Using the ICANN Procedure
In 1999, ICANN adopted and began implementing the Uniform Domain Name Dispute Resolution Policy (UDNDRP), a policy for resolution of domain name disputes. This international policy results in an arbitration of the dispute, not litigation. An action can be brought by any person who complains (referred to by ICANN as the "complainant") that:
a domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights
the domain name owner has no rights or legitimate interests in the domain name, and
the domain name has been registered and is being used in bad faith.
All of these elements must be established in order for the complainant to prevail. If the complainant prevails, the domain name will be canceled or transferred to the complainant. However, financial remedies are not available under the UDNDRP. Information about initiating a complaint is provided at the ICANN website.
Suing Under the ACPA
The Anticybersquatting Consumer Protection Act (ACPA) authorizes a trademark owner to sue an alleged cybersquatter in federal court and obtain a court order transferring the domain name back to the trademark owner. In some cases, the cybersquatter must pay money damages.
In order to stop a cybersquatter, the trademark owner must prove all of the following:
the domain name registrant had a bad-faith intent to profit from the trademark
the trademark was distinctive at the time the domain name was first registered
the domain name is identical or confusingly similar to the trademark, and
the trademark qualifies for protection under federal trademark laws -- that is, the trademark is distinctive and its owner was the first to use the trademark in commerce.
Defenses to ACPA lawsuits. If the accused cybersquatter demonstrates that he had a reason to register the domain name other than to sell it back to the trademark owner for a profit, then a court will probably allow him to keep the domain name.

Essentially, it's required pot stocks to make a choice: Either uplist to the NYSE or Nasdaq and reap the rewards of improved visibility, validity, and liquidity, but kiss the U.S. market goodbye until the federal government changes its tune, or forget about uplisting and attempt to infiltrate the burgeoning U.S. cannabis market.

Gov. Mike DeWine has signed the bill for legalizing cannabinoid oil and hemp production allowing farmers to cultivate hemp. Despite the legalization, Ohio farmers seem to be waiting for the green signal for growing the cannabis plant.
The law permits farmers to cultivate hemp with a maximum level of 0.3% THC, the psychoactive compound found in the cannabis plant. THC or tetrahydro cannabinoid is the chemical in the cannabis plant which is responsible for causing ‘high’ when users smoke pot or weed. The chemical alters brain activity and causes hallucinations. If taken in high potency over a long period of time, THC can lead to permanent mental disorders or cause deteriorating mental health.
Contrary to the effects of THC, CBD is a non-psychoactive compound which does not produce any hallucinations irrespective of what form it is being consumed by the user. There are plenty of medical benefits of CBD; from treating acute pains to chronic ache to inflammation to swelling to reduce stress, anxiety, and depression, CBD offers a plethora of treatment options.
Commonly known as CBD, the cannabinoid is an anti-inflammatory compound. It is being used in various products, ranging from topicals, ointments, creams, tinctures, oils, skin creams to chocolate bars, gummies, candies, cookies, cocktails, salad, beer, and much more.
Despite the federal regulations legalizing hemp-derived cannabinoid, and removing it from the list of Controlled Substances, the Food and Drug Administration has yet to change its regulations. The FDA prohibits companies from infusing CBD in edibles and food supplements. Anyhow, business leaders seem to avoid the warnings by the agency and continue to create an array of CBD infused products that may not fall under the legal category of FDA regulations.
The executive director of the National Hemp Association, Erica Stark, says that it is encouraging to see Ohio join the CBD bandwagon with more than 40 other states that have legalized hemp-derived cannabinoids.
Stark says that the Farm Bill in 2018 has triggered a dramatic increase in the inclination towards CBD amongst consumers. Not only has the Farm Bill being able to pave way for companies to step into a booming industry but also gained traction in the consumer section.
Many people have started using CBD as alternatives to opioids, painkillers, anti-inflammatory medicines, antidepressants and replaced their ongoing prescription with the much renowned CBD. However, with the growing interest and faith in CBD, law enforcement agencies are concerned about the alarming levels of CBD- there is no scientific research as such which supports the claims of the medical benefits of CBD.
The FDA stands firm on its decision to prohibit CBD infused edibles and beverages as it says that public health and safety is their first priority. Before they allow companies to enter into the consumer market, they need to ensure its safe levels, and any side effects of CBD that could impact the overall health of a user in the future.
Later this fall, the USDA will unveil its guidelines for the federal industrial hemp program. Farmers are suggested to wait until there is a clear law and situation in place from both federal and state regulations, or else they could face charges.
Stark recommends Ohio farmers to proceed with caution- not only in growing hemp but also in making sure that they fully understand the rules and permitting process as they unfold gradually over time.
Stark added that it is best for farmers who are new to this domain i.e CBD to start small- going full 100% or even growing hemp in 20,50,100 acres directly could cost them a lot and impact their entire CBD farming lifecycle. While many farmers realize the power of hemp cultivation and are witness to the booming industry, they should maintain a safe distance from any legal charges or penalties anyhow.
She points out that cannabidiol or CBD is a more labor-intensive and is quite similar to growing tobacco, while hemp fiber cultivation is relatively simpler and resembles that of a traditional row crop, planted much like soy or corn.
Stark added that on one hand, there’s CBD cultivation and then, on the other is fiber and grain cultivation, and both are quite different business models.
According to the Ohio Department of Agriculture, the agency will start issuing a license for hemp cultivation and processing permits by next spring.

