For the sake of argument let's say CYDY has a functioning drug that has been buried under the manure of horrific management. That one Nader Pourhassen has done such a disservice to investors and humanity to nearly extinguish the promise of a working drug.
Most of the board must go. Scott Kelly and Nader Pourhassen must go, and if the law so sees fit, the spend the last of their natural days behind bars.
that's just step one.
The real deal comes from finding a good experienced biotech maverick that wants to see a major project through. A Randal E. Woods type. Someone who has had his fair share of biotechs bought out, but has also seen his fair share of biotechs fall apart, but not for a lack of effort. Literally someone who invokes the quote of Teddy Roosevelt about the man in the ring.
Nader is no man, Nader is pond scum that deserves obliteration in the field of honest endeavors and good management. Nader is a fetal shit pig.
With solid management behind the company, non-dilutive fundraising can begin.
Step two is admitting the COVID farce is over.
CYDY is well out of step of ever producing a drug in time to meaningfully answer the market need. All that remains is HIV, NASH and possible cancer. CYDY needs to focus on revenue producing ASAP.
Step three, CYDY denies Nader, Scott Kelly, and any other current fraud their severance packages. Nothing reinforces a changing of the guard like obliterating the former leadership that nearly destroyed the company. In a just world Nader ends up back in Iran to live out a peasant thief's life, Scott Kelly spends 30 years in federal prison along with anyone else engaged in fraud.
But I will settle for a company put back on the right track with a drug that isn't lost to criminal activity and mismanagement.
That includes those hired by Nader to help him pump the stock.

A History Of Evil
He was a recipient of the United State's Goodwill after the fall of the Shah of Iran. He had access to education, freedom, and the opportunities that those around the world would die for.
In the end he was no better than a bandit that should have been hung in the town square.
Nader "The Chipped Tooth Liar" Pourhassen first committed his major crime while attending college. He defrauded a bank in a bad check cashing scheme that earned him the ire of his adopted state. That ire would rise again in a scheme to defraud consumers by claiming that art he sold was created by Native Americans. He was arrested in New York City, a popular departure point from the USA, and sent back to Utah to answer for his crimes. After his run in with the law and narrowly surviving Utah Justice he fled from the state where he wore out his welcome.
He now resided in the unsuspecting state of Washington, were his first wife would learn of his brutal narisistic ways. In a reviling court order Nader Pourhassen was order to stay away from his first wife and child via a protective order he soon violated. Admonished by the court he barely escaped serious jail time.
Years later he remarried and engaged in a fraudulent affair with running the company CYTODYN. There he made numerous false promises, engaged in market manipulation, fraudulent lawsuits against vendors and incurred the wrath of the DOJ and SEC. In a Delaware Court ruling his "unmitigated greed" was lambasted as he shirked away from the light of justice. He again faced several civil suits as federal law enforcement closed in around him.
A pattern of behavior has developed that will likely come under even more intense scrutiny. Nader engages several "news sites" to promote his stock. At the same time several blogs, posters and other internet sources unblindly give him praise. The question arising is who all is involved in a orchestrated promotion to pump CYTODYN beyond reasonable established facts.
Well ultimately Nader "The Multiple Time Felon" Pourhassen knows. And justice willing he will either spend out his last fetid days behind bars or be deported from the country that granted him so much freedom and opportunity that he spat on.
CYTO-CRIMES
Nader commits securities fraud with his BLA scheme.
Scott Kelly backs him knowing full well the status of the studies given his position.
Nader engages groups like Zerohedge, Proactive and other "fringe news groups" to pump stories on his behalf.
A fake Floridian Nurse claims to have fought against the SOC, somehow got Right To Try and then claims an miraculous recover a of their child. While never disclosing they are in fact a major shareholder of CYDY.
Nader claims the DOJ and SEC investigations are only fact finding. A phone call to investor relations stated "we were told from on top that it was merely "fact finding" and know nothing else."
Highly positive CYDY posters from other boards claim visits from the FBI, and that the FBI claim that the "drug is good," despite that being outside of the FBI's purview.
Several high profile posters from other message boards go silent as further revelations of fraud become public.
Here is my guess. Nader engaged several persons to post die hard positive reviews of the company. Several false stories of inferred positive reviews from "FBI agents saying the drug is good" cock and bull stories.
In the end I expect several criminal indictments and changes in reporting methods in the wake of all these "Cyto-Crimes"
This isn't running down drug dealers, human traffickers, or national security threats. This is white collar criminal activity. No repelling from helicopters or any other crazy nonsense.
Yes they absolutely do give a shit about legal representation issues because screwing something like that up kills cases. Last thing they want to have happen is someone in a custodial hold answering questions while being told "no you don't need an attorney" and then getting spanked over it by a judge.
Dropping by unannounced is a good way for spooking someone into lawyering up immediately and getting zero information. Even Nader gets notice that DOJ and SEC investigators want a chat.
Don't get me wrong I absolutely believe the DOJ is tracing who is involved with who at this point. By the time this is over there will be a chain between Nader and promoters.
There is absolutely no way the FBI is "visiting random shareholders," that's a load of crap. Keep in mind the same message board on Reddit claimed Nader was in a secret meeting with a billionaire in Las Vegas, secret meetings in D.C., people who "bash the stock" on message boards being sent to jail.
People who get visits from the FBI don't talk about it, they also don't talk to the FBI without council. The FBI doesn't just drop by either like on TV. Everything the FBI does costs money and time. Chasing down angry nerds doesn't fit into their "best use of time."
How about no and the company does a reverse split. It get's it's money, and the long term shareholders who were asleep at the wheel receive their just punishment for blindly supporting Nader?
This is a myth.
1. "Big Pharma" can't steal anything. All it takes is for a CEO to say "no we don't accept your offer." It's not like Nader was on watch, guarding against thieves and mercenaries looking for the holy grail that people claim Leronlimab is.
2. What potential? We don't know if it works. We don't know if it will actually meet the FDA standards once it has a complete filing to turn in.
3. The right fighter? Committed fraud, lied to shareholders, failed to meet a single goal, gained the attention of the DOJ and SEC.

