Here is what is needed for NUBV to succeed beyond the present day debacle. Firstly, they have a great business concept. Unfortunately, there is a long road to hoe from here. Credible leadership with integrity and proven track record in startup business ( no business builders in current group only syphons of investors monies). Cash or financial backing (they come up with a goose egg here, need to invest in the business rather than lining their pockets with investors monies). Market commitments for distribution (we need a bonified PR here Walmart, Target, etc). Production and Product to meet commitments (we need a verifiable PR here). Distribution - means of moving the product to the marketplace (who is there distribution partner). Infrastructure to support business (Operations, QC, Logistics, Procurement, Sales, Marketing, Accounting). You can't do business without an Infrastructure to support it. Conclusion to date IMO, Great Business Concept with no foundation. At present this is a house of cards. Probability of success is for you to decide. It's a no brainer from my point of view without addressing the aforementioned points. These are key elements to executing a successful business plan.
I am not on the inside. That's been coined by my critics. I am just closer to the history and situation then most. Yes we are working to reach agreement and willing to do so but Luke et al missed a conference call and have not responded to emails or phone calls to reschedule. Getting a new CEO is not the top priority ... rolling out product is. They don't need a CEO to do that. They need a production facility and utilize their infrastructure to get this to market ... that is of course assuming the sales and marketing effort has generated opportunity ie. Target, Walmart, Walgren. The problem is if you have a commitment you can'y miss the date or it can take 12 months to re-enter. The beverage market is already cluttered with market hype me too products. Speed to market is the 1st priority
My investment dates to 2003 and is with Impact Beverage, Inc. The owners of the patent rights which Nickolas only owned by rights 72.25%. I don't invest in or own pink sheet stocks. A significant % of these plays are scams. Trade shares, reverse mergers, big salaries, no return to investors. Notice most of these mergers do not involve cash ... just exchange shares and chance the business concept. Ron is a perfect example. My partners and I have a legal right to 27.75% of this patent and Nutripure Beverage.

As the Charmer has stated, we all have our own positions and desires to recover and make some dough. At the very least break even if this doesn't unroll favorably. I wish I could be more transparent but I am walking a fine line now.
We have legal recourse, but we also have influence and can control supply change to be able to practice the technology. The quality of ingredients and the sourcing of other proprietary technology are the most critical and the patent is worthless without them. The process isn't the most unique feature of the patent. That is being practiced today with sweetened and flavored products. Ingredient technology is where the secret lyes.

Kaz you have 20:20 vision. Lack of communication is disconcerting, but this is a real mess. Luke is an attorney and doesn't have a staff large enough to unravel it all. If Andy or I don't here from him this week we will be turning things over to our attorneys. Unfortunately, legalees will just bog things down. This is not the path we wish to take, but he needs to maintain a two way communication or we have no choice, but to go on the record legally.
We have extended our Olive Branch. Luke has moved underground and has not been very responsive this past week. I have not thrown my hat in the ring. I currently, would have conflicts of interest, but you never can tell. Luke knows we are willing to cooperate and offer our assistance to allow NUBV to move forward, but Nickolas has to be out with a guarantee never to return. That is the only caveat.
The patent is a process patent ... in todays world isn't worth much in delivering the aforementioned products to market. The liquid delivery for nutriceuticals has come along way. You can buy liquid glucosomine for addition to pet waters as an example ... not all that common 6 years ago. These type of systems have emerged in the international, pet food and supplements market already. It will be mainstream in beverage applications before you can bat an eye. The strongest market potential is Southeast Asia. The US beverage market is cluttered with Market hype, me too products. I am in the Food and Beverage Industry for over 30 years. IMO from my birds nest and provided everything could be cleared up quickly, the product is yearend at best and more realistically 2009. Thwey need to announce they are free and clear to move forward and that isn't any time soon if Nickolas has his way. According to Luke he has not been very cooperative and forthcoming to resolve the issues.
I do not owe you full transparency. I have provided many snipits of info. Names, companies, products, failures take that info and do your own DD to verify and form your own opinion and report back to the board. I have nothing to prove to you or anybody else. Yes and No to Steve not sure about Luke. Luke is an attorney, he is serving as interim CEO for an obvious reason. He admittedly knows nothing about the business. This guy is still a young buck attorney (36). I am not sure about the hornets nest that Luke et al are dealing with Steve. I know Nickolas has burnt many bridges and pocket books ... not sure if we can clean the mess up in time before NUBV is trumped in the marketplace. These type of products will be launched worldwide by a global company by yearend. I think it may be too little too late for NUBV. This is a totally different scenario to that of Coke and Glaceau.

He forwarded a response to one of my emails to Zouvas this afternoon. However, these guys seem to have gone underground for obvious reasons. I' ll let you know what I can and as soon as I can. Stewart is insisting on a guarantee that Nickolas is totally removed or he will issue a cease and desist injunction on the patent. The lien does not prevent them from practicing the technology ... they just need to come up with $350,000 in greenbacks because of the transfer XND to LDH t0 NUBV.

I am sure he can share some stories. Ask Steve himself since your buddies about the Quench disaster. I was testing the water on the board to see how informed you are ... not very. All you guys keep talking to Nickolas, Ted and Jess ... they have no power or forward control. They are right about one thing Nickolas won't go away easy and this company is going to be tied up in its' undies for some time to come.
The last I talked to Zouvas they were actively looking for CEO candidates and the bottling company that bailed on them because of all the BS was back on board. I told Zouvas without my partners you can't produce the product that has been marketed. I still await a response.

