Ugh... non-disclosure of this fact by management sets them up for shareholder lawsuits. It is a HUGE mistake, as it was very material to future earnings. Even if they still plan to build them under a re-worked deal, this still needed to be disclosed.
Yes... and ASAP... if the report is false, whoever wrote it and whoever paid them to write it needs to go to jail... if the report is true, the company needs to lawyer up, as they will spend the next 3 years dealing with shareholder lawsuits... if there is some truth to the report, the company better explain it all by the end of the day.
My monthly Roth IRA deposit goes in on Monday. Planning to buy some more FCEL... however, there is a CBD penny stock I follow that frequently has 20-30% swings in a day... I might put it in that first thing in the morning to try and buy below Friday’s close, and then sell it later in the day if it turns positive... and then put the money into FCEL. We shall see.
Preferred dividends are required to be paid... better to use cash than debt to do so. The filing also indicated some would be used to pay down debt if I recall.
Yes, and hopefully yesterday’s news will help lead to a new customer that had been “thinking about it” to go ahead and give FCEL a chance... and then hopefully THEY will become a repeat customer a couple years down the line.
Well, in the long run, these shares will impact the stock price in a much more positive manner than trying to pay down debt taken for building these projects... so instead of large debt payments holding the stock down In 3 years, the revenue will go towards better purposes, which would mean a highrr stock price.
It all depends on what they price these new shares at. Unless they have and I didn’t see it..
Having REPEAT customers is always a great thing when trying to sell to new customers... they see that other customers are satisfied enough with the product and company that they deal with them again. That always helps the confidence of potential customers.
While I haven’t read the details, as I am at work, I am going to take an educated guess that these projects announced this morning should be completed by late 2022/early 2023. Being that they are all in FCEL’s home state of Connecticut, they should already be very familiar with what needs to be done to get all the necessary permits, good construction contractors to physically install it, and a very short distance to travel from the manufacturing plant in Torrington. So there shouldn’t be any delays with these 4, IMHO.
Finally some meaningful newsworthy project wins!!! We should go up 20-25 cents at a minimum on this type news!
Possibly, the dates FCEL gives for project completion regards for THEIR aspect of the work, and does not factor in completion by 3rd party construction or inspection work, etc... They can't control delays in that often. So maybe FCEL is done with everything they need to do for Groton and the issue is with a 3rd party contractor?
There are many companies out there trying to do what we do. What makes you think it is us they are trying to buy? People have been suggesting we would be bought out for the last 15+ years here... IF it would happen, which I seriously doubt it will, Exxon would be the one.

Yes, if production and quality standards are not met... hence not truly a Vascepa generic. Or if tests show it lacks quality after approval, they can pull it from the market. It is very hard and expensive to produce... at least that is what AMRN tells us.
It’s obvious that the laws need to be changed... their job is to apply the law as written and not to see the potential outcome of the ruling. I am in favor of lowering drug costs... However, I think a deal can be struck where the government can set the prices for prescription drugs, based on the amount of money spent developing it, selling it, and producing it so the companies can make a fair amount off it each year... in exchange for the price control, the company is granted 50 years of exclusivity before any other company can create a generic. The only risk would be if someone else develops a more effective product.

Any idea how the judges are selected? Random draw or are they chosen... and if the latter, who makes the decision?
Any lawyers familiar with the appeal process.... here is a question: Would it be normal for judges to ask questions of the side that is appealing the initial ruling and not of the side defending it? After all, what do they have to say other than “the ruling was correct because of X, Y, and Z.”? Isn’t it up to our lawyers to demonstrate that the ruling was incorrect because of A, B, and C? They ask questions of our lawyers because WE are the ones APPEALING the original ruling.

I just added on the big dip in attempt at a day trade... put in a sell order $1.00 higher for 80% of the shares I just bought (so I can buyback the stock I sold to get them) and increase my overall holdings in AMRN with the other 20% of the shares I just bought. Not many shares overall, but a lot for me.
Probably a stupid question, but I am not involved in the legal profession at all... but when an appeal is filed, would it be expected that the judge(s) assigned to hear the appeal would read the entire transcript of the intitial case prior to hearing the arguments on the appeal? Thus each has an idea of how they would have ruled initially? Or are they going in blind and will review only the portions of the case brought into question during the appeal?

See, if a remand makes it very difficult to rule how a judge wants, then shouldn’t the appeals court just make the ruling based on the proper interpretation of the law?
Okay, thank you for that info. Do you happen to know, about on average, how often a case that goes back on a remand results in the original judge changing their ruling to the other party vs sticking with their original judgment?
Question (and I apologize if it has been asked before)... IF the 3-judge panel’s decision is to send it back to the lower court for reconsideration instead of making the decision themselves, would it go back to Judge Du, or might it go to a different judge at the same level?
I seriously doubt it... pharmacies report it to the two services that compile the data. I don't think they collect the information whether a cardiologist, PCP, or nurse practitioner issued the prescription.
The only confirmation is that they have yet to issue a PR indicating it is done and now in operation.
No legitimate judge should have a case decided in mind before hearing the arguments. Just need to be educated on the case to be able to ask the correct questions during oral arguments. But to have already made the decision prior to hearing the arguments is not how the legal profession works. One of my best friends is a Circuit Court Judge here in Florida.
Its all about educating the primary care physicians and improving the tier levels of insurance coverage.

Isn't the Groton project with the Navy? The first link, the writer seems to say it is a 6.5 MW with Pfier in Groton, CT, like he is getting the 2 projects merged... or is the project we did for Pfizer a while back also in Groton, CT?
I respectfully disagree.
I think if generics are allowed to prosper on all your hard work you lose innovation (See AMRN vs Hikma and Dr. Reddy)... so if you grant 50 years exclusivity in exchange for price control that allows for a decent profit after all the money spent to develop a drug, then everyone wins.
The best way to keep drug prices down is this: based on how much it cost to research, develop, and manufacture a drug, the government should set the price that can be charged so everybody can make a fair amount of money. In exchange, the company gets exclusivity from generics for 50 years once the drug receives FDA approval. That is what I think should happen.
How many small, family-owned businesses were put out of business by Amazon? People that merely wanted to make an honest living and feed their family while saving for retirement? Now they have to work for Amazon making minimum wage just to put food on their table a d pay rent/mortgage? The greed of a few has had dire consequences for many.
Exactly why they should pay higher taxes... the wealth had accumulated at the top! The rest of us fight for scraps. And technology/cheap labor overseas has caused massive low-level job losses, NOT immigrants!!!

Raise taxes on the rich... and not all of us are wealthy enough to worry about capital gains taxes... all my stock/fund holdings that are not in my 401K are in my Roth IRA.
