EU to accelerate renewables permitting, cut environmental requirements

The European Commission tabled a temporary emergency regulation with the aim to double the size of new renewable energy installations to 100 GW next year by cutting red tape. The measures would include lowering environmental requirements.
The European Commission proposed a temporary emergency regulation to accelerate the deployment of renewable energy within the plan to end the European Union’s dependence on Russian fossil fuels.
Measures to loosen the administrative procedures were already addressed in the REPowerEU plan, but the situation in the energy markets has worsened since then, prompting the need for urgent action, according to the EU’s executive body. It said the new rules would be introduced for one year by the European Council, to bridge the gap until the new Renewable Energy Directive comes into force.

“By doing so, we can unblock a myriad of renewable projects already in the next 12 months. According to calculations by the IEA, we could replace 14 billion cubic meters of gas already next year,” European Commission President Ursula von der Leyen said, pointing out that the International Energy Agency has highlighted a risk of a shortage of 30 billion cubic meters of gas ahead of the start of the heating season next year.
Too many projects are stuck in permitting process
The EU is set to add 50 GW this year from renewables, two times more than in 2021, she stressed and expressed the ambition to boost the additions to 100 GW next year.
“There are countless renewable projects that are just waiting to be approved. Some could deliver cheap energy immediately, in a matter of weeks or months. I am thinking, for instance, about solar panels on existing buildings, or the repowering of wind parks. But too many of these projects are stuck because of long permitting procedures,” Von der Leyen stated.
EU is jeopardizing environmental safeguards, EEB warns
Rooftop photovoltaic installations and solar power facilities up to 50 kW would be exempted from environmental impact assessments. The European Environmental Bureau claims it would be done at the expense of environmental safeguards and democratic checks and create legal uncertainty.
“Today’s proposal curtails environmental assessments that provide fundamental nature and social safeguards and proposes measures that de facto amend cornerstone EU environmental regulation… Renewables roll-out can be accelerated by ensuring better implementation of environmental assessments and tackling administrative bottlenecks – i.e. by fostering digitalization of procedures and establishing one-stop-shops for project applicants – and improving resources in all levels of competent authorities for both permitting and environmental assessments,” according to the network of environmentalist organizations.
Timmermans: Environmental requirements will be scaled back only where there would be no concerns
Conversely, European Commission Vice-President Frans Timmermans, in charge of the European Green Deal, said the focus is “on areas where there is strong evidence that there would be no concerns, such as solar panels on existing or already planned structures, or the renewal and upgrading of current plants that are near the end of their economic life.”
In essence, the proposal calls for declaring that photovoltaics, heat pumps and other clean energy facilities are of “overriding public interest” and imposing shorter deadlines for permitting.

Even for the 65 reported contracts, there were deficiencies. Five of the 228 contracts have been terminated, resulting in the current number of concession/PPP contracts being 223.
The largest number of them has the Ministry of Infrastructure and Energy as Contracting Authority, with 206 concessionary contracts/PPP.
" Collection of information has continuously encountered difficulties and therefore this report will convey information on 65 concession/PPP contracts ", clarified the Ministry of Finance.
The Ministry of Finance must report annually on concession contracts according to the law "On Concessions/PPP" of 2018. The report consists of the progress of these contracts as well as their costs.
The Ministry showed deficiencies in reporting on concession contracts in the transport sector as well as incinerators.
The concession project for the construction of the Arbri road worth 26.5 billion ALL has not realized the planned investments, according to the report. The Ministry has announced the termination of the concession contract for the construction of the Milot-Balldren road worth ALL 17.7 billion. This is as a result of non-fulfillment of the terms of the contract.
According to the Ministry of Finance, the Contracting Authorities have had a poor performance in providing services and public works. The Ministry has requested an improvement in this aspect and in terms of minimizing the risks affecting the state budget.
"183 contracts only for HEC-e"
The field of energy is the one with the largest number of concessions. There are a total of 183 contracts in the field of energy with a value of ALL 415.2 billion. The second sector is that of Transport with 20 contracts worth ALL 100.6 billion.
Out of 183 concession contracts in the field of hydropower, about 66% of them are active, respectively 24 of them are in the investment phase, 99 concession/PPP contracts are in the production phase.

