President Donald Trump's revised travel ban "speaks with vague words of national security, but in context drips with religious intolerance, animus and discrimination," a federal appeals court said Thursday in ruling against the executive order targeting six Muslim-majority countries.
In a 10-3 vote, the U.S. Circuit Court of Appeals for the 4th Circuit said the ban likely violates the Constitution. And it upheld a lower court ruling that blocks the Republican administration from cutting off visas for people from Iran, Libya, Somalia, Sudan, Syria and Yemen.
The Richmond, Virginia-based 4th Circuit is the first appeals court to rule on the revised travel ban unveiled in March. Trump's administration had hoped it would avoid the legal problems that the first version from January encountered. A second appeals court, the 9th U.S. Circuit based in San Francisco, is also weighing the revised travel ban after a federal judge in Hawaii blocked it.
White House spokesman Michael Short said the administration was confident that its order is legal.
"These clearly are very dangerous times and we need every available tool at our disposal to prevent terrorists from entering the United States and committing acts of bloodshed and violence," he said.
The Supreme Court almost certainly would step into the case if asked. The justices almost always have the final say when a lower court strikes down a federal law or presidential action.
Trump could try to persuade the Supreme Court to allow the policy to take effect, even while the justices weigh whether to hear the case, by arguing that the court orders blocking the ban make the country less safe. If the administration does ask the court to step in, the justices' first vote could signal the court's ultimate decision.
A central question in the case before the 4th Circuit was whether courts should consider Trump's public statements about wanting to bar Muslims from entering the country as evidence that the policy was primarily motivated by the religion.
Trump's administration argued the court should not look beyond the text of the executive order, which doesn't mention religion. The countries were not chosen because they are predominantly Muslim but because they present terrorism risks, the administration said.
But Chief Judge Roger L. Gregory wrote that the government's "asserted national security interest ... appears to be a post hoc, secondary justification for an executive action rooted in religious animus and intended to bar Muslims from this country."
The three dissenting judges, all appointed by Republican presidents, said the majority was wrong to look beyond the text of the order. Calling the executive order a "modest action" Judge Paul V. Niemeyer wrote that Supreme Court precedent required the court to consider the order "on its face." Looked at that way, the executive order "is entirely without constitutional fault," he wrote.
Ilya Somin, a law professor at George Mason University, said the partisan split was troubling.
If the Supreme Court follows the same kind of partisan divide, the Trump administration may fare better since five of the nine are Republican nominees. Still, he said, it's difficult to make a confident prediction because "Supreme Court justices don't always vote in ideological lockstep."
The first travel ban issued Jan. 27 was aimed at seven countries and triggered chaos and protests across the country as travelers were stopped from boarding international flights and detained at airports for hours. Trump tweaked the order after the 9th U.S. Circuit Court of Appeals refused to reinstate the ban.
The new version made it clear the 90-day ban covering those six countries doesn't apply to those who already have valid visas. It got rid of language that would give priority to religious minorities and removed Iraq from the list of banned countries.
Critics said the changes don't erase the legal problems with the ban.
The case ruled on by the 4th Circuit was originally brought in Maryland by the American Civil Liberties Union and the National Immigration Law Center on behalf of organizations as well as people who live in the U.S. and fear the executive order will prevent them from being reunited with family members from the banned countries.
"President Trump's Muslim ban violates the Constitution, as this decision strongly reaffirms," said Omar Jadwat, director of the ACLU's Immigrants' Rights Project, who argued the case. "The Constitution's prohibition on actions disfavoring or condemning any religion is a fundamental protection for all of us, and we can all be glad that the court today rejected the government's request to set that principle aside."

as litigious as our society is, and as high as some of these lawsuit settlements are (most are appealed way down BTW) you can try and kick my a** black and blue, (hell bring a friend) for 8 million dollars, hahhahha don't get too crazy you got be outta jail to spend it. hahaha but i think i prefer a peaceful, no drama flight anyway, lets just keep the antics on the ground, they should start issuing fines like crazy for those acting a fool and delaying flights and ruining the experience for others and put the money in a pool for paying legitimate lawsuits that actually have merit.

