Caveat emptor, pronounced /?kævi.??t '?mpt?r/, is Latin for "Let the buyer beware".[1] Generally, caveat emptor is the property law doctrine that controls the sale of real property after the date of closing. In South Africa, the term voetstoots is used.
Explanation
Under the doctrine of caveat emptor, the buyer could not recover from the seller for defects on the property that rendered the property unfit for ordinary purposes. The only exception was if the seller actively concealed latent defects or otherwise made material misrepresentations amounting to fraud.
Before statutory law, the buyer had no warranty of the quality of goods. In many jurisdictions now, the law requires that goods must be of "merchantable quality". However, this implied warranty can be difficult to enforce and may not apply to all products. Hence, buyers are still advised to be cautious.
In the US
The modern trend in the US, however, is one of the Implied Warranty of Fitness that applies only to the sale of new residential housing by a builder-seller and the caveat emptor rule applies to all other sale situations (i.e. homeowner to buyer).[2] Many other jurisdictions have provisions similar to this.
In addition to the quality of the merchandise, this phrase also applies to the return policy. In most jurisdictions, there is no legal requirement for the vendor to provide a refund or exchange. In many cases, the vendor will not provide a refund but will provide a credit. In the cases of software, movies and other copyrighted material many vendors will only do a direct exchange for another copy of exactly the same title. Most stores require proof of purchase and impose time limits on exchanges or refunds. However, some larger chain stores will do exchanges or refunds at any time, with or without proof of purchase, although they usually require a form of picture ID and place quantity or dollar limitations on such returns.
Laidlaw v. Organ,[3] a decision written in 1817 by Chief Justice John Marshall, is believed by scholars to have been the first U.S. Supreme Court case which laid down the rule of caveat emptor in U.S. law.[4]
In the UK
In the UK, consumer law has moved away from the caveat emptor model, with laws passed that have enhanced consumer rights and allow greater leeway to return goods that do not meet legal standards of acceptance.[5] Consumer purchases are regulated by The Sale of Goods Act.
In the UK, consumers have the right to a full refund for faulty goods, however by convention, most retail companies will allow customers to return goods within a specified period (typically a month or two) for a full refund or an exchange, even if there is no fault with the product. Exceptions may apply for goods sold as damaged or to clear.
Goods bought via 'distance selling', for example online or via phone, also have a statutory 'cooling off' period of seven working days. To cancel the contract is to treat the contract as if it had not been made, except that the Regulations refer to the terms.
Although no longer applied in consumer law, the principle of caveat emptor is generally held to apply to transactions between businesses unless it can be shown that the seller had a clear information advantage over the buyer that could not have been removed by carrying out reasonable due diligence.
Caveat venditor
Caveat venditor is Latin for "let the seller beware". It is a counter to caveat emptor and suggests that sellers can also be deceived in a market transaction. This forces the seller to take responsibility for the product and discourages sellers from selling products of unreasonable quality.
In the landmark case of MacPherson v. Buick Motor Co. (1916), New York Court Appeals Judge Benjamin N. Cardozo established that privity of duty is no longer required in regard to a lawsuit for product liability against the seller. This case is widely regarded as the origin of caveat venditor as it pertains to modern tort law in US.

I personally think that charts combined with L2 are two of the most important tools to any trader’s arsenal but I also understand that the tail doesn’t wag the dog! Lol… the main problem with using a chart to predict what a penny is going to do is that if someone drops 50k on the ask in the A.M. it doesn’t matter what the charts was doing and the same is true if that same person was to drop 50mil shares at the opening bell, it is to easy to manipulate share price when its at .0015 IMO
As for the PR about financials, I think they will let it out purely because they feel there a reputable company and that’s what reputable companies do! Lol… IMO they stopped dropping PR’s every other day because they acquired all the funds that they needed for the foreseeable future. I personally asked them via email about it and they said they acquired funds form outside investors, now I think they were putting on a show for these investors with the last push or paid promoters were involved so that an outsider could dump all there shares. Either way it has delivered us here, where we wait for the next big move created by sales or the need for more capitol.
This is just my thoughts and opinions and should be taken as such.

The first trader I ever talked with about GT said its a great stock but be carful because she can drop really fast! So I try and keep an eye on it a little closer than I think I would need to. And yes 3-1 and 5% today sounds like a pipe dream but it has happened before so, well you never know? Lol…

Let me see if I have SLV right, you guys are buying into the idea of silver? Someone else holds the goods and your paying for it, can this be correct?
Don’t get me wrong, I’m not bashing just trying to understand the concept here. I like silver as well, even own some, nice little pile of bars.