Devoll Hydropower sh.a is the largest producer of electricity in the private sector, with 395,634 Meh or 11% of the total energy produced. The company Devoll Hydropower operates the Banja and Moglica hydropower plants. The Concessionary Contract was signed with the Ministry of Infrastructure and Energy in 2008, and has undergone changes and additions in 2010, 2013, 2014. The investment value for this concession is 130 billion ALL according to the Ministry of Finance.
"Many concessions in few hands"
A problem that appeared in the conclusion of concession contracts over the years is their concentration in the hands of a few companies.
According to data from Open Data Albania (ODA), 10 companies received 42.79% of the procurement fund, while 15 companies received 52% together.
During 2021, 17,961 contracts were awarded through competition and 2,148 contractor businesses were engaged, according to ODA.
The ten businesses that have benefited from the most contracts are:
Intekar Yapi LTD STI; 4 AM; Salillari; 2T; Alb – Star; GPG Company; Agbes Construction; Peqin's Eurotheorem.
Turkish company INTEKAR YAPI LTD. STI is the company that has won the most contracts.

This company has won the tender for the construction of the Llogara Tunnel in the road section Orikum - Himarë part of the highway. The winning bid without VAT in this tender is 17.03 billion ALL or about 141.9 million Euros.
As for the number of concession contracts in total, according to an ODA chart, the two companies that have benefited the most from the tenders are Fusha shpk and Salillari.
Accordingly, Fusha shpk has won 61 tenders worth 5.8 billion ALL. While Salillari has won 31 tenders worth 4.2 billion ALL.

The leaders discussed regional security, in particular the situation in Iran and Tehran’s destabilising behaviour in the region, as well as the negotiations around the JCPoA nuclear deal.
The Prime Minister and His Highness Sheikh Mohammed bin Zayed agreed to continue working closely together on defence, security and trade, including progressing the UK-GCC trade deal next year.

DUBAI - The United Arab Emirates and the United Kingdom have a global leadership opportunity in developing clean hydrogen, through a broad collaboration involving policy, innovation, trade, and investment, according to a new report launched today.
The report is a joint initiative between the World Green Economy Organisation (WGEO) and Zest Associates, a UAE-based sustainability consultancy, and sponsored by HSBC.
The report draws on insights and studies from nearly 100 international hydrogen experts to prioritise 39 areas across policies, innovation, investment, infrastructure, supply, demand and skills, adding substantially to the world's body of knowledge on the subject. Initial findings were shared at the World Green Economy Summit 2022.
"We remain committed to achieve our wise leadership's vision and directives to foster the transition towards the green economy. We have an ambitious strategy to produce and leverage green hydrogen, which represents one of the pillars of a sustainable future that depends on accelerating the transition to carbon neutrality to support a green economy. This study is part of our efforts to support the Dubai Clean Energy Strategy 2050 and the Dubai Net Zero Emissions Strategy 2050 to provide 100% of the energy production capacity from clean energy sources by 2050," said Saeed Mohammed Al Tayer, Chairman of WGEO, a UAE-based international platform that builds coalitions to enable green economic growth worldwide.
"This report shows how the UAE and the UK can forge a robust partnership to develop the green hydrogen sector. We have seen strong actions and willingness to cooperate from the public and private sectors in both countries, but to fully realise the economic and environmental potential of green hydrogen, more and faster measures must be taken. This aligns with WGEO's commitment to a global economic transition through sharing best global experiences and practices that are key pillars for this development."
By 2050, hydrogen is estimated to deliver more than $8.7 billion (AED32 billion) annually to the UAE economy and $14.8 billion (£13.7 billion) Gross Value Added (GVA) to the UK, as well as over 100,000 new jobs in each country under high-adoption scenarios. These opportunities drive multibillion-dollar investments individually and jointly, through bilateral agreements such as the strategic partnership between bp, ADNOC and Masdar to build low carbon hydrogen hubs like the UK's H2Teesside.
"By working together, the UAE and UK can harness hydrogen's enormous economic potential and lead the global low carbon transition," said Sabrin Rahman, Managing Director and Head of Sustainability for Europe and the Middle East at HSBC. "The International Energy Agency estimates that $1.2 trillion of investment in hydrogen will be needed by 2030 to reach net zero. At HSBC, we recognise this sector's huge potential and are working with partners and policymakers to develop the clean hydrogen ecosystem as part of a net zero future."
Jeffrey Beyer, Managing Director at Zest Associates and the report's author, said, "Clean hydrogen is an opportunity to grow and diversify the economies of the UAE and UK whilst making progress on their net zero commitments."
"The UAE and UK agreeing on a common method for measuring the emissions intensity of hydrogen can be a first step to creating a robust global standard that ensures hydrogen delivers its low carbon promise."
The report notes existing agreements like the £10 billion (AED40 billion) UAE-UK Sovereign Investment Partnership, signed by the UK Office for Investment and Abu Dhabi's Mubadala Investment Company, or the Memorandum of Cooperation on Industrial and Advanced Technologies Co-operation, signed by the UK Department for Business, Energy and Industrial Strategy and the UAE Ministry of Industry and Advanced Technology, could be enlarged and focused on hydrogen to match the scale of investment required to achieve net zero...

