Thanks loop. I had seen some people say that the judge could confirm the 2002-2005 amount, but then let the SAM III arb determine the 2006 amount.
Do we know for sure that the SAM III arb involves only 2006 sales? Olddog or anyone?
Seems the Judge wants to make a decision before year end but the arbitration schedule goes beyond year end and he was not happy with that.
Could that decision be to stay the case? Guess I'll have to wait for the notes. Thanks Al and Jim and Loop.

It has effectively been stayed for 14 months already.

You gotta wonder if IDCC is waiting to announce their new licenses before releasing guidance. Otherwise they'd have to release guidance twice.
I was hoping Bill would stay back at HQ to finish crossing the Ts and dotting the Is on the new licenses, and maybe also finalizing a SAM settlement before next Monday's hearing.
Instead, Bill has plenty of time to go on the road to 2 investor conferences in the last week.

I hope you're right Jim. Management has also said in the earlier CCs this year that one of their goals is to sign a Tier 1 this year. Although they haven't mentioned that goal in recent CCs, hopefully it is one they are still working on.
Are those trades that were executed earlier in the day, and are being reported after hours?

NEW YORK, October 15 (newratings.com) - In a research note published on October 12, analysts at Matrix Research maintain their "buy" rating on InterDigital Inc (ticker: IDCC).

I believe Merritt's numbers. But Merritt did not say that the $200 million was generately SOLELY by the Tantivy patents.

Novatel would be in addition to the 2+ licenses to be announced in the 4th quarter or early next year. Because Merritt said they will be "handset manufacturers."
I relistened to the presentation. Around the 28 minute mark, Merritt's exact words are: "If you look at our market penetration, we have the 35% market penetration. If you take Nokia, Samsung, Sony-Ericsson, Motorola out of that equation, you probably have 80% or more of that tier 2 market under license."
"IDCC is already licensed for 3G by almost 80% of all tier 2!"
I heard that too. And IDCC has stated that they are only focused on the top end of the Tier 2s. So are there any remaining top end Tier 2s to sign? Or should we expect only Tier 1 licenses by year end?
I'm sure NOK and SAM were listening in on the CC. I wonder what they were thinking when Merritt said more licensees will be signing in the very near future.

IDCC said they have 30-35% share signed right now. So they need both MOT and ERICY to get their bonus.
From the Q4 CC, Merritt said:
"First, it’s no surprise that one of our biggest efforts will be continuing to add 3G licensees. Today we derived revenue on approximately 30 to 35% to all 3G phone chips but year end 2007 we would like to get to at least 50% market coverage if not higher, that means signing at least one additional top five company as well as additional tier 2 and tier 3 companies."
"So that’s our plan for 2007. Add more 3G licensees including 1 or more in the top 5, complete our modem and security design win for our ASIC, software or our complete modem design, and continue the innovation and invention activity that made us a thought leader for wireless technology."
From the Q1 CC, Merritt said:
"We also took some important steps in driving towards our goal of adding another tier one licensee this year."

Last time guidance came out less than 1 week later, so we shouldn't have to wait long.
They need to make sure all their clients have bought in before they release the reports.
I think there is a strong possibility that S-E and/or MOT will be one of them.
Merritt wasn't shy on previous CCs when talking about whether new licenses would be incremental or not. And now suddenly he doesn't want to say anything? Probably a Tier-1 then.
We know he's been saying that they are focusing on the top end of the Tier 2s and the Tier 1s. And of course we know they need a Tier 1 to get their bonus.
And if MOT has been selling a HSDPA handset for a year, and IDCC hasn't slapped an ITC suit on them yet, that probably says something.
mschere post was clearly about a legal victory not a settlement and such projections were based on a legal victory.
So if IDCC could have won 1 to 2 billion dollars, and they settled for less than 100 million, that qualifies as "pennies on the dollar".

#420 patent..has to do with initialization of the subscribers and the ability to talk to "particular" base station..(more than one)..
More significant.. The original cause of action included 6 IDCC patents (2 of which were revalidated) and 11 claims..We know that since the case has not been thrown out as frivolous..at least one Patent and one of its claims still are to be litigated at trial..IMO the Ericsson financial exposure for ten years of infringement of U.S.sales will total no less than $1 Billion dollars and past interest will double that number.and subsequently be enjoined from future sales. If you represented Ericsson could you guarrantee with 100% certainty that they will prevail? 99% will not cut it..They will seek closure, settle with IDCC for 2G ..obtain a 3G license ..and go on with their lives

Both court cases AND itc cases can be appealed. So if ERICY and MOT are to be sued, might as well use the Eastern District of Virginia, so as to not delay the NOK/SAM ITC case any longer.