It includes a sample of over 30 individuals in each age group. The two variables are CBD and Hemp Extracts. The only research method needed is a non-formal interview. The question to start off with is “Have you ever heard the term Hemp Extracts? Followed up immediately with the second question only if they answer Yes. The second question if they answered Yes.”Do you know what Hemp Extract is ? If they answer No to the first question go immediately to the third question “Have you ever heard the term CBD. If they answer Yes. Then ask them a broad question, What do you know about CBD? These two questions should also be asked immediately after the Yes to Hemp Extracts individuals are questioned. It will take some time to complete your Interview research. The three age groups can be 18-29, 30-59, and 60 and above or what you decide on. This will give you a good idea why the two distinctions are important when marketing CBD products. Most people are more educated on the term CBD than Hemp Extracts. The reason is because the term Hemp has been out in the public longer and associated with the plant and the bi products associated with them such as clothing etc. On the other hand, for the term CBD, people are today being educated on CBD terminology and not Hemp Extracts. California Hemp Cultivation Law is About to Change, Again

A week or so ago, I wrote a post outlining the current state of California hemp laws, and noted that there are two pending pieces of legislation that could change the state of hemp law in California: AB-228 which deals more with adding hemp-derived cannabidiol to foods and other consumer products, and SB-153, which would re-write a significant portion of California’s Food and Agriculture Code that relates to hemp cultivators. Today, I’m going to talk about SB-153, which could have a massive impact on California’s hemp cultivation industry. Below are some of the highlights of the bill.
A New Definition of “Industrial Hemp”
Currently, the California Health and Safety Code defines “industrial hemp” as follows:
“Industrial hemp” means a crop that is limited to types of the plant Cannabis sativa L. having no more than three-tenths of 1 percent tetrahydrocannabinol (THC) contained in the dried flowering tops, whether growing or not; the seeds of the plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin produced therefrom.
Current provisions of the Food and Ag. code relative to hemp use this definition. But if SB-153 is passed, it’ll add a brand new definition of “industrial hemp” to the Food & Agriculture Code, as follows:
“Industrial hemp” means an agricultural product, whether growing or not, that is limited to types of the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, the resin extracted from any part of the plant, cannabinoids, isomers, acids, salts, and salts of isomers, with a delta-9 tetrahydrocannabinol concentration of no more than 0.3 percent on a dry weight basis.
To be clear, this new definition would be in addition to—and not a replacement of—the current state definition. And significantly, the two definitions are different. For example, the general H&S Code definition appears to place caps on the total amount of THC, whereas the Food and Ag code’s definition would place limits on delta-9 THC. This could create confusion or different standards among state agencies. We’ve written about how “total THC” limits have caused a headache in Oregon, and it’s possible that these different definitions could lead to similar issues.
Additionally, the Food and Ag code’s definition only applies to agricultural products, and may not apply to many other derivatives, for example, hemp products imported from other states.
A California Hemp Production Plan
SB-153 would force the state to create and submit to the U.S. Department of Agriculture a hemp production plan. If you haven’t read about the 2018 Farm Bill yet, in short, it allows states to set up their own hemp production programs after approval by the USDA. States aren’t forced to submit plans and have to affirmatively take steps to do it, and SB-153 would put CA on track to do just that.
New Definitions of “Established Agricultural Research Institutions”