Egypt, as part of initiatives to diversify its energy resources, has signed an agreement with the United Arab Emirates (UAE) for wind energy with a capacity of 10 gigawatts, reports Anadolu Agency (AA).
EBA President Sheikh Mohamed bin Zayed Al-Nahyan, who is in Egypt for the 27th Conference of the Parties to the United Nations Framework Convention on Climate Change (COP27), announced the agreement on his Twitter account. .

Sara Falaknaz, group legal manager of Al Ghandi Auto and Al Ghandi Investment shares her insight and experience on the six key aspects the in-house counsel needs to know about their roles within a family-owned company.
1. Understand the role
The in-house counsel needs to have a comprehensive understanding of their role in the business as an advisor. They should be aware of the nature of the business and the targets of the company. Legal risk is one of the many significant risks that the company faces and the in-house counsel’s main objective is to mitigate the risk and protect the business in all aspects. The in-house counsel should try their best to mitigate the risk, provide other departments in the company information on the consequences of the contractual terms and conditions, and provide legal advice to protect the company from any potential dispute that may arise later. The role is also about enabling and enhancing the business through drafting and reviewing all legal documents. Those are not always aligned, so it is important to be creative in coming up with different ways to address the conflicts between the company’s best interest and protecting the company from any dispute.
2. Learn the business and its environment
The in-house counsel must understand the company’s mission, vision, and business as well as the core elements of the organization’s main activities in all the various sectors. Be informed of the company’s target and vision for the coming years. Seek out opportunities to learn more about the relevant area of law for the industry and its emerging legal issues. Assess where the areas of learning and growth are and pursue them. The success of the business comes from a strong environment and always seeks to enhance and improve it. A company and a department with a great environment can always improve the quality of the work and deliverables.
3. Work efficiently as part of a larger team
The legal department is one of the main departments in the company that supports many business units. Working as a team is a vital skill required to be successful not only within the department but also for the rest of your career. You should always be willing to cooperate with the other departments of the company to improve procedures, regulations, or policies that will add value to the company’s business or profit. It’s best not to wait for further instruction to mitigate the risk. Avoid any possible dispute in the future and be an advocate for the business. Use the law to advance and enhance the company’s policy, regulatory or procedure-related frameworks. Taking on a proactive approach will be greatly appreciated by your colleagues and supervisor now you are a part of a large team. Take efforts to build a diverse team, this helps to create an inclusive environment. Rewarding your team members will motivate them to achieve their goals and deliver the outcome of the job efficiently.
4. Embrace the need to add value outside the legal role
Your value and position are more than just being a counselor/advocate who implements and advises on the law. High-quality responsive legal work, communication, and deliverables are the focal points of your position. The greatest asset an in-house lawyer brings over external counsel is knowing the business vision, mission, strategies, and decision-makers, how decisions are made, what is in the best interest of the company, and how the law practically applies to and advances the business imperatives. It is valuable to find at least a few projects over the year that helps business partners and increases the business and revenue of the company and isn’t solely focused on legal documents or disputes. In-house counsel should be flexible in their decisions, smart in problem-solving, and rigid at the same time.
5. From cost center to value generator
As an in-house counsel, you try to save the company’s cost on legal advice, counsel fees, and law firms and aim to resolve the matters amicably. Solving matters amicably and gaining the satisfaction of customers, suppliers, and tenants instead of commencing legal proceedings against them will maintain a good relationship and increase the business’s revenue and income. Adding value through efficient communication with each of the departments on the legal matters to advise and discuss how to protect the company’s interest is a significant value add to the deliverables and the outcomes of the daily business. Increasing the revenue and the income of the company is one of the main objectives behind settling matters amicably at zero costs.
6. Advising a family-owned business
The main responsibility of working as an in-house counsel for a well-known family business is to ensure the success of the business across all aspects in current times and in the future. The legal counsel has to advise from the early stages of all contracts, agreements, transactions, formation of the companies, etc. to ensure the company’s outcome is smooth in the present while keeping an eye on the future. This ensures the future direction of the family business is beneficial, in addition to reducing legal risks and exposures. Long-term growth is one of the key aspects of a family business. Therefore, the counsel should think broadly not only from a legal perspective of the business and the shareholder’s value, but without causing any damage to the reputation of the family and the business.

