Thomas Lavelle "Tommy" Clark, 15, died Sept. 3, 2012, one day after he was hit while walking on the side of a Vernal street. The driver who hit Clark was texting at the time of the crash, according to Vernal police. Clark's mother has filed a wrongful death lawsuit against the driver. VERNAL — A Uintah County woman has filed a wrongful death lawsuit against a man who police say hit and killed her teenage son while texting and driving. Evie Lesser filed the suit this week in 8th District Court against Jeffrey Lloyd Bascom. Lesser is asking a jury to award her and her former husband for the loss of their son, Thomas Lavelle "Tommy" Clark. The lawsuit also list several "John Does" as defendants, identifying them only as individuals or businesses "who may have contributed to the cause of the accident" that led to Clark's death. Lesser's attorney, Daniel Sam, would not comment on the lawsuit when contacted by the Deseret News. On Sept. 2, Clark and a friend were walking along the shoulder of 500 West near 1200 South about 9 p.m. when Clark was hit from behind by the pickup truck Bascom was driving. The impact threw the 15-year-old about 40 feet through the air. He landed next to a barbed wire fence that separates a cow pasture from a roadside ditch. Clark's friend escaped injury. Bascom, 28, remained at the crash site and told investigators he was texting at the time he struck Clark, said Vernal Assistant Police Chief Keith Campbell. Bascom's statement was consistent with the physical evidence at the scene, Campbell said. Clark was taken by ambulance to Ashley Regional Medical Center and then transferred by helicopter to Primary Children's Medical Center. He died the following day after he was removed from life support. Bascom is charged in 8th District Court with automobile homicide, a second-degree felony, and obstruction of justice, a third-degree felony. A preliminary hearing is scheduled for Jan. 23. Bascom faces a maximum sentence of 20 years in prison, if he's convicted.

AKRON -- Akron's City Council is considering whether to ban drivers from sending text messages from behind the wheel.
A new state law already makes texting behind the wheel a secondary offense for adults. That means they have to be pulled over for speeding or some other offense before they can get a ticket for texting. It's a primary offense for those 18 and under, so they can be more easily ticketed.
The Akron Beacon Journal reports (http://bit.ly/V1GeB9 ) council members on Monday discussed a proposal that would make texting while driving a primary offense for drivers regardless of their age.
Akron's proposal is modeled after an ordinance approved by the Cincinnati City Council in 2010. Drivers would be banned from writing, sending or reading text messages and from interacting with Internet-based content.

I am in the business of medical sales. Here are a couple of facts:
- contracts only come up every few years per facility or region/buying group
- evaluation process is lengthy & rarely on time - often over 6-8 months from a planned start date
- once the evaluation is done, decisions communicated to vendors is often another exercise in patience
- the transition to the newly won products is often a slow process as previous inventories need to be burned along with facilities not moving quickly to the newer products - resistance / required in-servicing, ect.
Having said this, it seems the longs here have the patience required for this to come to fruition. Myself, I am happy with what I have accumulated so far & am in no hurry until we're receive updates from Surgeline.

You will likely have more luck searching distributors working with a hospital. Hospitals aren't likely to put out their what products they are using. All that info is often within confidential contract details.
