Whatever the outcome, it will be favorable to get it done and over with, although I'm leaning on the outcome being good for BYOC, as that is what it appears this far... but it is a jury trial, nonetheless.
There's a motion to dismiss the smaller case, see what happens on the 7th for that one.
Other new docs uploaded in the main case and says what I have been saying for awhile, she committed fraud and thought she was entitled, even though she didn't own the company anymore. But this is, of course, coming from the defense side, but things add up and in conjunction from what I've heard in the past.
OTC still is shit as a whole, so wait and see for everyone anyways.

My contention is that retail has an expectation that 10 consecutive days or delisted, in another words, this is a scare tactic.

Well, from what I recall, the plaintiff is on 3rd summary judgement request to the judge, cause the 1st & 2nd have been denied.
There is a motion hearing end of this month.
After my homework this weekend in the new documents in the lawsuit, I think there will be a "meet in the middle" settlement where BYOC will be required to pay something towards what is owed Jean.
In this contractual case that they say BYOC breached and BYOC didn't purchase S800 from the get-go, Jean signed the contract for a Promissory note due Feb 2022 for the remaining balance. She signed it, so what did BYOC breach in the contract other that Promissory note went past due?
Then Jean left the company in bad shape and stole from it after it was sold and committed fraud because Geordan was young and she could scare him into getting her company back. Then she sued them to further put pressure on them and the company.
BYOC won't pay shit until lawsuit solved.

In any case, let's see how this plays out, imo, positive or negative, finalization of the lawsuit is a catalyst.
Look at every timeframe on the charts, accumulation is in positive territory... where's the dilution as well? Huge climb and accumulation here in BYOC from fall 2021.
Mind you, it's been disgusting the dilution. but how many other companies listed on the otc/ big board/ and other markets have diluted big time to raise cheap cash in this market that our government poured money into and created new traders ingeniously to where money flowed into the stock market? And Now it's more expensive to get funding with what the government is doing. A lot of companies unfortunately diluted. But coming out of this pending recession, oh baby on how this market is going to change for the better. Good companies have minimal debt and sitting on cash will be well placed in the future and more profitable market. 20 year cycles... oh yeah baby.

Keep in mind, what she is sueing for is what is technically still on the books, it's on every 10k/Q. Its written in the damn lawsuit, obviously sense it's contractual so hard to dispute... but as you just stated....
You are correct on the scammy fraud part of Jean's part...she was the owner that founded S800 and from what I understood, mismanaged it and guess what, used the business while she owned it to benefit herself... as the owner. Then when ownership transferred, she still did things that costed extra expenses and perhaps this was not disclosed/ found during the due diligence by George, trusted her or whatever. So Jean's fraud continued and Geordan and team discovered it and cut her off. What else would she do but to sue for what's owed to her and in a contract, plus some extra $ for good measure. Again, as the owner, you use the business for deductions from expenses and benefit yourself from a tax perspective while business takes on the loss in the end... what owner doesn't, our tax laws have this built in that way! How this wasn't caught by George and team, who knows.
My understanding the financials were found to be worse than expected after BYOC took S800 over and Geordan made needed cuts and cleanup. Financials have improved these past years in both entities. Just now we have Discover, which I believe is done and price action and monthly otc updates show this as well... then there's this lawsuit, which part of the negative past, which I would like imagine Geordan and team want to finally put to rest.
So some of this is my speculation, some from what I heard, etc. Who the hell knows, I'm sure many many as you say want an exit out of this. Will see I guess

Yep, that's the article, along with another one I found, talking about Discover terms of contract as being "ironclad"!
I've been following, but not invested in CEI, and the dilution has been horrendous for investors. Appears that company is finally moving away from some of this dilution or getting it completed, but Discover seems to be always there on all the stocks they're involved with.
Imo, for BYOC, Discover has what they have, and dilution IS done. There was a filing last fall from Discover indicating they had 4.99% of OS.
Will see how this plays out in 2023, with everything.