i think there is just the one group of west coast passengers that opposed the merger for competitive reasons, effecting ticket prices. but with DOJ approval and stipulations met. i don't see they have a case, they have added attorney, don't see original lead attorney still, and jury trial was denied, may 18/19th is deadline for summary judgement or set trial date, i believe. here is hoping for summary judgement, general consensus is final disbursement late summer early fall
but would be nice sooner rather than later, i would give them 30 days from end of last case settlement
realistic, 90 days is not unusual for the crunching of numbers and rechecking everything before actual distribution of funds, cause they know they aint getting it back once they give it to us. :) but lets hope for sooner rather than later. at this point an announcement that all cases have been resolved, alone, would be well received announcement, in and of its self. GLTA OH WAIT! just saw the YEAR 2018, well crap, lets hope your wrong. surely this fall will be long enough for the bean counters to figure a way to syphon off as much as they can in order to not pay out anything.

for me, the distribution is a bonus, a reimbursement of that which is owed, so won't be affecting my sell price, (which is pretty close to yours) i have waited this long, i can weather any storm now.
yeah we should set up a nation-wide satellite up link for the drinks and festivities who have waited so long for that last pay out. so i guess may 19th is the next date to at least check back to see about summary judgement or trial date. but at least something we can wrap our brains around now, as in we can at least see the light at the end of the tunnel. now would be a good time to reassure shareholder confidence.

i don't either, what i read, appears to be good news, we have been on a roll the last couple of days, and was expecting a spike today, and see no explanation of premarket drop, unless there is something we don't know yet, or its being manipulated. hoping for a strong correction after opening. 1Q is never the best, and thats to be expected, and the numbers for the next 3Q's look good. summer traffic will be good
well raises shouldn't concern anyone, there were several imposed paycuts to attempt to keep AA out of BK, one of which was 24%, the pay raises bring flight attendants back to their 2004 wages, not counting any inflation, plus their new 787 jets(9 flight attendants) accommodate same number of psgrs as the 777 aircraft (13 flight attendants) thus reducing labor costs substantially with the ratio of flight attendants to passengers, as well as much better fuel savings.

