SEC spam snitch kills wife and toddler, commits suicide

U.S. Securities and Exchange Commission (SEC) informant and FBI "consultant" Edward Davidson, a spammer who was instrumental in building civil and criminal cases against alleged penny stock fraudsters Darrel and Jack Uselton of Texas, killed his wife and three-year-old daughter before turning the gun on himself on July 24.
Mr. Davidson, who had "walked away" from a minimum-security prison camp in Florence, Colo., just four days earlier, also shot his 16-year-old daughter, but the bullet just grazed her neck and she managed to flee to safety. He left his seven-month-old son unharmed in an infant seat in the back of the vehicle where the bloody rampage took place.
Club Fed
Dubbed Colorado's "spam king," Mr. Davidson copped a plea to criminal charges stemming from his e-mail spamming activity and began serving a 21-month sentence at a prison camp in Florence on May 27.
Like other "federal prison camps," the Florence camp is a minimum-security facility with dormitory housing and a low staff-to-inmate ratio. Even within law enforcement agencies and the legal profession, such camps are often disparagingly referred to as "Club Fed."
According to a July 22 Department of Justice press release, 35-year-old Mr. Davidson, "also known as the 'spam king,' walked away from a federal prison camp in Florence on Sunday, July 20, 2008." The news release went on to note that Mr. Davidson, last seen in Lakewood, "is now officially in 'escape' status.
It turns out, however, that Mr. Davidson did not just walk away from the prison camp two days before he was officially placed "in 'escape' status."
In fact, as his common-law wife Amy Hill, also known as Amy McDaniel, told police within hours of his escape, Mr. Davidson had forced her and their children into her Toyota SUV to make his escape following their Sunday visit with him at the prison camp.
Mr. Davidson drove his wife and children to the home of Ms. Hill's parents in Lakewood, a suburb of Denver. He changed clothes, got some cash and left.
It was later learned that Mr. Davidson, hunted by U.S. Marshals, the FBI, the IRS and the Rocky Mountain Safe Streets Task Force, made his way to Aurora where he spent the next several days staying with friends who were apparently unaware that he was an escaped convict.
Mr. Davidson made contact with Ms. Hill and his children again on Thursday, July 24.
Grim report
Notwithstanding its brevity, the original police report of the aftermath of Mr. Davidson's last contact with his family makes for grim reading.
An officer identified as C. Butterfield responded to a report of shots fired in a rural neighbourhood near Bennett at approximately 11:16 a.m. Thursday, arriving on scene at approximately 11:23 a.m. with an off-duty Denver police officer identified in the report as Jeff Cook.
According to the officer's report, a silver Toyota SUV was parked in a driveway south of a residence in East Arkansas Place.
"The two front doors were open," the report notes. "There appeared to be a male subject lying on the ground outside the driver door.
"There appeared to be a female subject lying on the ground outside the front passenger door.
"I approached the male subject/suspect and observed a black handgun on the ground near the driver's side rear tire.
"I placed the male subject in handcuffs.
"Jeff approached the passenger side of the vehicle and confirmed the adult female was deceased.
"He also advised there were two small children in the back, one appeared deceased and the other appeared uninjured."
The two police officers removed the uninjured seven-month-old infant boy "and turned him over to rescue."
The victims were subsequently identified as 29-year-old Ms. Hill, three-year-old Bailey McDaniel and Mr. Davidson.
According to the summary, Mr. Davidson shot and killed Ms. Hill and daughter Bailey and wounded his unnamed 16-year-old daughter "before shooting himself in the head."
Mr. Davidson's teenage daughter from a previous marriage escaped with a gunshot graze to the back of her neck and later filled in some of the terrifying details for investigators.
Tragic tale
According to the teenager who survived the ordeal, Mr. Davidson called Ms. Hill to say that he wanted to meet with the family on Thursday morning to say goodbye and give them some presents before turning himself in to police.
