Keepfaith: I understand where you are coming from on that issue of who knew what and when, but it all boils down to who believes whom. They don't believe Ice and that's their allegation that he knew in advance. We may not believe them being caught by surprise either. It seems okay to malign Ice, but not question them....calling it a "spin" by Ice is very unfair, just as their allegations are unfair.
I do agree wholeheartedly about your reasons for not reporting your shares to the unofficial board. the only difference between you and me is they don't question your ownership, don't bash you or attack you for not doing so as they do to me. Tells me of their one-mindedness and double standards.
Ice: Yes, I've seen that and have already gone back in time to look at posts by certain aliases and now they are absent. One Mod however is very active recently with the delete button and did not allow me to respond to personal attacks yet allowed the attacking posts to remain. Yes, agenda is clear.
Anyone who holds shares and is "happy this happened" apparently does not mind losing money and has no comprehension of the seriousness of the probe.
Ice: That could well be. It strikes me so unusual that ToddWho2 and others on that MB are so concerned with little ol' Danno 123 shares, but have NOT even questioned the obvious absence of share info from the MODS or other self-prominent posters on that MB. Sorry, sticks out like a fur coat at a Texas chili cookoff in July.
Ice: It was my personal contention months ago that select investors were provided an unfair advantage with what appeared to be inside information based on their personal/business relationship with Mr. Plant via their telephone conversations, visits, email communications.
Allegedly a few claimed to have shared this information with others by publicly posting these alleged conversations and their content. However, who can proof-positive that ALL information was provided, possibly just the positive and no negative. How many conversations were undisclosed? What did they do with the information in reference to their buy, sell, or hold positions. One poster, a Mod, even stated the T/A only speaks with "serious" investors. I assume since I have money invested that I am a non-serious investor? An investor is an investor. I guess the company gave rank to those with either large sums of funds invested or continually pumped the stock. That made them "serious" and worthy of extra consideration from the T/A and others at the company.
I wonder outloud here how many of these "special" investors possibly knew of the upcoming suspension in particular, and sold on February 2, 2007. Many openly accuse you of having direct knowledge of the suspension yet you had no insider relationship with anyone at the SEC or at Cyberkey.
It is all deeply troubling to me as an investor yet those on the other MB claim I have no right to question any of this, and if I do question as I have, then I must simply be a basher, not a concerned and inquiring investor.
Sandvet: ammo was running low on your IBOX machine gun....I didn't have to dodge as many bullets!
Ice: Maybe Sandan can suggest what he/she would like to look at in SQUM...seems enthralled with SQUM
Ice: I guess they can put lipstick on the pig, but it is still a pig right now.
Hey Keep: They usually issue a summons to comply with Federal Rules of Civil Procedure. I doubt if JP had an option.
Stogie: My best quesss are those insider telephone calls between JP and members of the other board then PMs between the rest of them
LoanStew: Slorke doesn't have a major position in CKYS...right Slorke? How many buys Slorke? One for a few hundred dollars? Kinda dabbling, right?
I have NO PROBLEM showing any and all account information on my purchased shares which show 9 purchases and no sells. I also have no problem disclosing my employment, past and present. Those disclosures would be made to any SEC official who requested them, if Slorke wants to accuse me of being a paid basher. But at the same time, I'd ask they look into Slorke, his past and present employment, his stock ownership and his activity on the other board.
Slorke: You are still a rookie and you embarrass yourself here and on the other baord where they openly accuse you of being a pumper.
Slorke: Hardly. My research is usually just that, research which involves calling sources or emailing sources from CPA to several government entities and persons. You cut and paste artcles from the internet and call it DD, and post it over and over again. Even those on the other board call you a pumper, and you fail to comprehend the intricacies and severity of the problem. You've had too much koolaid since you arrived.
Slorke: Please read the definition instead of posting information you find readily available on the internet and then cut and paste, calling it DD which it is NOT. The key elements of illegal activity are (1) False or exaggerated (2) purchase stock at a lower price. There are TWO elements involved for it to be illegal. Secondly, (1)basher is generally paid (2) basher will then purchase the stock. Once again, there are TWO vital elements.