your right, cause the airlines can show some prices are cheaper as well as some higher, and the fact they gave up routes and such to get the dept of justice approval. so they don't have to defeat AAL they have to defeat the DOJ, so good luck with that!! this should definitely be a summary judgement. not to mention, it would be nearly impossible to show damages for those individuals. you would have to prove your intention to fly and prove you would have paid less. come on summary judgement, they threw out cases that had much more merit
anyone know what the last case is about/with? is it a possible big payout case or small? AAL is on a roll, so far with these cases, lets hope we can hold on to the momentum. keep the information flowing and thanks for the due diligence guys.
i sure hope your right, wow, its about time this was resolved, and would improve shareholder morale, i just hope they don't come up with some creative accounting, minus legal fees, minus administrative costs, minus negotiating during a full moon cost.......half that would be nice, 7.4% would make my year. so now lets just hope this last case gets resolved quickly and doesn't take another year
every story has 3 sides...hope this one just goes away..here is info from someone who actually witnessed it, not just furthering hate or an agenda.
I was on this flight directly across the isle from the woman filming the video. This is what I observed: 1.) woman gets on the plane pushing a car seat type stroller with one child in it, carrying a second child on her hip and dragging behind a very large folded stroller that was too big for the overhead bin or to go under a seat. 2.) the flight attendant shown in the video approached from the back of the plane and informed her in a calm manner that there was nowhere to store the stroller. The woman immediately escalated the situation and within about 30 seconds was screaming at him at the top of her lungs. 3.) the flight attendant evidently decided she was not fit to be on the flight (in my opinion the correct decision) and started to move her and her children towards the front of the plane. 4.) when they got to the from of the plane the woman decided she was not going any further. The flight attendant picked up the stroller and lifted it over his head to try and move past the woman. As he was doing this she pushed him and the stroller fell a bit and struck her in the face. She began crying loudly and dramatically. Shortly after this is where the video begins. 5.) The first class passenger then inserts himself into the drama with his faux chivalry but clearly has no idea what has transpired in the back of the plane since he was in a window seat in the first class section of the plane and could not have viewed the incident from his seat. 6.) after another 10 minutes or so the woman exits the plane only to be returned about 5 minutes later and taken to her seat. We wait another 30-40 minutes while various flight and ground crew come and go speaking to the woman. After about 40 minutes she deplanes again this time telling all of the passengers, who are now becoming vocal in support of the flight crew, that all she wanted was an apology from the flight attendant. Evidently that's what the 40 minute delay was all about. Then we waited another 10 minutes for the ground crew to find and remove her luggage from the belly of the plane. 7.) the flight finally leaves and arrives in Dallas an hour or so late. American representatives are waiting at the gate to speak with the first class passenger who made the threats. What I heard was a very apologetic tone coming from two American employees, as if the airline had done something to upset the first class passenger. 8.) when I entered the bag claim area the first class passenger was right in front of me and as soon as he made it through the revolving door there was a camera crew waiting for him on the other side to interview him. That's about as factual of an account as I can provide and I realize there may be other parts of this story that I do not know about or did not witness. From what I saw: a.) if anyone from American should have been punished it should be the ground crew who somehow letting this woman on board with a full size stroller. The flight attendant was put in a horrible situation by a passenger that most passengers in my immediate area thought seemed unstable. She escalated the situation, not him. b.) in my opinion, the first class passenger should have been removed. Had the flight been in progress he might very well have been arrested upon landing for threatening a crew member. Additionally, he could not have seen any of the back of the plane antics of the woman based on where he was seated. c.) I agree the flight attendant may have reacted too harshly in responding to the threatening customer in first class, but his actions with the woman in question were professional throughout the ordeal. I am disappointed American has chosen not to punish him.
Just read the article from ABC news and the comments from the traveling public. Nice to know over 95% agree that the mother overreacted and ask why she would even try to bring a stroller onboard. They also have the opinion that the male pax should have been removed from the ac.
This time the public has the airlines backs, i mean alternatively, they could have gotten 3 nice frequent flyers to voluntarily check their roller boards so this woman could bring her stroller on. hahaha yeah right, i think once you delay the connecting flight 2.5 hours and you feel your luggage takes priority over everyone else's. you loose support. although i think in hindsight the f/a should not have even responded to guy making threats, kept the issue off the plane. the women wanted an audience. i think we are gonna see a lot of "staged" videos to see if they can get $$$$ from airlines.
yep that would be nice. but they always seem to find a reason not to payout, legal fees, court costs, full moon, the pilots did loose that last case but not sure if that was only one, but lets hope the last one resolves quickly, it will be nice to clean the books, and not have any things up in the air, besides our planes

i find it amusing, when the mob mentality, cheers litigation (rightfully or wrongly) where do they think these enormous payouts are coming from? corporations won't print that money, or take it from executives, vendors or shareholders, they will pass the debt onto those same consumers, so they are actually cheering on higher prices/fares for themselves. certainly many times lawsuits are justified, but we do live in a litigious society. beautiful weather today, that is all.
plus we are the "meet or beat" estimates airline. as long as we continue to beat estimates, keep capacity in check, a lot of good potential in the pipeline
American Airlines Group Inc on Tuesday raised its quarterly forecast for a key revenue metric, citing higher average fares.
The No. 1 U.S. airline said it now expects total unit revenue, which measures sales with flight capacity, to be up about 2-4 percent, compared with the 1.5-3.5 percent it previously forecast.
The forecast comes at a time when other airline companies are struggling to increase unit revenue. Last week, No.2 U.S. airline Delta Air Lines Inc lowered its guidance, citing slower-than-expected improvement in average fares for flights booked at the last minute.
Shares of American Airlines rose as much as 1.4 percen