With some reservations, Ms. Hill agreed to bring the children to meet with him outside the Home Depot store in Aurora.
Mr. Davidson's 16-year-old daughter says that her father showed up carrying a shopping bag at approximately 9:45 a.m. and, as he had done in his escape from the prison camp, forced his way into the Toyota SUV, pushing Ms. Hill to the passenger side of the vehicle.
Her father asked the teenager and Ms. Hill to talk about previous happy times as he drove toward their former home in Bennett.
Ms. Hill's concern grew as they approached the house and she wanted to know what they were doing there.
According to the teenager, her father took a handgun from the shopping bag that he had claimed held presents and put it in his mouth and then pointed it at his head.
Ms. Hill and his daughter pleaded with him not to do it, saying that they loved him.
As they stopped in the driveway of their former home, Mr. Davidson pointed the gun at Ms. Hill, who lunged to try to take it from him. He shot her in the head.
He turned and shot at his 16-year-old daughter, who was in the rear of the vehicle behind the passenger seat. The bullet grazed the back of her neck.
Mr. Davidson then shot his three-year-old daughter in the chest as she sat strapped in her car seat, killing her.
Meanwhile, the wounded teenager managed to get out of the vehicle and began running away, later telling investigators that she zigzagged as she ran in the hope that her father would miss if he shot at her again.
She ran screaming to the home of a neighbour who happened to be the off-duty policeman who made the 911 call to report the incident.
As it turned out, Mr. Davidson saved the last round from the .45-calibre handgun for himself, putting a bullet in his own head.
Spam king history
As first reported in a July 16, 2007, Stockwatch article, the SEC filed a lawsuit against alleged penny stock fraudsters Darrel Uselton and Jack Uselton in the U.S. District Court for the Southern District of Texas on July 9, 2007.
On the same day, Texas Attorney General Greg Abbott announced that the pair also faced criminal charges relating to their fraudulent scheme.
According to the 31-page SEC complaint, from May of 2005 through December of 2006, the Useltons obtained cheap stock from at least 13 pink sheet companies and then scalped those shares into an artificial market they created through manipulative trading, direct mailers, Internet-based promotional activities and spam e-mail campaigns.
Among the relevant players in the serial scalping and market manipulation scheme attributed to the Useltons, was "a principal spammer" who was unidentified in the SEC complaint.
"Presumably the unnamed principal spammer was responsible for operating the 'botnets' or proxy bot networks typically comprised of personal computers connected to the Internet that have been infected with malicious viruses or malware that forward the stock spam," Stockwatch noted in that July of 2007 article.
"While the SEC does not name the principal spammer in its lawsuit, it is clear that his identity is known to the regulator," the article continued. "According to the SEC, in return for disseminating massive amounts of spam e-mail touting the penny stocks, the Useltons paid the spammer approximately $1.5-million.
"It is likely that the spammer's name will surface at some point during the proceedings."
It is now known that the principal spammer employed by the Useltons was Mr. Davidson.
The informant
In fact, Mr. Davidson was indicted and arrested in Colorado on June 6, 2007. That was a month before the SEC filed its complaint against the Useltons who were criminally charged in Texas at the same time.
"The same day of his arrest, the defendant (Mr. Davidson) provided a confession to federal agents regarding his involvement in illegal spamming activities," Assistant U.S. Attorney Tim Neff wrote in an April 24, 2008, government motion for a sentencing reduction for Mr. Davidson.
According to the prosecutor, as part of his co-operation after copping a plea, Mr. Davidson provided several proffer statements to the government beginning on July 19, 2007.
Mr. Davidson reportedly "provided technical explanations as to the methods, systems and programs utilized by him and other spammers in the course of their operations."
"Such information was helpful and insightful to the FBI regarding the techniques and sources of information used by spammers," Mr. Neff wrote.
