Lydian Armenia plans to restart operation at Amulsar

Lydian Armenia has posted on its Facebook page a statement stating that the news about its operation and the Amulsar project are inaccurate.
In its statement, the company states that lawyer-activist Nazeli Vardanyan has told deputies of the National Assembly that “…the Amulsar mine will probably be zeroed in their [Lydian Armenia’s] balance” during a session of the committee leading a probe into the lawfulness, substantiation and reliability of financial and other reports presented to and accepted by the government within the scope of investment projects in the field of metallic mining industry.
Lydian Armenia states that the Amulsar project remains the 100% ownership of Lydian Armenia, the company still possesses all rights for exploitation of the mine and plans to resume activities at Amulsar to end construction of the mine. It also reminds that just a day ago, the first instance court of Armenia viewed Nazeli Vardanyan’s previous statements on Lydian Armenia as slander and obliged her to refute them.
The company states that its lawyers will consider the appropriateness of filing another lawsuit against Nazeli Vardanyan since the latter continues to disseminate misinformation and make illogical statements, misleading the public.

The participants of the open discussion on Amulsar held in Jermuk on December 15 unanimously rejected the police request to clear the roads leading to the Amulsar Gold Mine so that Lydian Armenia Company, owners of the property in Amulsar can assess it. The participants agreed that Lydian Armenia should not be allowed to enter Amulsar area, and stated that the roads will never be opened. Local and federal officials did not oppose their statements.

Opposition MP: Public perception of corruption level still very high in Armenia
"The corruption commission should do everything possible to prevent corruption, rather than wait for anyone to get involved in a corruption scheme and then catch them," Edmon Marukyan, a lawmaker from the opposition Bright Armenia faction, told reporters in the parliament on Tuesday, referring to Haykuhi Harutyunyan's appointment as chairperson of the Commission on Prevention of Corruption.
Harutyunyan's candidacy for the post had been nominated by the Bright Armenia faction.
Marukyan stressed the need to first and foremost get rid of the "widespread" corrupt system to clear the system of public administration and the economy of such “infection”.
"We had a different version of judges' vetting, but the burden was put on the shoulder of the commission. I hope that everything possible will be done in that direction," he said.
Marukyan disagreed with Prime Minister Nikol Pashinyan’s claim that corruption has been rooted out in Armenia. “There is always corruption. Public perception of the corruption level is still very high, but there is no coordinated corruption in Armenia. Today there is corruption at lower levels,” he said.

On March 11, 2019, Lydian International Limited notified the Government of Armenia that under the Agreement between the Government of Canada and the Government of Armenia for the Promotion and Protection of Investments, in force since March 29, 1999 (the “Canada BIT”), respectively, that Lydian will consider going to arbitration if Armenia does not remove the blockade as well as pay compensation for the expenses and problems related to the blockade.
According to the BIT process, if Armenia has not responded favorably withing three months, Lydian can institute arbitration.
It has now been over three months, but Lydian, so far has not instituted arbitration. They are still trying to see if they can get the blockades removed, plus receive monetary compensation from the Armenia government.
If they do end up seeking arbitration, the process can take over a year to reach a conclusion.
As an example of an outcome:
Bilateral investment arbitration concerning RTB Bor, a copper mining and smelting company in which the Republic of Serbia took over the mine. The arbitration ruled in favor of the mining company. The company asked for USD 100 million for breaches of the foreign investors’ standards of treatment under the 1997 Greece-Yugoslavia Bilateral Investment Treaty (the “BIT”).
The court awarded the company $40 million, basing its award on what it calculated the company would have been due at the time that its mine was confiscated. This is the normal practice of the arbitration court. Companies suing a country only get a fraction of what they are asking. However, as in this case, the court ordered Serbia to pay USD 40 million, including interest.
The ruling can not be contested by either side.
Over the years I've noticed that mining companies usually receive less than half of what they are asking. However, the court usually does rule in their favor.
Even 40% of what we are asking would-be multiples higher than our present stock price. On the other hand, if a company does instigate arbitration and they lose, they can not contest the decision.
On the other hand (now includes both hands, you've got to hand it to me), people seem to be coming to the conclusion that the company is eventually going to win this battle. It's stock price has been climbing for the last week, after hitting a lowly low.

While the Armenian government is defying its own courts order to allow Lydian to construct its mine, Lydian is waiting to see what settlement it gets from the BIT arbitration it previously initiated. That is a slow slow process, and takes several years, but now that time scale is down to about a year +/-. Armenia had their chance to do the right thing. they chose the worst option - try to destroy the company....well we will see how that works out for them. $2 Billion settlement is theoretically possible, but the arbitrators in many cases only give half, or even less, of the actual worth of a mining property, say $750 million. Its ruling is final. There are no appeals by the company or the country. If the country does not pay up, Lydian can seize government owned assets. Just a matter of time, say 12 - 14 months or less.
Tribunal at the Additional Facility (AF) of the International Centre for Settlement of Investment Disputes (ICSID) arbitrates a bilateral investment treaty (BIT) between a company and a country.

