The last 1MM shares are due Nov 1 2007, not in a few days. My guess is they've already transfered all 5MM shares. And Calypso does not pay $3MM if they fail to deliver the shares. The $3MM is only if they are delisted.

I think the shares available at 12c have dwindled now. MMs don't want to show a better bid yet.

I don't know why you expect no news for a few weeks when we'll know next week the result of the Acacia court review. And I expect it to be approved, especially given Daic's lame objections I read. And I do think there is accumulation going on outside the retail level. Maybe NSN? If you knew you were going to do a big deal with Calypso, maybe you'd want to take a posiiton.
The action over the last 2 days has been buying at the ask and without the other side of the trade showing up. It's bid 11.5 at 12 but all you see traded are 12's. You don't see many at 11.5 for the other side. Plus you are seeing big blocks. IMO, this is not retail. There is a market maker buying shares for their inventory.
Well whoever is buying they are not pinching pennies. Almost every buy today has been at the ask. Probably close to 600k.
Heavy buying at the ask all day. Frequent large lots. MMs are accumulating. Saw this back when it was 5c-10c then it took off.
Good for you. Not a scam in the least. You saw the Acacia deal in black & white. Field trials with Nokia-Siemens. Much more behind the scenes. The only thing holding it down is the uncertainty with the Daic case and that could go away any day.

I reviewed Daic's objection to the Acacia deal last week when they filed it. It's not even worth the paper they used.

I can tell you that exact thing has been discussed between Calypso and Acacia, only in the form of joint PR's, not a letter.
Another thing...Calypos's ASNAP patent has been cited by 40 other patents since being issued. That is a very big number given the patent was only issued in 2004. Here's what a patent attorney friend of mine says to that...

I don't know if it's the same thing but if it's even close Acacia will be licking their chops seeing how Calypso's patent was filed 3 years before the PCTEL patent. Calypso's patent filed May 2000, PCTEL 7133669 Aug 2003. Note that PCTEL says carriers are licensing this product which is even better as Calypso can show material damages. The list of infringers on Calypso's ASNAP patent is very long. The Acacia deal is going to bring in a boat-load of money.
The new letter has this section:

So, the field trial with NSN is progressing positively. He could have said it's just moving along, but he did more than that. Turrini is very conservative so if he says positively it's much better than even that.
"We expect our relationship with (NSN) to begin adding value.." That's "expect", not hopeful. Kind of hints at deals already in the works...?

Believe me, Calypso and Acacia have been talking about this deal for a long time and this is how it works and both parties agree on that.
Between Acacia getting infringement revenues and Calypso getting new licenses this will be a $20 stock in a few years. NSM has 70% of the worlds carriers on its networks and every one of them will be shown ASNAP. The NSN deal alone is going to launch this company very high.

The only companies Acacia can go after are the "Exclusive Parties". The term "Exclusive Party" shall mean:
(a) a declaratory judgment plaintiff or an infringement defendant under any of the Patents;
(b) a party, other than Licensor, infringing any of the Patents as of the Effective Date; or
Obviously a and b are the heart of the agreement where Acacia gets to go after infringers.
(c) a party with which APAC has initiated or undertaken licensing communications, discussions and/or negotiations or otherwise asserted any of the Patents against, provided that an Exclusive Party shall be deemed to include any and all of its affiliates.
What you are missing in c is the phrase "otherwise asserted any of the Patents against". That means going after infringers. a and b take care of companies that are already infringing and c covers ones that Acacia has notified that they may be infringing.

The Grant-Back gives Calypso the right to license ASNAP to annybody with the exception of infringers...
2.1. Grant Back License. ....APAC hereby grants to Assignor a limited, non-exclusive, non-transferable, royalty-free, personal right and license under the Patents to make, use, offer or sell products or services solely as required by Assignor to conduct Assignor's Business as defined below (the "License"). For purposes of this Section, "Assignor's Business" shall mean only those products and services offered for sale or sold by Assignor as of the Effective Date (the "Products"), including improvements, modifications or extensions of such Products developed solely by Assignor and offered for sale or sold by Assignor thereafter...
2.2. Limitation to Grant Back. Other than as expressly set forth in Section 2.1 above, Licensor expressly retains no rights in or to the Patents, including without limitation no rights to sue for and collect past, present and future damages and to
seek and obtain injunctive or any other relief for infringement of the Patents, and no other rights or licenses under the Patents are granted or implied.
Daic was the only one. There were others that were actually on Calypso's side.
