I'm not sure I agree. My understanding is that Apple already asked the Appeals court to step in and they declined to. The only other step I can see is Apple asking SCOTUS to step in, but I doubt very strongly they would grant cert. Would these "Mangrove IPRs" be a different issue that wasn't part of Apple's ask of the Appeals court back in February? There's a lot of issues and suits going on here: I read an interview with one of the attorneys for VHC that patent validity issues were somehow estopped, so why would the issues re: IPRs even matter for the purpose of this case?

Patent originally applied for in 2007. This suggests to me that their technology is still state of the art.

Excellent points. After reading the Prospectus from a few months back and last quarterly filing, I believe M&A is more likely than them trying to go it alone.