Current California law creates a scheme for commercial cultivators to register to cultivate hemp, and then exempts established agricultural research institutions (“EARIs”) from needing to register. EARIs currently can include:
(1) A public or private institution or organization that maintains land or facilities for agricultural research, including colleges, universities, agricultural research centers, and conservation research centers; or
(2) An institution of higher education (as defined in Section 1001 of the Higher Education Act of 1965 (20 U.S.C. 1001)) that grows, cultivates or manufactures industrial hemp for purposes of research conducted under an agricultural pilot program or other agricultural or academic research.
Part (2) of the EARI definition is pretty consistent with the 2014 Farm Bill, which is still in effect, but part (1) is much broader. In the wake of this law, many institutions that may not necessarily qualify for cultivation under federal law would be able to cultivate in CA.
SB-153 would close that gap. The bill would re-define EARIs to only include:
an institution of higher education, as defined in Section 101 of the federal Higher Education Act of 1965 (20 U.S.C. Sec. 1001), that grows, cultivates, or manufactures industrial hemp for purposes of research conducted under an agricultural pilot program or other agricultural or academic research in accordance with Section 7606 of the federal Agricultural Act of 2014 (7 U.S.C. Sec. 5940) or otherwise approved by the secretary.
This new definition of EARIs would be much more in line with the 2014 Farm Bill, and would not allow many different kinds of parties to claim EARI exemptions. But note, this definition change won’t take effect until after the state’s hemp production plan is approved. So it could take a long time.
Expansion of Hemp Registrations
What will all of those companies who used to qualify as EARIs and don’t want to cultivate commercial do if the definition changes? Well, the answer is that SB-153 would expand required registrations from only commercial cultivators to include all cultivators except EARIs. So purely private companies who wanted to do hemp research and could not qualify as EARIs or work with EARIs would probably need to get registered with their county commissioner and follow the Department of Food and Agriculture (and localities’) requirements for registered cultivators.
Penalties for Misbehavior
SB-153 would add some pretty key penalty provisions that are not currently in the Food and Ag code.
First, SB-153 says that “[a]ny person convicted of a felony relating to a controlled substance under state or federal law before, on, or after January 1, 2020, shall be ineligible, during the 10-year period following the date of the conviction, to participate in the industrial hemp program.”
This is exceptionally broad. Anyone who has been convicted, ever, in any state, for any drug, would be barred from participating in the program for 10-years post conviction. We don’t have hemp regs yet or even know what the production plan will look like. But the extent of this could be far-reaching. If “ownership” is anything like in the cannabis rules, this may exclude a wide class of persons from even owning relatively minor stakes in hemp companies.
Second, “A person that materially falsifies any information contained in an application [for commercial or non-commercial registration], or other application to participate in the industrial hemp program, shall be ineligible to participate in the industrial hemp program.”
This is also significant. Companies who are seeking registrations will need to be 100% sure that everything they put into their application is accurate. Even minor slip-ups could lead to ineligibility to participate in the hemp industry.
These are just a few examples of the significant changes that SB-153 might bring about. The bill isn’t guaranteed to pass, and it’s possible that it gets amended again. It’ll be a while before it’s fully implemented, but it’s clear now that the state wants to get up to speed and in compliance with the federal farm bills as fast as possible. We’ll continue to report on SB-153 and its aftermath in the coming months.
An Update on California’s Proposed Hemp and CBD Laws

