark in late June and will take three months before it is given to an examiner. There will most likely will be an objection by them because there will be similar classes of use to CV Sciences trademark registration. There should be no problem that we will win our case. New Harvest Foods had to have known about our registration because we filed in late February. The Pharmanex Example
In April 1997, Pharmanex, the manufacturer of Cholestin, a red yeast rice dietary supplement, found itself in a similar position. Cholestin contained mevinolin (also known as monocalin K), a substance that is chemically identical to the active ingredient in the approved new drug Mevacor (lovastatin). On this basis, FDA advised Pharmanex of its position that Cholestin was a drug requiring FDA’s approval for marketing and detained Cholestin that the company had attempted to import. Counsel for Pharmanex maintained that red yeast rice was an ingredient with a documented history of food use going back nearly a millennium.[4] After a series of meetings regarding this issue, Pharmanex filed a petition for FDA to stay its action on Cholestin. Although FDA determined that there was no agency action to stay, it decided to open an administrative docket to consider the issues relevant to the marketing of Cholestin supplements.[5] FDA ultimately decided against Pharmanex with respect to Cholestin.[6] In FDA’s view, Pharmanex’s product did not contain traditional red yeast rice as that product had historically been manufactured and sold.[7] Instead, Pharmanex had specifically manipulated its Cholestin supplement through the production process so that it would contain higher levels of lovastatin. The company had also promoted the product’s lovastatin content in materials directed at pharmacists.[8] Accordingly, FDA concluded that Cholestin containing lovastatin was an “article” that had already been approved as a drug and was therefore excluded from the definition of “dietary supplement.”[9]
Following the adverse administrative decision, Pharmanex filed suit seeking a declaration that the FDA decision was arbitrary, capricious, and not in accordance with law. The district court agreed with Pharmanex that the term “article” did not refer to a mere ingredient in a drug.[10] However, the appellate court reversed,[11] agreeing with FDA in finding that a previously approved “article” could include a specific active ingredient or the approved drug product itself. The court expressed concern that permitting manufacturers to market dietary supplements with identical active ingredients to approved new drugs would undermine the new drug development process. On remand, the district court affirmed FDA’s conclusion that lovastatin was not marketed as a dietary supplement or as a food prior to 1987 (the year that FDA approved the NDA for Mevacor).[12] A product named Cholestin is now marketed by NuSkin, but it does not contain red yeast rice.[13] Cholestin containing red yeast rice is no longer available as a dietary supplement in the United States.[14] However, dietary supplements that contain red yeast rice are widely marketed, and FDA tests such products from time to time to determine if they contain lovastatin at or below the levels of traditional red yeast rice products.[15]
Although the outcome of the Pharmanex case was ultimately negative for the dietary supplement manufacturer, the case history provides lessons for manufacturers and distributors of dietary supplements containing CBD regarding a formal resolution of CBD’s status as a dietary supplement ingredient. FDA’s action to detain Cholestin began after a pharmacist filed a complaint about the product, presumably because of its similarity to a known, marketed drug. After meeting with FDA on its own initially, Pharmanex convinced FDA to seek public input on the issues surrounding the proper regulatory status of Cholestin’s dietary supplement ingredient and to allow its import and continued marketing during the pendency of that proceeding. In the end, FDA’s decision turned on the specific facts concerning how the product was manufactured and promoted, including that it had been engineered to have levels of lovastatin more similar to those found in an approved new drug than to the levels found in traditional red yeast rice products. Nearly four years elapsed from the time FDA initiated the administrative proceeding to the final court decision affirming FDA’s findings. Cholestin remained on the market during that time.
In a similar case, Biostratum filed a petition with FDA to request that it take action against manufacturers of pyridoxamine supplements because Biostratum manufactured pyridoxamine dihydrochloride, which was the subject of an IND application.[16] FDA concluded there that products containing pyridoxamine were excluded from the definition of “a dietary supplement” because pyridoxamine was authorized for an investigation as a new drug and there was no good evidence of prior marketing of pyridoxamine in dietary supplement type products prior to the passage of DSHEA.[17] Again, the decision turned on the inadequacy of the factual support regarding prior marketing provided by the supplement industry. Biostratum began asking FDA to take action regarding pyridoxamine in July 2005, and the FDA finally decided the matter in January 2009. Pyridoxamine supplements remained on the market during those three and a half years.
