I contacted Nils last night regarding the negative BMXI posts & received this response in less than 5 hours.
"I am familiar with Xxxxxx, his background and motives on this board..I won’t comment on his post other than to say his assumptions and accusations are way off the mark… He clearly has an axe to grind and is neither informed nor concerned about the actual operations and future success of our company.. I would dismiss whatever he says as the sort of venal commentary employed by someone who has negative aspirations for our stock..I will address the oft discussed issue of dilution et al in the upcoming Q&A and look forward to reassuring our community that our business is increasingly well placed and that the audit will settle questions and issues that have been raised by our loyal and supportive shareholders..

How are they going to reduce the A/S by 500M? As of 7/1, the A/S was only 500M. They can't reduce the A/S to zero. What am I missing?
The dividend is safe for now, but the pps keeps dropping even when the market is up. I can't find any news to explain the downtrend.

Why does it keep dropping?
Having been there before; Henry should know the repercussions of being in the grey markets. The tone of his text made it seem like it’s almost inevitable that PHIL is headed in that direction. I’m glad I got out.

He acts as if going to the gray market is just a minor inconvenience. His comment regarding that was the main reason why I sold. He doesn't seem to have a grasp on reality.
Perhaps some people will view what he texted me as positive news, but to me it seemed more like vague answers to serious questions. I debated back & forth whether to sell or not, & reached the decision to sell because I didn't see anything concrete in his answers. There seemed to be no concern over the possibility of going to the gray sheets, & he brushed it off as just a minor inconvenience. Although I finally pinned him down to January to get current, based on his past performance, I wouldn't count on it.
I texted back & forth with Henry on Thursday night, Friday morning Vietnam time. Right or wrong, based on the correspondence, I sold all 215M of my shares on Friday, thus part of the reason for the heavy volume. It took the entire day to sell, but even with no bid, I was able to sell everything. I don't know where the remaining 400M in volume came from. While I believe that Henry is working hard to get things going, his answers to my text were too vague, and made me uncomfortable. I wasn't in a position to risk $21,500, so I decided to sell. Actually, I ended up losing $12,900, as my total purchase price was $34,400. It's very possible that I made a huge mistake, but I simply couldn't take a chance. Below is a word for word copy of the text. Best of luck to everyone who still believes in PHIL & Henry.
Me: Henry ~ I need a more specific update than you’ve provided on your tweet. Shareholders have been kept in the dark way too long. Specifically, since financials have yet to be filed, how do you plan on avoiding delisting, and removal from the OTC to the gray markets? When, specifically, do you expect the new partners to enable you to move forward? Have the new partners addressed the ‘critical requirements’ that you mentioned in your previous text? We need an update with specifics Henry. The time for news is now, not a week or month from now.
Me: Please answer the above as best you can. If you would be forthright with your response, I wouldn’t have to keep pestering you. I’m simply trying to find out where we stand after this latest setback. Thanks.
Henry: Our stock price should rise significantly after we get the funds activated and begin to buy back shares in the open market. However, it may not happen before the end of this year.
Me: Henry, I hear you, but there’s a legitimate concern over PHIL being delisted to the gray sheets if financials aren’t filed. I’m not sure why you keep avoiding this concern, as I’ve seen it happen all too many times. If PHIL goes to the gray sheets, then nothing else matters. Under such a scenario, investors could lose everything. How can you allow this possibility to happen?
Henry: No problem. We’ll complete the audits and get the filings current.
Me: When?
Henry: January
Me: That may be too late. Currently, PHIL does not meet listing requirements. It can be delisted at any time for being delinquent on filing.
Henry: We’ll be fine when we are current with the SEC.
Me: I think we’re going around in circles. The bottom line is that PHIL is not current with the SEC. It can and very well may be delisted before January.
Henry: Even if it goes grey we can always get back on.
Me: Okay
There's a website called Smart Asset that has a capital gains calculator for both federal & state taxes. It will give you a figure for both short & long term capital gains. Total taxes on short term gains can approach 50%, especially if you live in a state that has high taxes, such as New York.
This doesn't exactly tell us anything; it just adds to the confusion.

I did text him regarding delisting, but he didn’t respond.
I texted Henry last night, asking "Is there a problem with the Asia Diamond Exchange? That's what people are saying. Thanks." He responded "No official news out yet but we will announce when it is ready." I don't know how to interpret this, good, bad or unknown.

It’s nice to see you back; I was missing your optimistic posts. Hopefully, your source will continue to provide updates, & more importantly that these updates come to fruition.

Speaking of your source; he/she hasn't mentioned anything new since last week. Everyone is depending on your source to keep us up to date; more frequent updates are needed.
