WE ARE SETTLED. I have been waiting for this day for a long time and now it's here. We are done with Daic. The case has been settled out of court.
The court docket was just revised to show the following:
11/07/2007 TRIAL SETTING TRIAL ON MERITS CASE SETTLED
I spoke to Betsy Wall the coordinator who said she got a call from Ms. Rusnak, Daic's attorney, this morning saying the case had been settled.
You will also notice on the docket sheet at the top the status has changed to:
Status HOLD FOR JUDGMENT
According to Ms. Wall, that denotes the parties have reached a settlement and when they submit it to the court the judge will sign it.
Ms. Wall said the Friday conference call will be cancelled.
It's been a long road to get rid of Daic but it's done. I'd guess we will see some formal announcement from Calypso in the next few days followed by licensing announcements now that we are free to execute deals.

No. If they don't settle by Friday, they will have a hearing on Friday to decide the continuance.
About the continuance...
I talked to Betsy Wall the court coordinator. She is my main contact and very helpful. She said the continuance phone call was put on the schedule just to make sure they booked time with the judge to hear it in case they do not settle before then. She has received nothing from Calypso or Daic saying they cannot or did not reach a settlement. She said they could indeed reach a settlement and not need the phone hearing.
I was told we had Mendoza here and ready but their lawyers did not make the proposed deposition time and he had to leave.
Mendoza was in Houston ready to be deposed and Daic's lawyers siad they did not have time. It was the day after Davila was deposed.
I saw the continuance filing last week. The clerk emails me when new filings come in. Here's what I know:
(1) Of course, Calypso will oppose the continuance. Look for a filing from Cohn. There will be a phone call hearing on it next week. Don't know what day yet. It will probably pop up on the docket.
(2)Turrini/Cohn have suspected for a while that Daic might try for a continuance so Turrini has been in contact with the judge beginning a while back making sure she is aware of the games Daic has been playing. Remember he did the same thing trying to postpone the depositions. In the end, they went in front of the judge and she stopped his BS.
(3) Daic was the one who requested mediation. I got that directly from Turrini. They got "correspondence" from Calypso only after Daic's side called and asked for mediation.
(4) I have heard that Daic's lawyers want to settle. They do not want to go to court.
IMO, I think the continuance will get denied and then Daic will settle for next to nothing before the court date.
Obviously neither of you have read the court case filings. If you had you would realize that Daic is INDEED full of sh*t and the only reason he got the ruling in the first place was because Calypso was literally forced into not showing up.
Looks like we'll have to settle out of court.

Yes, they allow 2 weeks but it won't take that long. Daic has exactly zero witnesses to call for his defense. Calypso has at least 4-6 but they won't take longer than a week

Why wouldn't the decision be immediate in a jury trial? This is a jury trial not another hearing with a ruling by the judge. I'd expect 1 week at most for the trial and an immediate decision. Yes, Daic can appeal but at that point Calypso is free to do deals out the wazoo. I think we are 3 weeks out at the max. I know that Calypso did not request mediation and I know the court did not ask them to mediate. I had also heard rumors that Daic requested it. It seemed to add up to me. And I'd expect him to given the landslide he's up against. He's lucky to stay out of jail.
Are you blind? I said in my post they've got a deal with Acacia..that's public info. I said they have a field trial with NSN...that's public info. Are you blind?
Interesting JW. Like maybe how you said they'd never get their filings up to date, but "yes" they did. They'd never land a licensing deal but "yes" they did with Acacia. Their tech would go nowhere, but they landed a major field trial with NSN. And who knows what other deals they have lined up to hit when Daic is gone. This stock is coiled to explode in the near term.
2 weeks people. 3 weeks max given a week for the trial. And that's only if they don't settle beforehand. Daic was the one that requested mediation, he does not want this to go to trial, but even if it does, you are 3 weeks from major gains. If you can't wait 3 weeks then sell now.
Checked with the court clerk on preventing Daic from trying to move the Nov 7 trial date if they don't reach a settlement...
"We have a trial date of Nov 7 in the Calypso case. If the other side tries to delay the trial, can Judge Baker over-ride that and keep the Nov 7 date?"

Like I said yesterday, weak hands will sell out and strong hands will buy cheap shares. Either we settle for pennies on the dollar or we take Daic to court Nov 7 only 2 weeks out and get the whole thing overturned.
It's going to be quiet while settlement talks are ongoing. Weak hands will sell and strong hands will buy on any weakness knowing we'll either settle or go to court and win. Either way we get rid of Daic and bring on the licenses.

You don't think Calypso has met with the parent company Nokia? Yes they have. More than once.
Yes, once parties agree on a settlement, they notify the court and that's the end. The judge does not approve the settlement.
I'm not a lawyer, but once a settlement is reached in the Bill of Review, I would think that the court would put a note in the file for the old case saying that the old judgement is null and void.
You have lots of questions today Biscuit.
1. restricted and longer than the usual 2 years.
2. the hearing was only for the Acacia deal, not for NSN. please do some DD before posting.
3. got a note from Turrini saying the maint fees are scheduled to be paid by Malloy & Malloy. "they have automatic reminders"
Every license that comes through the carriers behind NSN will be 100% Calypso's, but let's not debate it again. What I find ironic is that some people want to bail or at the least lament over lack of news when we are on the very verge of resolving the Daic nonsense and Calypso finally being free to close licenses, make money and drive the stock. We have seen evidence of mediation and evidense of Calypso no longer needing approval of the Acacia deal. We could literally be announcing licenses as early as this week if the case is indeed settled. Why anyone would sell now is beyond me but to each his own.
Believe me, Calypso will do much more than survive. The NSN deal combined with the carrier licenses behind it will launch Calypso into double digits. Add on top of that the Acacia deal to get revs from infringers and the new patents... it's going to be a fun ride.

Now in addition, the docket for Monday's hearing has been changed today to read:
10/15/2007 LAW DAY DOCKET ENTRY OF TEMPORARY ORDERS PASSED
They have added the word "PASSED". I called the court and spoke to the clerk (Veronica) who told me "PASSED" means the party requesting the hearing has cancelled or "passed" on the hearing. In this case, she said Mr. Cohn called to cancel it. Here is what the court scheduler told me via email:
"that means whoever set the hearing has passed the hearing because either they've reached an agreement of some sort or the hearing will be set at another time."
The clerk told me Mr. Cohn has not rescheduled the hearing.
The Acacia hearing was obviously very imoportant to Calypso. The only reason they would canceled it would be that they have settled.
In the FAQ section on the new website, I noticed this statement at the bottom. Notice the word "several".

Yes, the court will nullify the temporary injunction if in fact we have settled out of court. You are thinking too hard on the Acacia deal. We have probably settled and so now we don't need the hearing on it. The clerk told me that's one likely reason for cancelling the hearing.
Once they settle, all temp orders are suspended. I told you Daic would never let this go to trial.
The parties just file a letter saying it's been settled out of court and that's the end.
The judge does not approve settlements. Once they are done, they are done.
I got it from eDocs. I gave you the document number. I downloaded it, it was a letter from Daic's attorney. I have it as a picture but can't figure out how to attach a picture. Go to that document number under our case number 200722571 and pull it up. Page down a ways till you see the passage I quoted. It was filed I think on Oct 4? so they've apparantly been talking for a while.