In the case of CBD, FDA has already informally invited public comment on whether evidence exists that CBD was marketed as a dietary supplement or as conventional food before the start of substantial clinical investigations involving CBD. This openness to other evidence and the red yeast rice and pyridoxamine precedents suggest a potential openness to an administrative proceeding and a formal resolution. But more likely it is the proverbial invitation by the spider to the fly, unless the CBD industry can gather substantial information to rebut FDA’s present view. Accordingly, before the CBD industry jumps at FDA’s informal invitation and seeks a more formal resolution, the industry must gather and evaluate the factual support showing that CBD-containing supplements or foods (e.g., hemp products) have a long marketing history. Given the uncertainty created by FDA’s pronouncements on CBD over the past year, CBD-supplement manufacturers and distributors seeking clarity on the future of these products should consider joining forces to examine the factual predicates available to challenge FDA’s preliminary determination about CBD dietary supplements.
The CBD industry has had substantial support from families who believe children with severe epilepsy not responsive to conventional therapy respond well to CBD products. Those families have become patient advocates for state and federal laws that make or would make CBD lawful for a variety of uses. This movement, along with the passage of state laws making the use of marijuana lawful for medical and even recreational use, would provide a strong base to seek FDA recognition of CBD as an acceptable ingredient in dietary supplements.
Note that, even if the CBD industry cannot marshal sufficient evidence of prior marketing of CBD dietary supplements or foods, the law provides a potential pathway for CBD dietary supplements. The last part of the approved drug/investigational drug exclusion from the definition of a “dietary supplement” contains the following proviso: “unless the Secretary, in the Secretary’s discretion, has issued a regulation, after notice and comment, finding that the article would be lawful under this Act.” In FDA’s Draft Guidance for Industry: Dietary Supplements: New Dietary Ingredient Notifications and Related Issues IV. D. 8 (July 2011), FDA provides its interpretation of this language as follows:
The general rule is that an article that has been authorized for investigation as a new drug or as a biologic before being marketed as a food or as a dietary supplement cannot be marketed as a dietary supplement if substantial clinical investigations of the article have begun and the existence of such investigations has been made public. FDA can create an exception to this prohibition by regulation, but only if the agency finds that the use of the article in dietary supplements would be lawful. To date, no such regulations have been issued. The appropriate mechanism to request such a regulation is to file a citizen petition under 21 CFR 10.30.
From red yeast rice and Pharmanex, pyridoxamine, and, so far, CBD, the dietary supplement industry should understand that administrative processes and proceedings involving disputed ingredients take a relatively long time from beginning to end, require substantial fact finding and analysis to show that a product was a dietary supplement or food first and an approved or investigational new drug second, and, in the end, DSHEA itself provides for a citizen petition to have FDA simply declare the ingredient lawful. Given its botanical origin and strong grass roots support, CBD could make an interesting candidate for this regulatory override option.

The other day the Wolf posted a breakdown of the sales per stores and comparing CVSI with CWEB. An individual from another forum came over here and disputed my analysis which he had every right to do. In his rebuttal of my analysis, I came to the conclusion he was either trying to spin my results or he had no idea what he was doing. Later he admitted to another poster he wasn’t certain about some of the things he countered me on. I tried to correct his analysis in rebuttal. We went back and forth without agreement. Then he started posting negative posts about our CEO. That is when I recommended we continue our discussion about the sales per stores to his board. He didn’t want any part of that when I copied and pasted my analysis on his board along with a new discussion. He didn’t want anything to do at that point so I left their board. I later realized he had scrubbed my post. He told one of our investors on this board on their board that I called him a name. He came back on this board criticizing our CEO and I called him out on it. Another one of his cohorts came over and tried to rebut my analysis and tried to spin it with her made up numbers. Yesterday, another his counterparts came over to our board and attacked me and our company in a disrespectful way about my analysis. I then took that same analysis to their forum and they ignored it, not even trying to rebut it. I will give the young man some credit where credit is due. He returned to our board and did not criticize our CEO. What he did do is he posted 11 times about some things that were informative but mostly negative about our company. I can understand why he wants to come to our board. In comparison, we have four times more followers on this board then they have on theirs. I noticed yesterday that we had over 120 posts and they had 63. Out of the 63 posts over there this individual posted a total of 33. The other 30 posts were from 7 other posters. Two posts by me, one from Space Lady saying goodbye to her friend, and 5 from Clark Kent you understand. What I’m trying to get at is, it is not worth the time and energy to counterattack these lonely souls by going over to their board and doing what they have attempted to do here is trying to disrupt the positive forum we have going on here. If you truly believe our company is everything we know that is is. It is again not worth the time and effort to even confront these lost souls no matter what they say and do. Whatever we say on this board or their board to counterattack their opinions or deceptions or retaliate is not going to change our opinions about