The Durres port project has involved Emaar where Faisal Falaknaz is director. This is a touristic investment.
I think the energy investment leg will be in the hands of Abdul Rahman Falaknaz with his 1,27B investment.
It could be delayed by the finacement origin. Chinese investments in western balkans concerns EU and the West lunch a big investment program against the Belt and Road, then Falaknaz could finance his project from his pocket or through western institutions and China Gezhouba Group only will build the dams finally...

Numerous doubts have been cast on the project in the media, which have not received an answer from the institutions.

From Tropoja, Prime Minister Edi Rama spoke about all the projects that aim for our country not only to stop buying electricity, but to sell it abroad once it has met its needs. Rama said that the goal is to have 100 percent of the energy production capacity by 2025 to meet our needs when there is not enough rainfall. While 2029 is the deadline when, according to the prime minister, Albania aims to be totally sovereign and fulfill all its capacities.

Balluku presents the MIE budget for 2023 to the committee

Deputy Prime Minister Belinda Balluku is a member of the Committee for Production Activities, Trade and Environment, for the presentation of the draft budget of the Ministry of Infrastructure and Energy for 2023.
During a report, she listed the works that have been done so far and the expected projects.
Balluku informed that the Public-Private Partnership projects covered by the Ministry of Infrastructure and Energy are budgeted in the amount of 4.59 billion ALL.
She also announced that the works for the Arbri road will be completed in 2023, while 74% of the works have been completed so far. Meanwhile, in 2024, the Llogara tunnel project will be completed, with 46% of the works completed so far.

The United Arab Emirates and the United States have signed a partnership to spur $100 billion of investments in clean energy projects and add 100 gigawatts of clean energy globally by 2035, state news agency WAM reported on Tuesday.
“Together, we will spur large-scale investment in new energy technologies, in our own countries, around the world and in emerging economies,” US energy envoy Amos Hochstein said in a statement carried on WAM.
This said that the partnership would “assemble and stimulate” private and public sector funding and support for clean energy innovation, carbon and methane management, advanced reactors including small modular reactors, along with industrial and transport decarbonisation.
Under the initiative OPEC member UAE and the United States would provide technical, project management and funding assistance for commercially and environmentally sustainable energy projects in other countries.
“The energy transition needs a realistic, practical and economically viable plan to deliver climate progress together with energy security and inclusive economic growth,” Sultan Al Jaber, UAE Minister of Industry and Advanced Technology and Special Envoy for Climate Change, said in the statement.
The initiative will also focus on investing in responsible and resilient supply chains, promoting investment in green mining as well as production of minerals and materials vital to the energy transition.

But I never could to predict a earthquake and a pandemic. I have shared many proves that Falaknaz is still on course. The Prime Minister of the country, Edi Rama, during the meeting with tourist operators in Dibër, focused on the energy crisis. He said that the country is forced to enter the market, but still added that the government will do its best to protect family consumers.
"Regarding energy, we are forced to import. We want to protect family consumers at all costs. Everyone should be mindful to turn off the lights," said Rama.
The head of the government was harsh with those who oppose the construction of the Skavica Hydropower Plant.
This project, Rama said, will give a great development to the surrounding areas, and in addition to this, he hinted that the objections of the residents of the areas are instigated by the chairman of the PD Sali Berisha, although he did not mention him by name, but he left it implicit by reminding him of the "non grata" part from the USA.
"Why do they oppose Skavica? Skavica will open perspective for all areas there. Not counting those who will be displaced from where they will take home. Why is it opposed, listening to the hyenas…..Neither the hyena nor the non grata is tolerated. I'm sorry that I mentioned it too soon", said Rama.