"Specifically, the defendant provided information concerning an individual identified as Darrel Uselton," Mr. Neff continued. "Davidson explained that Uselton operated a penny stock fraud scheme from his Houston based company, Warrior Capital LLC, during 2005 and 2006."
According to Mr. Neff, Mr. Davidson also provided details regarding telephone conversations he had with Mr. Uselton regarding the scheme.
"Such information was previously unknown to agents," the government lawyer noted.
"As part of the defendant's co-operation, various law enforcement agencies have interviewed the defendant regarding his activities with Uselton, including agents from the New York Attorney General's Office, the Texas Attorney General's Office and the Harris County District Attorney's Office," Mr. Neff continued.
"In addition, a staff attorney and investigator with the U.S. Securities and Exchange Commission interviewed and relied upon the defendant's information in building their case against Uselton and others connected to their fraudulent stock fraud scheme," the lawyer wrote.
According to the government lawyer, Mr. Davidson was prepared to testify in the criminal case against Mr. Uselton scheduled for trial in September of this year.
"Over the past two months, the defendant has also provided proactive co-operation as a 'consultant' to the FBI," Mr. Neff wrote in his April 24 motion. "Such co-operation has involved regular meetings with a FBI agent, at various locations and times designated by such agent.
"The defendant has attended such meetings and co-operated fully with the FBI. "Without revealing the specific details of the investigative activities (as some aspects remain ongoing), the defendant has repeatedly provided useful, reliable and timely assistance in the course of such meetings."
Because of his co-operation, characterized as "complete, truthful and reliable," and his "substantial assistance," the government recommended that the court make a downward departure in sentencing Mr. Davidson.
The sentencing
Judge Marcia S. Krieger of the U.S. District Court for the District of Colorado granted the government's recommended downward departure in sentencing Mr. Davidson on April 28.
Still, Judge Krieger noted that she had some concerns about Mr. Davidson's attitude.
"The court understands and appreciates that the defendant is quite shaken by this and he is concerned both for himself and his family," Judge Krieger said during the sentencing hearing. "But the court is quite troubled by statements made by the defendant that suggest he considers himself a victim.
"He is not."
"No," Mr. Davidson acknowledged.
"He thinks he has had a rough childhood, and I'm sure from his perspective he has," the judge continued. "But quite frankly, comparing his childhood to most of the people who appear in this courtroom, it is not a rough childhood.
"He has enjoyed the fruits of being able to work and support his family.
"Many people have not.
"And he has told me that his crime really was that he was trying to help people; that he didn't harm anyone.
"And there is a common belief in this society that if you don't pay money that you owe and if you play games on the Internet, it doesn't hurt anyone.
"It does.
"There are victims here."
The judge noted that Mr. Davidson's spam e-mail messages contained fraudulent information and he was paid well for sending that spam.
"In addition to being paid handsomely for sending those messages, some $3.5-million, he didn't report it to the IRS and pay his taxes," Judge Krieger said. "And what is particularly troublesome about this pattern is that this was no innocent oversight; it was accompanied by concerted action, thoughtful efforts to avoid detection, structuring payments into other people's accounts, structuring withdrawals from accounts in less than $10,000 amounts to avoid detection, and the conversion of a substantial amount of income into coins in order to trade with coin dealers to avoid detection.
"These are not innocent oversights and they are not justified by the desire to give your children a better life."
Judge Krieger again admonished Mr. Davidson that he did not seem to really appreciate his responsibility for his crimes.
"You are still making excuses and justifications for it," the judge said. "And until you come to terms with the fact that you have done something wrong, yes, indeed, sir, you have violated the law and you are a criminal."
"Okay," Mr. Davidson said.
"This has nothing to do with your upbringing, and it has nothing to do with your love of your family," Judge Krieger continued. "And quite frankly, I feel very sorry for your family because the decisions that you have made are going to separate you from them for a period of time.
"Your apology should go in part to them because you made bad choices, and they are going to be deprived of your comfort and love and presence because of the bad choices you made."