I mentioned before that new revolutionary products will be in the market by yearend. This was too little too late for Nutripure because they would have been swallowed by the whale (out marketed and driven out of the market). There is no infrastructure to this so called enterprise ... if there is a change for this to turn around it will be too late. At this level you can only buy time. Probability is remote IMO.
Brasco I was involved with Nickolas over 6 years ago, before all of this came about. I bought in for the same reason as you because this product was the next best thing since sliced bread until he started going through money like water. He can charm the siver off of a mercury head dime. He absconded the company funds because he was within 30 days of losing his house. He even stole from his wifes brother who is in the water business. We had the Quench Water deal collapse because Nickolas couldn't buy the Silver Bullet Technology because he duped that investor and tried to send the Japanese moldy contaminated water ... the bottles exploded from all the gas buildup. Then catch this he tried to pass off regular water for and enhanced and got caught with the replacement container ... like the Japanese weren't going to test the product after the first fiasco. We have a case on file, but he keeps changing law firms because he doesn't pay his Bill's. When he went public is when he exposed his achilles heel for us. Now we are going after him, Zouvas et al found out about this stuff and canned his ass. I came out of the closet because my colleague was getting response. That's when I jumped on this board.

That's great!!! 98 out of 100 new startups fail ... usually have one or two seeds of destruction. we certainly don't need to read between the lines to figure out NUBV's probability of success. They are not flavored but the nutriceuticals are predominantly masked. Example mineral waters have a slight mineral flavor compared to that of purified or distilled waters that are flavorless. In the case of vitamins the water won't taste like you were eating a tableted vitamin that most consider extremely objectionable. It will have a slight flavor but not objectionable. It is not possible to add ingredients with flavors and expect them to be flavorless unless you put so little in the beverage that it has virtually no nutritional value. Years ago SoBe added botanicals but the levels were so nominal you would have to drink a case per day to have the same impact from a tableted supplement.
NUBV waters are not Flavorless, but the taste is not objectionable. It depends on the product and dosing levels. These enhanced waters are more on the flavor scale to that of city / municipal water versus spring water.
It's also loaded with Sugar (evaporated cane juice). IT'S ORGANIC is their key positioning. I e-mailed Brad - the CEO, the product will roll out National by yearend. This product lacks a antimicrobial agent. This water is at risk for microbial (shelflife) issues.
You are so correct. They have no money, have no credit and they are cut off from the key ingredient that is the silver bullet to the technolgy, the flavor masking and the antimicrobial.
Finally, a colleague from the industry. The patent is process. You are right about the ingredients. The proprietary art in minimizing flavor is with the other ingredients not the botanicals or nutriceuticals. They also act as a antimicrobial.

Brasco, I am tired of your BS. Take your pennies and go home. If all you want are hugs and kisses go to T**** BAR. These guys blew smoke up my skirt a long time ago. I have ownership rights to the patent. In fact, you probably won't see this in a PR, but they will have to pay for the rights and if not a cease and dessist is in process from our attorneys. They can't by the other ingredients to practice the process patent as we have influence and control over that. The secret is in the ingredients not the process. The window to make money is closing and quite frankly if Nutripure does not come up with an appropriate settlement to proceed this deal is done.
I have been involved with these guys much longer than I care to admit. That is why I say what I say. I just don't want these guys to continue to fleece others. That's why I share what I share. This product is the best thing since sliced bread, but these guys aren't going to make it happen. We need professionals and the guys that have the voting power don't have a clue. If and when we get a CEO worth his salt and builds an infrastructure to build a business ... then and only then should we buy with confidence. Otherwise this is just a dream. Within the year, you will see these products in the market from a giant, if they can't be me first then this will be worth squat. You can produce these products by not practicing the patent. Remember, I have been in the Food and Beverage Industry for over 30 years. I attend all the trade technology shows and call on this industry. I do have my fingers on the pulse and we are running out of time. If we don't lead this market then we are doomed. Remember a minnow can't swallow a whale. My posts are not bashing. I know a s*** load more than most of you. My investment is huge and these guys are dubious. These guys are not water walkers, sorry for the pun prior to Easter, I stand much to lose. If this goes South, I stand to lose more than most. I am only sharing info for you to make an informed decision. In life we all take the good with the bad. If you are that thin skinned BUY A CD. Ladies and Gentlemen, investments that return favorably are based on weighing the info ... how you personally interpret is your decision. Nobody is twisting your arm. Quite frankly, I LOL at a lot of the posts. The stock will only rise on buying confidence and quite frankly we have little positive info based on the facts to buy with confidence at this point. They are issuing stock instead of green backs to their creditors. It would be nice to now how many of these transactions are for cash. IMO
They owe a lot of vendors for services, lawyer fees, other investors, etc. to make this deal right before they can even operate. They have no money the only way they can pay is in stock. IMO
Guys you have cause for a class action. Zouvas needs to give up Nickolas. On the other hand, if he does he hands you the victory in the case. Nickolas wasn't summarily dismissed without cause. He was riding a huge PR wave then wiped out. The reason for being removed ... exactly what I told you from the mouth of Luke Zouvas. In terms of a new CEO, who would want to get involved in this mess. No money to pay the guy, a pack of PR lies (how much more is yet to be retracked or clarified).