the Diamond In The Rough that we hold. Take a look at this silent but thriving company out of Utah my former wife and I were involved with in the early 90’s. Can you imagine, they were using placenta in their products at a time when aids was prevailing. The competition was using fear tactics in order to keep their flock from ringing door bells (Avon) and jumping ship to pull fog horns you understand. If you recall, in the past their was a loaf of Btrad called New Harvest, they too had NH ad their registered trademark. How many of you remember that Bread but don’t recall the Corporate name? Space Lady mentioned using cross marketing to introduce the New Harvest name into the market using a slow approach. Man, this company and this CBD market and the world in general forgot what the word slow means in this fast paced environment. Like Playonthedivine mentioned in his earlier post, when you refer people to Plus CBDOIL oil you can tell the person CV Sciences and they would easily forget it or confuse it with the sound of CB Sciences which of course wouldn’t be a bad thing since it is only missing the D you understand. Do you the Japanese Patent And from the Translation they referred us as CV Sciences. I believe there is a company with that name. I believe it was AP17 in his earlier post that their was a company called CBD Plus. They are out of LA if I recall. If you tell people about Plus CBDOIL and they google it wrong or they are dyslexic, they will be directed to the wrong company. This will be resolved soon because we have been using our tradename in commerce longer then they have and we registered our Plus CBDOIL name for that very reason for protection from the confusion. If you tell people that our product is New Harvest Plus CBD without the word oil then they have less words to remember. Oil, when I called the Virginia Beach Kroger’s store recently to see if they were carrying CBD products, the store associate wasn’t sure, I told her I was looking for Plus CBD Oil. She returned to the phone and started giving me Brand names like Pennsoil, Quaker State, etc. There are a lot of people who know little about CBD Oil. If you noticed, one of the Trademarks is Plus CBD. It is most likely that you will see the new labeling dropping the Oil. The public is aware that most people are educated enough on that word because most of these smaller companies are using Oil in their names. If we decide to add New Harvest to the mix along with Plus CBD then it gives more visibility from 10 feet away as Space Lady mentioned from her conversation with one of the companies representative. When I mentioned New Harvest some of you were and still are fearing the possible change thinking like our good little buddy ST who Reminds me of Gilligan you understand. He came on today and claimed it was a bad idea. That alone should make you realize that you think the opposite of what he thinks or suggests on this forum. He is mostly negative on this board in his postings, for obvious reasons. From this point on I am going to refer to Space Lady on this board as such because the short reference of ST and SL are confusing the devil out of me you understand. That is why I refer to Him as Super T. Back to the New Harvest Trademark, The Wolf has another drawn out post pertaining to that least important topic. Space Lady mentioned cross marketing and focus groups. Focus groups were mentioned by Mr. Dowling in his letter as consumer research. Marketing research can involve focus groups, surveys, etc. The New Harvest trademark is already set in stone in my opinion. The Trademark was used in the past and abandoned last year by DuPont, a company whose Subsidiary is involved with the making of our gummies product. If you recall, CV Sciences registered the trademark containing a product they once marketed called Pro CBD OIL. Some of you still refer to Pro but the company decided to stay with Plus and differentiated the Pro by using colors on the labels in its place. Pro in reference to the Gold standard. The color Gold being in the consumers mind as more superior to the color of silver and in our case green and red. The company also has another trademark besides Pro CBDOIL that they appear to be abandoning, that being Plus Hemp OIL. This apparent abandonment should ease your minds that CBD is not going to have to be dropped and replaced with Hemp to appease the FDA. That is no longer a legal factor from this point on you understand. The other Vertical companies will benefit less because their costs will be variable on the up side in most instances by having to pay for increases in planting, taxes on land use, fertilizer, 401k’s FICA match, Taxes, pesticides, siesta breaks machinery, Labor etc. I recall JD when he mentioned Coca Cola and how they benefit by outsourcing Bottlers, Distributors, etc. Good to hear from you. They could be planning to do consumer research on the New Harvest ™? Tradename along with Plus CBDOIL or new labeling. I never suggested dropping the Plus CBDOIL, but just adding it to the label. Who knows they have changed their corporate name before, They could possibly separate CV Sciences and make New Harvest into a Division of CV Sciences, separating the two units.
We are also accelerating our Direct-to-Consumer tactics, including a redesign of our PlusCBD™ Oil consumer site and adding tools to accelerate online sales.

According to a conversation that Space Lady had with Mr. Dowling and she stated it on this board, I believe she stated he told her it would be for future use. I don’t want to misquote her so maybe she can post her conversation with him. Why are thay registering New Harvest with the USPTO and spending itheir energy and resources. When you read Dowling’s’ letter yesterday he mentions that he wants to do a brand refresh. If you read the links to Brand Refresh you can see that it pertains to many marketing and advertising fields as well. Tradenames, Logos etc. in my Marketing and Marketing Research classes in Undergrad and Graduate work . I studied Brand Refresh, Branding, Rebranding, etc. This is all I can share with you maybe you can call the offices and direct your questions to them, BTW the other day you posted to my link that you were going to do an analysis comparing sales per stores between CW and CV.