Now, you presented only one-half of the equation. The second part is relative to pumpers, as per the SEC:
One of the most common Internet frauds involves the classic "pump and dump" scheme. Here's how it works: A company's web site may feature a glowing press release about its financial health or some new product or innovation. Newsletters that purport to offer unbiased recommendations may suddenly tout the company as the latest "hot" stock. Messages in chat rooms and bulletin board postings may urge you to buy the stock quickly or to sell before the price goes down. Or you may even hear the company mentioned by a radio or TV analyst.
Unwitting investors then purchase the stock in droves, creating high demand and pumping up the price. But when the fraudsters behind the scheme sell their shares at the peak and stop hyping the stock, the price plummets, and investors lose their money.
Fraudsters frequently use this ploy with small, thinly traded companies because it's easier to manipulate a stock when there's little or no information available about the company. To steer clear of potential scams, always investigate before you invest:
Consider the Source
When you see an offer on the Internet, assume it is a scam, until you can prove through your own research that it is legitimate. And remember that the people touting the stock may well be insiders of the company or paid promoters who stand to profit handsomely if you trade.
Ralphkaz: I don't think any of us are shocked. However, it is possible that Sequiam didn't ship the order until after the 4th quarter, and therefore, did not post it as a sale in the 4th quarter. I agree as first glance it doesn't bode well for PR on a $2.5m PO from CK to SQUM.
The Enduro: I'm not sure what the poster on the CKYS board bought off Ebay from Cyberkey, but he seems to be elated. My personal experience with the Enduro flash has been less than stellar. Here's what the web site says about the Enduro:
Have More Security than Vladimir Putin - We’ve got your back - the Enduro features Personal Anonymity, Personal Intrusion Detection, Filtering and Blocking, and Personal Communication Security via our preloading PurelyPrivate from SpyCop, LLC.
PurelyPrivate is a suite of personal privacy applications, detection of surveillance filtering, blocks and shreds malicious code, scripts, pop-ups, ISP log files and personal history files. PurelyPrivate also encrypts email, chat and instant messenger contents and encrypts content files downloaded and copied to your Enduro, on the fly. Additionally, CyberKey bundles a trial subscription to McAfee Virus Scan software for virus protection.
I received mine more than a month ago. It took almost 2 weeks, several emails and telephone calls to get the correct partitioning/security utility as the one on the web site for download is not the correct one. Now read the web site promise of the included software such as Spycop aka PurelyPrivate, and McAfee trial. None received. Absolutely none.
I was told two weeks ago the information on the web site is wrong as the Enduro does not come preloaded with the software. I was told that would be corrected, and all software will be avalable for download from the web site withina week. Guess what? Still not there.
I'm just an investor, that's all. But think about John Doe public buying this drive after reading the web site...does false advertising ring a bell? Oh, the kicker was I had to tell them what was said on the web site. They obviously don't proof read it.
Ralphkaz: When I post an invoice for a client, I do so when they have completed the service and/or shipped their product. Then it goes directly to sales on the P&L, and remains as an A/R on Balance Sheet until paid by check, cash, credit card. That's accural method of accounting, and the standard for most business purposes.
ForestFlan: Since I'd get deleted on the other board and I know you visit here...don't call me a liar on the other board. I own shares. Period. Are you too dense to understand that I do not bash the stock? I express my extensive displeasure with the executive team at CK for its obvious errors, omissions and misleading and/or untruthful statements. I also state my displeasure with obvious pumpers who try to entice uninformed investors to buy. One can't bash a stock that is close to worthless! One can express his/her displeasure with the management team that caused its demise.
You're a coward. You have something to say to me like question my share ownership, then bring it here where it can be discussed without censorship.
Robtff: I have proof. Called the Bible. I see the gift of life. The complexity of every living creature. There is only one explanation...God.
Robtff: Thanks for your explanation. If that is your belief and basis for it, then you have to go with it. However, from my perspective, belief in humans is not the same as belief in a Divine Being. We as humans are not perfect yet God is by His very nature. We can have faith in others, but for me, it is not unconditional, as is my faith in God and His word.
Ice: Oh I know some of the quotes from visitors that proved to be false based on conversations with Mr Plant too. Mr. Plant can always deny he made those statements. Mr Merlich can deny his phone conversations too.