California’s legislature introduced a potentially game-changing hemp-derived cannabidiol (“Hemp CBD”) bill in January 2019: Assembly Bill 228 (“AB-228”). For those of you who aren’t familiar with AB-228, see my posts here, here, here, and here. AB-228 would change California’s anti-Hemp CBD policies, and the highlights of some of the more significant changes from the recent version are:
Licensed cannabis companies wouldn’t be precluded from being in the hemp business;
Hemp products that are foods, beverages, or cosmetics would have some minimal labeling requirements;
Food manufacturers that make hemp products would be required to obtain certain registrations and would need to demonstrate that their hemp comes from a jurisdiction that has an “established and approved industrial hemp program” that meets all federal requirements for the sale and cultivation of hemp;
The CDPH wouldn’t be able to conclude that foods, beverages, or cosmetics are adulterated just because they contain CBD; and
Raw hemp products would need to undergo certain lab testing and get certificates of analysis prior to sale.
AB-228 has made it all the way through the California Assembly and part of the way through the California Senate, with almost complete support along the way. AB-228’s most recent hearing in the Senate Appropriations Committee was on August 12, 2019, during which time the bill was placed in the “Suspense File”. The Suspense File is described as follows:
The Suspense File process has been a part of the Committee Rules since the mid-1980s as a way to consider the fiscal impacts to the state of legislation as a whole. The committee analysis indicates whether a bill’s fiscal impacts meet the criteria for referral to the Suspense File.
Bills that meet the Committee’s Suspense threshold will be placed on the Suspense File after testimony is taken at a regular-order hearing. A vote-only Suspense Hearing will be held prior to the deadlines for fiscal committees to hear and report bills to the Senate Floor. Bills will either move on to the Senate Floor for further consideration or be in held in committee and under submission.
At the Suspense File hearing bills are taken up alphabetically by author. There is no public testimony.
Being in the Suspense File doesn’t mean that AB-228 won’t pass—it just means that it’s on hold for the time being. In fact, this isn’t the first time that AB-228 has wound up in a suspense file. AB-228 sat in the California Assembly’s Suspense File just a few months ago. We don’t yet know when AB-228 will be heard next, but hopefully sometime this year.
Of equal importance is SB-153, California’s proposed bill to update its hemp cultivation laws, which I wrote about previously here. For a summary of SB-153’s important provisions:
Adding a new definition of “industrial hemp”;
Narrowing the scope of who qualifies as an established agricultural research institution to be more consistent with federal law;
Requiring CA to submit a 2018 Farm Bill-compliant hemp production plan to the U.S. Department of Agriculture;
Requiring registrations for commercial and non-commercial growers who don’t qualify as established agricultural research institutions; and
Creating enforcement provisions, penalties for false statements on applications, and a bar on persons from being a part of the industrial hemp program if they had a conviction relating to controlled substances in the prior 10-year period.
SB-153 was recently modified further in the California Assembly, and one of the interesting new modifications is the following:
Industrial hemp shall not be cultivated on a premises licensed by the department to cultivate or process cannabis. Industrial hemp, regardless of its THC content, that is cultivated on a premises licensed by the department for cannabis cultivation shall be considered cannabis as defined in subdivision (f) of Section 26001 of the Business and Professions Code and subject to licensing and regulatory requirements for cannabis pursuant to Division 10 (commencing with Section 26000) of the Business and Professions Code.
So the message here is that California Department of Food & Agriculture licensees won’t be able to cultivate industrial hemp on their licensed premises, and that if they cultivate plants with less than .3% THC, the state will consider them “cannabis” and subject them to all state-level cannabis regulations.
SB-153 was passed off to the Assembly Appropriations Committee, but it doesn’t appear that a hearing has been set yet.

After reviewing your post and links is wasn’t anything new. The Wolf gained more knowledge and information from the back and forth debates between DV and Jefra, and Space Lady. The only post I read of yours was when you came from the itsy bitsy spider board along with DV and Gladys Knight a few weeks ago. What I was referring to from the Forbes article is relevant and issues that haven’t been resolved as you stated. Here is what I was referring to from the Forbes article. Once again thank you for the compliment, I do keep up with the Industry. The only thing I don’t keep up with is your Valens Holdings. Like I said, they are not unique or superior to other extractors that I do keep up with you understand. FYI, the lawsuit between the Two notso Happy Apples has no merit by the Plaintiff in the case. It was an interesting and informative read. It goes to show you how difficult it is to win one of those cases. CVSI is going to be in the same situation in the future. Here’s the Logic to back up my claim. If you noticed in the photo of the CBD infused water, the company you referenced to and the link you provided shows the Water products in Aluminum Cans and not clear bottles. That is done in order to keep it from light you understand.

That means CBD in a clear water bottle stored on a brightly-lit supermarket shelf is most likely completely useless and provides no other benefit than the regular hydrating effect of plain water.
Assuming some manufacturer takes the initiative to sell CBD in dark brown glass bottles, like Guinness, from the moment the cap is opened and oxygen hits the product, it begins to destabilize.
Therefore, putting a dropper full of CBD into a bottle of water and sipping it here and there is not advisable either. Opening and closing the bottle numerous times and allowing oxygen and light to penetrate the container weakens the CBD, rendering it all but ineffective, quite quickly. (Unless fitness buffs do this at Soul Cycle, where the room is pretty dark and cyclists tend to chug.)