No word from the company that it has been cleared by the DOJ and SEC. The investigations remain ongoing.

CYDY demanded Amarex submit the HIV BLA knowing it's not complete. They acknowledge it's not complete but want it done anyways.

The company's filings stated it was served with subpeonas including it's officers for the statements made by the company and officers regarding Leronlimab.

So Amarex suit is being heard in Maryland. Maryland is a contributory negligence state. Nader told Amarex to file an incomplete filing with the FDA to appease some message board. CYDY is cooked.

Well with Nader intentionally telling Amarex to file a knowing incomplete application, and then telling shareholders how awesome everything is going....
It's not a question of if a crime has been committed any more. It's a question of how many knew and went along with it.
So the DOJ and SEC are probably hoing to clobber the company and officers real soon.

Not really. Everything is slated for mid 2022. Nader has never hit a deadline unless it involved him cashing in on stock options. Financially time is not on CYDY's side either. There are a lot of other companies further along than CYDY, that handle turnarounds better and don't face credibility gaps.

So it depends on first the shareholder vote. Then the SEC actually allowing them to place the shares publicly. With the SEC and DOJ still not finished their investigation into CYDY those shares may not make it to market.

The Reality Of A No Vote
A reverse split would sink the company. All loyal investors get burned, and the new ones will avoid CYDY like the plague.
A reverse split at 3 bucks would quickly sink back to 1.50. Not much of a story stock when your shares get reduced 4 to 1.
There is no partnership. CYDY has nothing to offer right now. It has a dubious record with drug trials. Nader won't budge when it comes to things like compensation and control.
CYDY is laden with bad debt. The DOJ and SEC investigations aren't even over.
So with pretty much everything slated for mid 2022 to wrap up and no further funding, CYDY goes bankrupt.
It's plain as day between what has previously been put out in PRs, Nader's statements and more recent PRs, that there is some kind of fraud or deception taking place at Cytodyn.
Nader's haziness about the first round of injections and enrollment progress are going to show up again when the trial runs over it's planned time.
Just remember Nader makes 1.5 million a year for doing exactly what he is doing right now.
So sounds like they just started and weren't doing trials. So everyone say trials had not started yet were right. Nader led everyone to believe things were well underway.
Getting details right should be like tying your shoes. Which is why Nader is constantly tripping over himself.
They already announced this weeks ago. So either it didn't happen then or they are recycling news now.
Last filing was 200,000 vials and they went for 41,000 USD. CYDY is still under compassionate use in the Philippines. The PFDA goes off other "senior regulatory" agencies before approving, no one has approved it yet. Clinical data isn't there yet. Brazil trials either save or sink the company because HIV may never happen the way Nader runs the show.
CYDY's Current Situation.
CYDY has a horribly flawed and useless CEO. Nader Pourhassan is an absolute scumbag. Not just for the shit he did in his past, but it's been the constant lies and misrepresentations to shareholders. The complete lack of personal responsibility and even the ability to competently manage a company.
In every failure, he is a major component, and he is a constant liability because of his behaviors. He is a constant target for lawsuits with merit, a walking red flag to the SEC and DOJ, and a egotistical greedy pig of a man. You don't have to look much further than the Delaware Court ripping into him for his unjust enrichment scheme.
Speaking of his schemes we can go right to his attempted end run around the regulatory process. Stalling clinical trials to hand out EINDs like candy to the point of the FDA having to step in and check him. Just like the FDA would have step in again and check him because of the misinformation campaign around Leronlimab.
Nader's behaviors and criminality have to be nailed home, because there is a serious contingent that excuses everything he does. Not unlike how Joe Paterno or Jim Jordan get excused by their respective followings. Shareholders are in fact the first line of defense for any company. When they refuse to defend the company, hold officers accountable, or ignore serious mismanagement, it allows for more egregious to happen.
Nader is a case study in unchecked behaviors.
The Drug Itself.