Judge Krieger went on to sentence Mr. Davidson to 21 months on both counts to run concurrently, followed by three years of supervised release.
Mr. Davidson's lawyer asked the judge to request that the bureau of prisons assign his client to a correctional institute in Englewood, but she declined, noting that such recommendations were rarely followed in any event.
"What I will recommend, however, is that he be placed in a facility here in Colorado," Judge Krieger said. "And I do that not in deference to Mr. Davidson, but in deference to his children, because they have relationships with him and it's my hope that they will continue their relationships with him during his incarceration."
Judge Krieger did agree to let Mr. Davidson self-surrender on May 27.
"Good luck, Mr. Davidson," Judge Krieger said as the hearing came to a close. "I hope not to see you here again."
That is now a very tragic certainty.
It remains to be seen just what effect, if any, Mr. Davidson's death will have on the civil and criminal cases against the Useltons.

I would challenge you to produce any documentation to the effect that any member of CMKM Diamonds Inc was a member of that company. And as far as a judgment against Mssrs Casavant and Moen, nope! There was NOT a judgment issued. In fact, if you read the whole case you will see that stipulations of a DEAL were not met by certain parties involved(Hodgson)and they were NOT compensated as they would have been if they did what they were suppose to have done and lived up to their portion of the deal. Business is business. I may like you but if we have a business deal and you do not produce the receipts for payment as indicated in the agreement, you don't get compensated. Period. If that makes Mssrs Casavant & Moen bad then so are many others. Some just like to complain and even slander when they don't get their way.

GOLDSOURCE UPDATES BORDER COAL DRILL PROGRAM
Goldsource Mines Inc. has completed the first drill hole and commenced drilling the second of seven additional core holes on its coal permits of the Border property near Hudson Bay, Sask. The first hole drilled in this sequence was BD08-01, which was followed by BD08-04.
Drill hole BD08-01 was drilled approximately 1,300 metres to the south of the initial discovery holes and roughly equidistant between these holes. The hole was drilled to a depth of 110 metres and intersected approximately 7.5 metres (41.0 to 48.5 metres) of carbonaceous mudstone, coal and sand partings at the base of the overburden followed by Lower Mannville mudstones and Devonian limestones that underlie the coal seam in the discovery holes. It appears that these basal units are about 50 metres higher at this location than in the original sites which suggest a gently undulating paleo-surface. There were also distinct differences in the nature of the overburden which suggests the possibility that an earlier glacial event may have removed a majority of the coal in this specific elevated location.

CMKX started off as a diamond mining company speculative play after the company filed a form 15 and ceasing to file periodic financials and keeping shareholders informed.
Speculation fueled by the likes of Willy Wizard, Sterling, Topo, Acca and jay_adobe made mention of millions of acres of prime land full of diamonds that CMKX had rights to.
It was stated that CMKX was actively drilling and conducting surveys and drilling test holes. They hype even made mention of warehouses full of mined diamonds and CMKX possessing the largest diamond ever mined.
What better way to spread the word than an alcohol powered funny car and ASA sponsorship for 1 full year. Speculators encouraged shareholders to attend races where groups would break off and the head promoters would whisper sweet nothings to the shareholders who would then repeat it to race fans and on message boards. Throw a few t-shirts into the crowd and eat a hot dog in the VIP tent while Urban and the promoters sipped expensive wine and ate top of the line beef in a seperate tent.
Speculation then turned to buyouts and mergers with many companies named.
UCAD wanted a piece of CMKX's mineral rights and spent millions in cold hard cash and handed over millions of restricted shares for a percentage CMKX's rights.
Not to be outdone, SGGM wanted in on the action too. More cash and even more shares (200 billion) were handed over so SGGM could have a percentage of CMKX's rights.
Promoters said there had to be diamonds and lots of them for these companies to pay such a premium price for a small piece of the pie.