Ruling bloc lawmakers meet anti-Amulsar protesters

Deputy Speaker of Parliament Lena Nazaryan, together with fellow party members from the ruling My Step bloc Mary Galstyan, Maria Karapetyan, Varazdat Karapetyan and Mikayel Zolyan have met with a group of residents from the towns of Jermuk, Gndevaz and Kechut who are protesting against a possible re-launch of the Amulsar mine operations and are keeping the roads leading to the site blocked.
“We discussed the existing situation, the government’s implemented and ongoing actions, we exchanged ideas regarding possible ways of solution, were informed about the resident’s questions, concerns and problems, which we will discuss with our colleagues in the government. The meetings will be continuous,” Nazaryan stated.
While discussions proceed, the road blocks will stay in place.
Interesting, court has ruled, "The Court also found that Mr. Grigoryan had been actively involved in anti-Amulsar activities prior to his appointment as the Head of the Inspection Body, which raised reasonable doubts on his objectivity."

TORONTO, Oct. 17, 2019 (GLOBE NEWSWIRE) -- Lydian International Limited (TSX:LYD) (“Lydian” or the “Company”) is pleased to announce that the Administrative Court of Armenia ruled on October 15th in favor of Lydian Armenia, a subsidiary of Lydian, and upheld the Company’s appeal against a Directive of Armenia’s Environmental and Mining Inspection Body (Inspection Body), dated August 27, 2018 preventing any mining related activities at the Amulsar Project (Directive 30-A).
Mr. Artur Grigoryan, former Head of the Inspection Body, directed the Company on August 27, 2018 to refrain from any mining-related activities until the Ministry of Nature Protection conducted a study of ‘new found ecological factors’ alleged by Mr. Grigoryan to have been identified at the Amulsar Project for the first time.
The Administrative Court of Armenia established that the existence of the alleged ecological factors had not been substantiated after independent investigation. The Court also found that Mr. Grigoryan had been actively involved in anti-Amulsar activities prior to his appointment as the Head of the Inspection Body, which raised reasonable doubts on his objectivity. The Court ruled that Mr. Grigoryan failed to recuse himself from considering the matter when required to do so and declared Directive 30-A invalid.

Lydian HAS BEEN A GOOD NEIGHBOR! People must know that. Lydian has done multiple environmental studies and has made sure that their mine will not harm the environment. The mine will mean good paying jobs for the local population.
The strike and blockage of the mine is being done by people that have a fake ideology. People that don't care for the local inhabitants. Hopefully the local and Federal government will eventually decide to back Lydian up.
As most people know, Lydian International had a mining concession in Armenia with reserves of 2.6 million troy ounces of gold.
The economic studies for the mine were completed, the necessary permits were obtained, the project financing was secured and the mine construction was well underway, with first gold pour and commercial production expected in second quarter of 2018. However, in the late spring of 2018, a new government took over. Natives throughout the country started blocking and attacking mines, including Lydian.
Even though the new government and courts say that the blocking of the roads to the mine by the native people is illegal, the government and the courts are refusing to have the road blocks removed.
Looks like they are just mouthing off platitudes and are in reality not only not planning on doing anything to stop the blockade, they are for the blockade and want Lydian to go bankrupt and leave.
The government can then take over the mine site and develop the mine for themselves, knowing that Lydian did all the work and spent all the money drilling and locating the ore, and getting the site ready for the mine.
Just another third world country confiscating a mine.
It's looking like we are going to be able to build our mine. Our price should advance as that becomes clear.

TORONTO, Sept. 09, 2019 (GLOBE NEWSWIRE) -- Lydian International Limited (TSX: LYD) (“Lydian” or the “Company”) announced today that during a live Facebook broadcast, Prime Minister Nikol Pashinyan, of the Republic of Armenia stated that access to the Amulsar Project site should be restored and the protesters blocking access should open the roads.
The Prime Minister also stated that there is no legal basis on which the Government of Armenia can prevent Lydian from advancing the Amulsar Project in accordance with permits based on an existing Environmental Impact Assessment (“EIA”) or require an additional EIA regarding the Amulsar Project at this time. The Prime Minister noted that Lydian had affirmed expressly that it would comply with its EIA performance standards and then stated that stopping the Amulsar Project on environmental grounds would clearly illustrate a discriminatory approach regarding Lydian and not enhance Armenia’s ability to attract foreign investment.
The Prime Minister further stated that the Government’s Mining and Environmental Inspection Body will conduct an inspection to ensure that Lydian is complying with its permits, including that no changes have been made to the Project unless permitted under the EIA. The duration of the inspection could be as short as 30 days or longer depending on what is discovered.

I have owned shares of Lydian International Limited since before the illegal blocking of their mine. At prices of course, much higher than now.
By a report just released, it looks like the illegal blockage of the mine is not a spontaneous even, but that groups are paying people to oppose the mine, and that the agency that has insisted on three, three unnecessary environmental audits, are part of the paid perpetrators. Since the government agrees that there is no reason for the mine not to proceed, but refuses to do anything to stop the illegal blockage of access to the mine, ummm?
And now the UK government is being pressured to force Lydian to close the mine. ...