So the scathing rebuke of Nader aside, let's talk about the drug itself. It is know that it has had teething problems with HIV, but is the best path to actually be approved. So there isn't much to say other than note how strange it is that this path gets pushed further and further back. That again goes back to Nader as CEO and being an all round awful human being.
I want to talk about cancer next. I would love to be enthuisatic about it, but those studies take a long time. Not only that, but CYDY now has a history of "always stellar" PI and PII results. Only for it to turn into train colliding with a school bus style investment horror story. Because CYDY has no track record, credibility is everything. Well credibility has been burnt through. It's why the market won't move on that news, or contract after any positive share price movment.
CYDY needs and EUA or BLA to have sustained positive movement.
Can't stress that enough. So now we go to COVID.
There have been a lot of lies about CYDY's COVID progress. Anecdotes thrown around like Halloween Candy to distract from the reality that is biotech investing. Clinical Results are everything. When someone takes 2 weeks results and claiming those are the end all be all results you have a problem. When someone claims to have medical expertise and ignores long established protocols, or gets wrapped up in the financial outcomes that leads to trouble.
Perfect example is from a Zerohedge Article involving a "Parent" heavily involved in CYDY ignoring medical procedures and the interests of a child/patient in favor of proving a point. The story itself is dubious because you can't get Right To Try drugs without going through the Standard Of Care first. But let's take the story at face value and what was done. Someone seeking an anecdote to justify everything and induce other investors to buy or buy more. Just at the price of a child. That's just sub-human.
Clinical results are everything. They remove the possibility of coincidence, provide objective analysis, and make regulatory approval possible. CYDY hasn't hit those numbers to earn an approval.
At most CYDY has results that justify continued exploration of their hypothesis. Not outright approval. Certainly not the right to harass the FDA, Congress, or anyone else.
Could the Brazil trials be different? Maybe. If they are it shows how badly Nader has managed things. He ultimately signs off on the designs, tells the CRO what he wants out of the trials. The roads led back to him. If CYDY can swing good numbers they will be able to do a BLA, but probably not an EUA.
The BLA is the only open route to approval because again credibility is everything and CYDY currently has none. The FDA has already dealt with all kinds of shenanigans out of this company. So an EUA is unlikely over potential blow back from another potential unforced error. The FDA is staffed with diligent and good folks, but errors happen and when they do it hurts their mission. They don't want granting an EUA to CYDY to be another error, so they are going to make them take the long road. Again that's Nader's doing and the situation he created more than anything else.
So I hope the Brazil trials work out. I don't think they will because of more trial design flaws out of Nader. I think something is amiss with the management of the company in general. I have been saying that for a long time.
So it's definitely a situation where the drug may have potential but it's buried under a pile of crap. There may not be enough time to dig it out. Burning a lot of cash to keep the lights on, a lot of unforced errors eating up money. Multiple lawsuits and possible regulatory punishments in the pipe. The fact that Nader is likely kept on really hurts the chances of recovery.
That's the situation.

CYDY is not on the list. Which is strange considering that Nader supposedly got into contact with them. At least he said he did. So two possibilities Nader never contacted them and they aren't aware, or he did and the European Health Union thinks very little of CYDY's current offering and data.

We know the trials have a set length. Everyone has to get injected, the trial runs it's course and then the data gets interpreted. CYDY has stated everything will wrap mid 2022.
So how is it that this idea of "sudden results, sudden approval" gets tossed around? It flies in the face of what Nader "The Chipped Tooth Liar" Pourhassan has said.
Even when we have a timeline from Nader, it's never been met. Nader has never delivered early, and has a routine of having to move goalposts.
The only results that could break at any time are the results of the lawsuits, criminal charges, SEC halting the public placement of more shares and so on. Those are events that will resolve sooner than later because they are serious legal matters, and Nader doesn't have the ability to delay legal actions against him and the company.