And the whole time promoters are saying the real O/S count is extremeley low as Urban has been retiring shares like a mad man.
Then it all began to unravel.
The diamondiferous find resulted in micro-diamond-dust particles weighing .00005 carat. 2 Canadian JV's were halted after CMKX released their PR stating the find was diamondiferous but did not reveal the results. Canadian regulators refused to let the 2 JV partners trade until the actual results were given.
CMKX halted, UCAD halted
The checks stopped coming to the race teams and the sponsorships ceased mid-season.
Full blown SEC investigation
O/S count released by Urban and it's high....way high....no doubt the highest O/S count ever reached by a public company.
So far all speculation has proven to be wishful thinking only.
Then the real fun starts.
SGGM revoked, CMKX revoked
Full blown SEC investigation continues into CMKX and now includes USCA too.
ASA sues Urban for failing to pay the $2.5 million sponsorship fee.
CMKX corporate address is really a hotrod shop, CMKX does not and has never had an office there.
CMKX never spent a dime on the claims the promoters claimed to be so valuable.
All claims defaulted.
Urban decides to wind up the operations and resign.
So when you reflect you can see that there was never anything here except unsupported hype that was easily proven to be false while Urban was selling 703 billion shares. When the curtain was finally pulled back a little he said he was sick and resigned.
Somehow the retards have decided that means CMKX was shorted and now shorty is going to make them all millionaires.
Don't own one share of GXS but I own several thousand acres of coal permits inside and around the discovery. I retired a long time ago just do this for fun.

A Vancouver-based junior exploration company that discovered coal in its search for Saskatchewan diamonds began re-drilling its discovery holes Monday.
Goldsource Mines Inc. announced in April it had found coal — 27 metres deep in one hole and 34 metres deep in the second — while drilling for kimberlite about 50 kilometres north of the town of Hudson Bay, in the east-central part of the province.
"So that's about an eight- or nine-storey building [in depth]," company president Scott Drever told CBC News in an interview.
Goldsource's shares soared on the news it may have discovered a whole new coal basin in the province. The price rose from 37 cents in late April to nearly $20 by June, levelling off at about $14 per share this week.
Since the discovery, the company applied for and received 176 permits from the province to explore for coal in the region. The permits are good for a year, with two possible six-month extensions, and they can be converted into 15-year leases.
During the next two months, the company plans to re-drill the two discovery holes to confirm the initial findings, as well as drill seven new holes to see whether the coal extends farther.
An independent company, Norwest Corporation, will "be present for initial drilling to inspect coal intercepts, establish coal sampling and handling protocols, quality assurance and control and set up a standardized coal logging system," a Goldsource news release said.
The samples will then be sent to Loring Labs in Calgary for analysis based on Norwest’s recommendations, it said.
With the price of coal on the rise, Drever said if this deposit pans out it may be more valuable to the company than the diamonds they were originally searching for.
Residents of nearby Hudson Bay, which has relied on the forestry industry until its recent downturn, have been a little skeptical about all the coal hype, said Dave Ferguson, the town's economic development officer.
But after Goldsource held a community meeting and explained its findings, local interest picked up, he said.
"It has the potential to be huge," Ferguson said. "I mean there hasn't been a major coal find in the last 40, 50 years in North America. And this one here — they're very excited and they're slowly starting to drag us along, and get us excited."
Coal is currently mined only in southern Saskatchewan, around Estevan and Coronach. The province consumes most of the coal produced, using it to generate electricity.

There was nothing wrong with the "junk yard drill rig" or the people who operated it. The mental cases in Vegas and Moose Jaw were the problem.
Urbie was at the Heritage Alliance church today and I understand he actually testified and swooned! I think it used to be a baptist church - we used to skip school and sneak in and skateboard down the halls. I remember one time the janitor chased us out and later than night with our slingshots took out all the basement windows. I wish I would have been there it would have been an all time hoot!
