sooo moon turd 99, why are you here if you aren't investing , nor interested in investing in IDCC? WHy waste your time here? QCOM needs you......
sail...I think NOKIA will need a carrot or a big reason NOT to let this draw out as long as possible. If there isn't a strong benefit for them financially to settle early on, I think they push it out as far as possible. Hopefully IDCC has something up their sleeve along with a strong backbone.
Stock price...been holding quite steady in this 14.80 range for a number of hours...are we putting in a bottom....
Pago Pago...I think you and I are on a different page here...yes it is putting $$$ in the coffers but in the big picture those are very minimal dollars coming from ERICY, especially without a 3G license attached. Secondly, it was presented to all that this would get NOK and Sam finalized and as of now it hasn't (I am fairly certain it will be finalized how long and how much is the big question).
Pago Pago...I don't know that I could agree with you that IDCC "Prevailed over ERICY".....
OT: mschere...you have a PM
pochemunyet....yeah that is what I said $4 dollars ago....stuppy me....parted with 25% back at 19. I am still waiting for it to take the turn back, so I can buyback but unless we get some news or K of P does something to support this thing, I think the trend will continue....
thanks...I'll send the jailbird a note...with a file or key in it!!
Learning2vest. In my opinion its an easy answer. Its fourfold
1. It is a LOT of money, any reduction they can get out of these actions may be substantial.
2. IDCC's history. IDCC has oft been the loser in any legal action. NOK may think they can make these guys blink because just in the last few months they once again stayed true to course and settled for pennies on the dollar
3. Might be a good time to "aid" the share price in its move down (to about $15 a share)and aquire 4.99% (2.8 million) of the shares. Settle (for say $100 million, heck IDCC's history says they would be ecstatic with that), move the price back to about $30 a share and sell their shares and cash in $42,000,000 ($30/sh-$15 sh X 2.8 mill shares). Net effect you pay 58,000,000 of the 180-220 million IDCC asked for. Either that or keep your shares and ride the gravy train.
4. IDCC mgmt embarrassed them by airing the dollar amount publicly. That might have been the straw that broke the cames back of the upper tier of mgmt. The brainiacs do well with each other, upper mgmt "maybe not so good"
Speaking of MIA, where is Jimlur, teecee, and DannyDetail? I would like to get a flavor of how they feel these days....those are 3 guys that generally have a pretty good take on things..
eneerg...time for our mgmt to learn some of these lessons and put them to use for OUR good...Nokia knows how to play the game, our guys are just learning...BTW, one cheerleader down...I'm as long as ANYONE here but its time to open our eyes and see what is happening all over again. If we don't recognize things time after time, we learn nothing. So far the naysays have been right,...I have been wrong....round 1, 2, 3, 4, 5, 6....to them, hoping I get the last round right
H42, I tend to agree with you on this one. Howard did offer the disclaimer that it could go to arbitration but in every way shape and form he painted a picture that that was a remote remote possibility. I thiink there is little doubt that this has all the analysts and one's thinking of coming on board, very defensive. Its all about trust and from what I have learned from some of the so calls "wall street pro's" here they don't liked getting blindsided like this. I think they have undone some good faith and trust they had finally established over the last couple of years
This looks like good enough reason (link below) for me.....re: doom and gloom. I applaud those that weren't applauding mgmt a month ago just because as some of the biggest mouths here were saying "what has the stock done since March". In case ya'll haven't noticed, what has been accomplished since March 17th in the way of benchmarks with IDCC? Remember how many here said there would be 20-25 licensees waiting at the door to sign up once ERICY was put to bed, where are they? The indeminfier is on 3G not 2/2.5G right so where are all these new licensees? Still no goals/plan for 2003? Mgmt should definitely be belling up and buying on the open market to show some faith...
http://table.finance.yahoo.com/d?a=6&b=04&c=2003&d=6&e=31&f=2003&g=d&s=i...
mschere...any thought as to NEC deciding not to pay based on the indeminfiers proposal to other unsigned potential licensees? They have a contract, they have been paying (setting a precedent) but I am getting leary of us enforcing on any of the G's (to the big guys) while we are once again tied up in legal proceedings....we are not getting our due or the respect we should and I just have to think that the guys that are paying. where the majority are not, will have questions as to why they should keep paying...heck contracts don't seem to mean much to many of these thiefs....
revlis, totally agree we don't know who it is, but to me if IDCC brought it up, it is a concern to them that has financial effects on their model.
mschere...but how can we conclude that it is only a minor issue for us when IDCC has stated that it is impeding their ability to license...not signing, thus not collecting is a big issue in my book...thats called revenue, something we sort of want isn't it?
ams, you might be onto something. Recall the "damage control" cc? Rip or Merritt commented not so secretly that the engineering folks still have a great working relationship (ie mgmt's might not see eye to eye) Maybe one of the lone snoozers is holding up a compromise that would get most everyone happy. Gripe away all of you that feel the need but I think our mgmt mishandled the ERICY settlement cc and now NOK is PO'd that they aired the numbers in public. Additionally they feel stretching this out is worth any gamble involved and that IDCC's track record is to give away the farm when their back is against the wall. Maybe just maybe IDCC is finally standing up and saying the "buck stops here". Somewhere they have to set a precedent for not backing down like the ERICY debacle and maybe this is finally the time. It won't be easy or pleasant but I for one would rather see them give it a sincere try and if they fail, find a buyer that can close deals and enforce patents...
yarxxx, yes I believe the super qtr will help the stock move from 14 back to the 17's...big deal..frustrated and hungary today...delayed and denied AGAIN...this has that ERICY feel to me...it was said arbitration sets a timeline to finality...my question is how long can it be dragged out before we get to arbitration?