Picked up more GT today at .01 above LOD, getting very exciting now IMO just a fun stock to play. Have you looked over the GT board lately? I’ve been trying to clean things up a little without people thinking I’m monk-eying around lol…IMO that was a great comment though!
P.S. found another big board guy, Pro Trader seems like a very cool guy IMO and very knowable about this stock.

Could not hold the new 52 week high but still closed GREEN! For the day, up 0.60%
As for the chart:
Candle inside the Bollinger bands, CCI turning down but still way in the power zone, MACD crossed over and heading north, and the TRIX on a good up swing. With support at 14.26 and resistance at 15.86 tomorrow should be a very interesting day for Goodyear IMO
Now on a personal note: picked up a large bag today @ 14.66 one cent off LOD so I’m about half full now and if everything works out for GT then this will work out very well for me.

Will GT break the 52 week high this week of $15.27 per share?
Well if it can break and hold this level it should be well on its way to uncharted ground for the last 365 days anyway. Now one of the things that my DD shows about Goodyear is that about every twenty years or so it breaks bad and the company follows it with a split, sometimes 2-1 and sometimes 3-1 now I’m not saying GT will hit that 37-40 per share range but if it did holders might just double up if it did! And IMO this would be very good for investors’ confidence in Goodyear.
So everyone playing or considering buying in keep an eye one the 52 week high as well as the investor conference coming up as well.

I am in GT and SIRI but mainly day trade pennies, I have been watching GT for a number of years now and just pulled the trigger on an entry position as well. Monday I will continue to fill my bag and couldn’t agree with you more on GT and big board stocks on IHUB in general. One of the things I don’t get is that on SIRI people frequent that board but not GT? Lol… I took the mod position to clean it up a little in order to try an draw interest, for I know that me and you can’t be the only holders of this security! Lol… GT’s site has 27,000 holders of record so I know that we are not alone.

Wanted to talk a little about Goodyear, it’s not a bottom play but is starting on a nice run, it has been up listed, and it’s running green! 6.62% Friday alone!
Wondering if you or anyone you know is playing this one? Looks like great potential for 30%+ gains coming on in the near future.

Stock goes up 6.62% in one day, fairly good up trend going on, and it get up listed but yet this little board gets NO action! Lol… I’m starting to think IHub just wasn’t designed with these big board stocks in mind or maybe there is something about Goodyear that I’m missing here????
I guess I would just like to see some more traders posting here, if anyone has ideas on how to get GT investors interested in our little board here please let me know and in the mean time I will see what I can do to help drive some interest in this stock.

Dow Jones reports that Morgan Stanley did a big flip on the tire maker, raising its rating to overweight from underweight, skipping the mealy-mouthed equalweight in between. It raised Goodyear’s price target to $20 from $13. Goodyear is up 6.8% to 15.
Morgan Stanley says that higher rubber prices could help tire companies beyond 2011. “No one is currently modeling in a potential surge in tire volumes, driven either by emerging markets or pent up demand leading to potential volume and earnings upside,” the investment bank said.
Cost savings from a plant closure in Tennessee also a plus for the stock, if not for the workers.
The last buys that were for 1 mil each were E*TRADE! There were two or three there in the last few minutes. In my opinion it’s hard to tell because I can rout buys and sell through different MM’s and I use E*TRADE. I.E. sometimes I will rout through AUTO if there the ones on the bid and ask for a really fast buy or sell but to answer your question it was ETMM < that’s E*TRADE.

The part I don’t like is that in my experience with LKEN they don’t always answer there phone when you call, even during business hours, and if you request something they need to research it and get back to you! Lol…

Yah I don’t like that stuff, I am really empathetic to the plight of injured and displaced people. It just really gets to me, and then I get all freaked out because I’m on the Washington State coast! And they kept saying all day “here it comes!” now there talking about two nuclear plants might blow and spread radioactive stuff all over us. So I’m slightly nervous! To say the least. I don’t know the US rule off of the top of my head but I do believe you’re correct with your analogy of this issue. Never feel like your stepping on my toes if you have a valid answer to a question whether it is directed at you or not, I for one say throw it out there! I hope we do see the PR Monday, really just think we deserve to see it and I do agree with you in that it won’t be what we want to read but on the other hand I believe we need to read it.

Personally I sticking to my original plan, I bought a large load of this stock as a lotto play and this is what it is! Win big or loose it all (hoping for win big! Lol…) all I can really say is that more will be revealed in time and right now I wouldn’t want to be with out my shares.
If your in it for the long hall, just hang out and wait just a little bit longer, if not don’t drive yourself crazy trying to guess what’s up because know one knows for sure except LKEN and it appears there not talking right now! Lol… I personally believe this will at the least explode one more time but that’s just a feeling and I surely wouldn’t place a buying decision on my feelings!!!! But I have a rule when I day trade that if I would buy it then I do and if I wouldn’t buy then I sell, does that make any since?
