yeah, no, you are right at least to some degree. I got the capital gains and person income cornfused into the mixture.. and, when ever I dumped this lotto ticket it was to enjoy the lose during that year. the only trades I recall of any consideration,were MM's passing it around for .00009. and it was delisted into the gray sheets.
I don't recall if the actions caused it to be notable as a complete loss including at the same time the issue was raised and captured by the SEC either. and still retain the stock, but,, I also didn't realize it could be deductible while you still own it..
Obviously something to keep in mind during the dumpty dump season.

if you lose 100k on one stock and gain 50k on another you pay no tax . what you are saying is not reality. now on earned income you can write $3k off your earned active income from your passive unearned losses. passive gains and losses are cancelled from each other on a par level ...learn how to read please. i hope you don't do your own taxes.
i would NEVER give a broker my shares, and if the stock came back to life after writing them off you haVE THEM to sell and make it 100% gain and a zero basis. if there is no bid you can write them off imo. you explain that the shares are worthless because they have no recognizable bid or zero bid and therefore you are writing them off. as long as you don't lie you are safe. if the bid comes back and you sell you show the no basis b/c you already wrote them off .completely legal... there is no reason to give your shares to a broker. ridiculous !!

Huh?? whenever you dump a completely dead stock for tax loss to broker,, you're not selling, and in some cases the broker might charge ay 10 bucks or so.. The broker takes them off your hands, and you get nothing. And for all I know they just might hang on to them forever in storage waiting for another run, LOL.
The value is using the loss against your unearned taxable income.. Albeit, depending on how you're holding them because, if personal the feds only let you deduct small amounts each year. 'I think it's up to $3,000 per year limit, every loss from any or all stocks combined $3,000 per year and you have to spread out anything higher over 5 years or so. "I know yeah, That's BS!" Some people use a small corporation to retain their stock trades, and it's costly but gives the benefit of using higher amounts against earnings. Then again 'who's actually planning for losses?' LOL!

The complaint alleges that Calmes, Rowntree, and Shulman devised a scheme to illegally sell large amounts of stock of small companies after they had arranged for the companies' shares to be publicly quoted. According to the complaint, these illegal stock distributions were often facilitated by baseless legal opinion letters written by Pratt and in some cases by fraudulent wash trades by Rowntree. The complaint further alleges that Calmes and Shulman took control of Younger America, one of the companies they had helped become publicly quoted, and disseminated false information to facilitate illegal sales of its stock by themselves and others. According to the complaint, many of Shulman's illegal sales were made through accounts held by his wife, Krystal A. Becnel, who is named in the Commission's complaint as a relief defendant.
The Commission's complaint alleges that Calmes, Rowntree, and Shulman violated the antifraud provisions of the securities laws contained in Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder, and that all of the defendants violated the registration provisions contained in Sections 5(a) and 5(c) of the Securities Act of 1933. The Commission seeks officer and director bars against Calmes and Shulman, penny stock bars against Calmes, Rowntree, Shulman, and Pratt, and disgorgement, plus prejudgment interest, and civil penalties against all of the defendants.