Robtff: You ask questions, but don't answer mine. What is your basis for the unquestionable belief and loyalty in what Mr Merlich tells you in a phone conversation?
Robtff: Absolutely...and you?
Robtff: Yes unless proven my opinion wrong after the SEC probe concludes and confrims such contract. You need to review history...GWB told us to believe WMD in Iraq, we were told the U.S. wasn't behind the Bag of Pigs, Ken Lay said all was fine with Enron, Nixon said he knew nothing of Watergate coverup.
How many years have you known Dan Merlich, boyhood friends, college fraternity brothers, member of your immediate family, served side-by-side in the military? What basis does he deserve your unquestioned faith?
Forestflan: For one, I am interested because I still hold shares so the company has my money. Secondly, there is huge interest in this company, the SEC probe, simply because it was touted as so unique and largely different than 99% of the pinkies. It is an unfolding and evolving story of significance in pinkie land.
What is the fascination with a failing company in their eyes?
So you admit it is failing.
Robtff: What do you think Mr. Mertlich is going to say especially since he works for JP and the company is under SEC investigation? He's holding the company line that is challeneged by the SEC. If the DHS contract was FACT, the company would issue a PR saying Cyberkey provided the DHS contract to the SEC showing a $25m sale, and the contract has been verified by the SEC investigators.
BookUm: Exactly, I listened to the same interview several times. Nothing but a pump interview and what Mr Plant discussed then doesn't exist even now. That web portal he promoted should have been out the 4th quater of 2003 for music. Never happened. None for Mascar yet he advertised it nationally in the Nascar Guide out in February 2007. No MYFanKey either. I mean we could go on and on and on.
Yes, all one has to do is google medical data, medical and usb flash drives, and see other companies already doing this. I imgaine JP will try to claim they stole his "visions" and "solutions".
LoanStew: Yes, I agree. They would have to admit our DD was right on the mark too. I learned long ago in life whether it is friends, family, business that it is always best to openly admit mistakes. All of those people admire it and you gain more of their respect, admiration and reinforce your integrity with them. That's what works for me in life. If the SEC completely exonerates Mr Plant and the areas it is investigating, then I'd be more than happy to admit I was wrong. I doubt that happens as the SEC is not doing this for grins, or just to pick on CKYS. It is serious. It is an official govenrment investigation. The Fantasy members can criticize the SEC all it wants, but the fact remains, it has the legal right to investigate. Nothing is life is fair, and not all companies get invetsigated when maybe many others should be probed. It is also not fair when one gets stopped for speeding at 70, when the car next to them was doing 90 and not stopped.
I also find it traggic that some who claim to be christians use their faith to gain credibility with others especially when it comes to investing and monetary issues, and especially when they have a direct monetary inetrest in the outcome. "For they, being ignorant of God's righteousness and seeking to establish their own righteousness, did not subject themselves to the righteousness of God."
Yes, from what I've read about SEC and securities investigations, they ought to be far more concerned about pumpers who have not disclosed their share interest and trading activity such as flips, or buying/selling patterns prior to the suspension and afterwards.
BookUm: When you search the internet then one will find Mr Plant's so-called solutions already in existence by other companies in several areas such as medical emergecy, medical records, home records and insurance, child lost and kidnapped. Mr PLant on the other hand has failed to bring one to market inclusing his most recent fiasco MtFanKey advertised in the Nascar guide when it was NOT available for purchase along with his web portal for it.
Many of his so-called "visionary" concepts aka solutions are already available while he continues to promise yet fails to deliver.
LoanStew: I'd have far more respect for them if they'd recognize then admit that this stock's demise is the direct result of Mr Plant's actions, words, deeds, omissions. However, I realize in doing that they too admit making a mistake in their judgment and investment decision, in some cases huge mistakes, with the amounts of money invested. I've openly admitted it several times...I made a misatke. It is much easier for them to find scapegoats such as us.
Much of the reading I've been doing lately even indicates that pump boards like that one in Fantasyland are far more dangerous to investors than those that challenge such as ours. An actutal statistical study was done on it and referenced in many prestigous magazines and business newspapers. Additionally, the SEC is far more interested in looking into pump message boards, and the individuals involved in those pumps.