I'm not real bright but I can do some simple math from there!!!LOL. It has been said for years with this investment but the big word is "Patience", some can tolerate the turmoil on the way there some cannot...doesn't make anyone bad just maybe not suited for this investment...
that is certainly what I read teecee....4.27 for fiscal 2004 would be just fine by me...
I'm no expert but don't think you need to be at this point in time. We took the big hit. It seemingly is done. Downward movement...no good reason for it right now...nothing has changed except timing. Upward movment, not much reason for it either unless we get new licensees or surprise upside on earnings. We are still in wait and see mode and I feel until NOK is resolved we will maintain the 17 to 20 dollar range....All it is for anyone at this point in time is a guess......
deleted.....someday we will know who and why....
could very well be...I think most here (including me) assume its QCOM, however it could be someone else and if we knew who it was it may shed a whole different perspective on what its all about....(ie what if it turned out to be NOKIA)I'm just searching for possibilities and appreciate you offering some sincere input...
I'm obviously a little thick in the head mschere...my question is why isn't the indemnifier named?
IDCC states that they are finding reluctance to signing new licenses because someone has indemified agaisnt their IPR on 3G. Why can't they just say who it is that way it would be a little more enlightening as to the reasoning,....possibly. I think they ahve every right in the world to say who is hampering their business
to any and all....why would the indemnifier not be made public? If someone is essentially trying to destroy your business shouldn't you legally be able to let the rest of the world know who's trying to cut your head off? Or is this just IDCC's decision for some reason? If so what reason could they possibly have for not wanting to say? An Inquiring half of a mind wants to know.....
unfortunately YES...I have resisted and fought that feeling for sometime but I am starting to think that these battles one after another after another would be much less prevailent with someone with a bigger stick.....
mschere...here I thought maybe a lot of the shorts had decided to cover after the big drop.. It doesn't sound like it if you listen to some here though, they say we are not done "going the wrong way", at least in our long eyes...
Loop, regarding the following from your post:
At what point does NEC have to inform IDCC that it has been the only infrastructure company paying since 2001 and can no longer compete and pay royalty in the sector. Do you see a potential mandate behind the curtains? At what point does IDCC owe its paying customers a duty to enforce the technology that it has licensed? Is 2 and 1/2 years Ok, too long or on the borderline?
This is something that I have really been concerned about. In an extremely tough and competitive market slight percentages are make or break. The guys that have been paying have so far been deemed the "honorable ones" but I thiink as ERICY wiggled out, and Nokia is trying to reduce their obligations, many of the "honorable ones" have to be taking a second look at what they are doing. In some cases these guys are in survival mode. When they see their competitors ignore Interdigitals licensing they are going to be forced to consider the same....JMO
BTW, as a sidebar, I am starting to have concerns that Merritt is incorrect in his continued statements that present proceedings will not have an effect on signing new licensees for 3G. I don't believe that. Just as in the case with ERICY (see all the "trigger" talk), Interdigital will continue to have those out there using their IPR until they PROVE they can enforce it and collect on it. To me it doesn't matter if it is 2G, 2.5G, 3G or even 4G, until you break some legs infringers will stall, contest, ignore.....Question for all, we have IPR in all 5 modes of 3G, correct? How much infrastructure and handsets have been shipped around the world? What percentage have we been paid on?
Go ahead IDCC break some legs and if it takes you a year to do it FINE but it is time to **** or get off the pot. Don't settle for a pittance, GO GET what you are entitled too. I don't want to play this game year after year, "G" after "G". Its time to take a stand and go after everyone with utmost vigor, nice guy isn't working, just ask our "friend and partner",.........NOKIA
yes...I think based on what might be happening that we will be above break even. No I don't expect anythign even close to last qtr but think that we might be surprised with 2-3 cents on the good side of the equator....
Isn't the analysts concensus for Q2 -.03? If so I would imagine we will blow that out of the water...I think there is somethingup their sleeve.
sjratty. I heard and thought the same thing. I had almost forgotten about it until about 10 p.m. last night and wondered if it had been talked about here...I think we might have a little surprise...
call is over, no bombs whatsoever. We will see how the market reacts. I just have a sinking feeling we are kind of stuck in the mud until this is resolved...., JMO
LongIDCC...any info that you can provide would be appreciated...thanks
ams, I am really surprised that you didn't comment that the price is staying up pretty well at this point?
nieves.....can get anything out of that post....clue me in...when you say "In Play" I thought there was an article saying they are for sale..
mschere...don't be so sure that we are going to get all this wonderful support from the analysts and institutions today. My guess is exactly the opposite. These guys put some serious faith in management leading them down a particular timeline and it looks like that could be substantially altered. They may have no choice but to downgrade due to this delay. I doubt they keep a 12 month price target of $34 when the quote out of the Philly paper said it could take a year to resolve this....Hope you are right and I am wrong, I don't want another painful day today.
dd, I wondered the same thing regarding the timing...seems a little odd. You would think they would have waited until after the bel just to give people a night to absorb it and get over that instant reaction. Oh well, I'll buy more in the a.m. most likely...Gamble a little more what the heck!!!
good point Bob and maybe that is NOK's thinking...tie it up for 18 months and wait for handset market and general economy to recover....In all honesty if I were NOK I would look at IDCC's history in legal matters and take my chances with waiting it out. I can't believe that ERICY will not fight having those docs opened, as I bet IDCC will too.
georgebailey..If indeed what you say is correct, would you think that IDCC had all those i's dotted and t's crossed before putting ERICY to bed. I would have thought that F&J would have anticipated this action by NOK and had it down stone cold in the ERICY docs. If IDCC fights the opening of the docs, then I would guess there is a problem within...If they allow it immediately I like your scenario....another thought, would ERICY get involved and try to keep the docs from being opened?
mschere...curious as to what you are thinking this late afternoon? teecee?
