Now casavant both mr and mrs will need to be served by publication. But the judge will have to order it to be done. once that order is handed down. its 4 weeks before the affadavit of service by publication is filed. after that its up to the judge what to do. William Frizzell, Esq., out-of-state counsel, present.
Mr. Koch referred to the issue of servicing certain Defts last time and
since that time, considerable attempts were made to serve The UAJC 2005
Irrevocable Trust; requested that the Temporary Restraining Order (TRO) be
extended; and requested to put on some evidence indicating as to where this
money has come from and gone to, noting he has received numerous records
from several Banks and the representatives that service the account. Court
stated he cannot proceed with a motion which has not been served. Mr. Koch
stated the following Defts have been served:
- UAJC has been served through the address listed on the Secretary of
State website;
- Mike Williams has received notice of the law suit;
- As to Deshawn Wayne - several attempts have been made;
- Brian Dvorak has been served;
- As to James Kinney and Ginger Gutierrez - several attempts have been
made;
- P A Holdings Inc and Bucko LLC have been served
and attempts to serve those Defts means they would not accept service. Upon
Court's inquiry as to the representation of the UAJC, Mr. Frizzell stated
that at the time this was just filed and he indicated he was the trustee; he
just this learned that Michael West was the trustee for five (5) years, and
Ed Donald is now the trustee. Statements by Mr. Frizzell as to attempts to
serve; sending certified mail; and that Mr. Casavant is in Canada and also
has an address for Las Vegas. Matter TRAILED.
LATER, matter RECALLED. Court noted the TRO originally in this case was
effective April 30, noting the Application was heard April 30. Mr. Koch
stated the TRO was not effective until May 2. Court noted the TRO was
extended May 15 and there is service on some of these Defts; there is a
proffer that notice and attempted service has been made to some of these
Defts and inquired as to the likelihood of service or causing notice to be
given to Mr. Casavant. Mr. Frizzell stated they have sent all of the
proceedings both to Mr. Casavant's criminal attorney who has represented him
and have also served Steve Oceans, who represented Mr. Casavant in other
matters. Colloquy regarding service. Kevin Michael West sworn and examined
on behalf of Pltf. Mr. Frizzell referred to an Affidavit of attempt service
on Mr. Casavant which was faxed to him last night. Court directed counsel
to file it in due course in the Clerk's office.
Colloquy regarding amending the complaint to add additional Defts
including Ms. Casavant; returning to Canada to serve her and have a
deposition scheduled here. Upon Court's inquiry, Mr. Koch stated the
parties served indicate there is no opposition, and can amend to add the
trustee and others who were served. Following further statements by
counsel, COURT ORDERED, TRO EXTENDED as to Mr. Casavant until Monday, June
11; and matter set for FURTHER PROCEEDINGS as to him and any of the other
Defts who were not served, noting this will not be an evidentiary hearing;
if it appears that one will be needed,, the Court will set a date and time
for same. COURT FURTHER ORDERED, Preliminary Injunction GRANTED to parties
who have been served and have not appeared. Mr. Koch to submit a
Preliminary Injunction and an Order addressing that the TRO is extended to
the parties who have not been served. Mr. Koch requested that discovery be
permitted, and COURT SO ORDERED.

In United States law, a temporary restraining order (or TRO) may be issued on a short-term basis. TROs usually last until a hearing date for the TRO at which the court decides whether to drop the TRO or to issue a preliminary injunction based on the TRO. Thus, the relationship between a TRO and a preliminary injunction is the same as the relationship between a preliminary injunction and a permanent injunction.
"In very rare cases, a TRO may be granted ex parte, i.e. without informing in advance the party to whom the TRO is directed. Usually such ex parte orders are of a short term and are to prevent one's adversary from having notice of one's intentions. Such notice may prohibit the eventual object of the application for an injunction from doing something that would make the court's granting of an injunction fruitless, such as wasting or hiding assets (as often occurs in dissolution of marriage) or disclosing a trade secret that had been the subject of a non-disclosure agreement."

Fact is if deli holds the shares in trust thats exactly what Edwards and his clan did.

Fuego Entertainment, Inc. (OTCBB: FUGO) today announces that for the first calendar quarter of 2007, its music division, Fuego Entertainment Music International (FEMI), has sold over 18,500 music CDs to various distributors and retail outlets around the world. These sales represent over $175,000 in revenue for Fuego Entertainment and are the direct results of the music content previously licensed from Ciocan Music's existing catalog.
These sales do not include the new releases. These sales also do not include the Company's sales efforts in the digital distribution of music, sound recordings, and video content as a result of Fuego's exclusive agreement with Digital Music Group, Inc. It has already been established that the action that will be filed will be a dirivitive action. a dirivitive action is the shareholders attorney acting on behalf of the company in the shareholders best interest. This action is the action Janice brings into question from the original letter in 2005.
You will see multiple lawsuits filed against the people named in the original dirivitive rights letter in 2005. It was not inaction on Frizzells part. It was Frizzell giving the company time to act on its own. It diodnt now we have the right to act on the companies behalf at the companies expense. to sue those that wronged the company. Anything gained will be gained by the company for all shareholders benefit. Anyone that says differently is either ill informed or blowing smoke up your behind on purpose.