I see ToddWho2 said he'd talk to you more if I would disclose (validate) my shares. Todd is a nobody, and there's no need to validate my shares as I don't believe their thoery of NSS. Aside front that it is my right to protect my personal information. He ought to be more concerned with the mods and some prominent posters who have not disclosed their shares yet consistently have pumped the stock.
Janice: They certainly are but I understand that many are suffering huge losses, and rather than blame themselves for holdong their investment or Mr Plant, they think we over here have some huge effect on CK demise.
At least I admit my mistake of holding too long, but I also know who to blame for its demise and the SEC investigation...Mr Plant and his executive team.
Heenster: That's fine. That's their usual argument against anyone who questions the company. I understand their frustration since they've both lost a heck of allot more cash then I have on CKYS.
Both projects you refer to are just in the works...kinda out of my hands until I hear back, or I'll follow up next week with both sources. Don't like to rush them.
Good Article: One of the posters on the Fantasy Board provided this useful info...why does it not surprise me that anyone commented on its valid content as it pertains to CKYS. I guess ToodWho2 is too concerned with my share count, and Smartmoney claims I bash the stock. First, ToddWHo2 has no authority or valid reason to know my share count or anyones for that matter just as he has no right to see my check book, savings account or driver's license. He's nobody. Smartmoney doesn't realize I do not "bash" the stock. I question the competency of the company's leaderhip, integrity and truthfulness, and blame them for the stock troubles. Bashing is their catch-all word for those of us who are not cult members.

Heres some administrative procedings education:

dbleagl: Yep, two of mine simply in response to cultists who used my name in their posts...and while theirs remain, mine were instantly deleted.
Yep that was a real gem! eom/
Thomas: from what I've been able to research it's extremely serious when it gets to this level.
dbleagl: They are too busy to bid. Gotta discuss the stock manipulation on the greys from open to market close each day. Yep one would think dozens of them would be bidding
Next Stage: Guess the word is Mr Plant is going to D.C. to meet with the SEC. Guess it will be Discovery time for the SEC lawyers. I'll assume JP is answering a summons to appear, and just didn't offer to go for a friendly visit. Obviously much more serious than "bump in the road" comment by a poster who vistied CK during the suspension.
Chapter V - Discovery (Federal Rules of Civil Procedure)
Rules 26 to 37.
Chapter V covers the rules of discovery. Modern civil litigation is based upon the idea that the parties should not be subject to surprises at trial. Discovery is the process whereby civil litigants seek to obtain information both from other parties and from non parties (or third parties). Parties have a series of tools with which they can obtain information: 1) Document requests: a party can seek documents and other real objects from parties and non parties 2) Interrogatories: a party can require other parties to answer 25 questions 3) Requests for admissions: A party can require other parties to admit or deny the truth of certain statements 4) Depositions: A party can require at most 10 individuals or representatives of organizations to make themselves available for questioning for a maximum of one day of 7 hours, without obtaining leave of court.
dbleagl: That's exactly my point, and they need to take ownership of their part in it which was calling, emailing, writing the SEC to rant about NSS and probably complaints about the FnF crew too. Liquid and I imagine others started badgering the MMs too, and those MMs could well have picked up the phone to the SEC too. But to place it all solely on this board, its members and Moderator Ice, is just unfair and absurd.
Hate Danno! : Yep, I've been investigating that hatred factor and my DD certainly dispels it! LOL. Anyhoo, I've explained it to them over there in posts and PMs that I STILL HOLD my shares. You did not hang me out to dry. How could you? You didn't know a dang thing about a suspension. I hung myself out on February 5. My best guess is the SEC was getting hit from all quarters, all sides, prior to the suspension, and their interest really got piqued by the complaints when it saw PRs about CK sales to the federal government. Those cries of NNS, call the MMs, contact the SEC...well, that brought just as much attention to CK by the SEC, as complaints about the share structure, contracts, PRs etc.
Liquid: If he's going to D.C. for the SEC, then it would be at the request of the SEC to appear. The SEC calls the shots, not Mr Plant. Now if you truly think Mr Plant is going to use your stated approach with the SEC....well okie, dokie. LOL