I also agree that with the idea that once the FED starts easing on the rates, which might not happen for awhile, we'll see better action in the markets. Although historically, a correction in the overall markets helps bring volume to the OTC, so those entities can make some money any way they can.
Also, I like that 5 year chart as it relates to now and ultimately a correction in OTC. Look at the trend starting 2015, it could turn the corner in a big way or continue a slow trend, but still up i believe. Will patiently wait, I guess.

But my point is that this was called a mistrial when things were on the plaintiffs side of the story, not the defense. Tells me the judge thinks the plaintiff side needs to get her shit straight or as you say, this gets tossed out/ dismissed in BYOC favor. So far, that makes sense and a reason why her lawyer withdrew.
Also, why aren't BYOCs lawyers not available until well into May 23. That's very curious.
Hopefully they are bringing this to light, to light a fire and to show her they mean business, to get this resolved sooner! Seems to be the case, imo

Case in point....
Defendants have learned that Bredeson continues to contact Service 800 clients and
vendors and even former employees, without providing those communications in discovery. This
came up most recently when a former Service 800 consultant indicated he would seek a
restraining order if Bredeson continued to contact him. It is unclear if these are attempts by
Bredeson to obtain additional witnesses to testify on her behalf at the next trial or if Bredeson is
attempting to make this whole ordeal so unpalatable to potential Service 800 witnesses that they
do not want to come to trial and testify, but Defendants respectfully ask that the Court require
that all supplementation by both sides be completed on or before December 31, 2022,
That was earlier in the year or last year, I do believe. I'd have to go back. There was 166 million added to OS in between those 2 increases, which might be Peter's
In March and September the OS increases are as follows:
2022-03-22 - 791,800,000
2022-09-08 - 791,750,000
Total that up is 1,583,550,000.
So even though it said converting at the average of the last few trading days, it's uncanny that 1.5 million converted at the par value of .001, plus including interest equals that perfectly.
Without proof shown in a 10Q, we can only speculate.

Who knows why a mistrial, could be all sorts of things. It's almost as if it was a mistrial because there wasn't anything that actually needed a trial for and both parties need to review their evidence and litigation.
Remember, this document is from the plaintiffs council and does not constitute the defenses communication to the judge.

Mis-trial. That is what it says, and defense council earliest date is May 2023... so why are they not available until then?
Plaintiff is seeking a summary Judgement for what is still owed anyway.
My recommendation would be for defense to counter sue Ms. Bredeson for the stealing she has done.

It may only been 4 hours a day for the case, as 1 of the days it had 2 start times, 9am and 1:30 pm. Most days only at 9... it's a guess. I agree it took extra long.
I also guess is the plaintiff took extra time and added crap to prolong this case for her goal of scamming BYOC out of something that she no longer owned, again this is based on what has been divulged in the case documents already... can't wait for the rest, hopefully favorable.
A fellow long alerted me that Geordan posted an EV article on LinkedIn today, so he must have some extra time available away from the lawsuit and it's another post about EV, so a little comfort of what's to come potentially going forward.
The 2nd lawsuit deals with another way that Jean, the former owner of S800, used to con her way into getting money out of BYOC and to pressure Geordan and team to get her company back.
This lawsuit has GREEN VALLEY ASSOCIATES, INC as the plaintiff, which is owned entirely by Jean. As outlined in case #1, it deals with her blackmailing S800 to use her residence as a headquarters or something like that, where she didn't have authority to make a contract on S800's behalf in the first place.

I also believe this woman was stealing from her own company for many many years before BYOC purchased it, for her own benefit, tax purposes, etc. Maybe she felt entitled to continue to steal from the company... then take advantage of Geordan and the BYOC team after Georges sudden death... I surmise they saw the shenanigans and put and end to her robbing from the business... which led to Jean sueing BYOC as revenge, get S800 back, or whatever. You can see from the "motions in limine" throwing some of the litigation out of the case, she went to the extreme to get as much crap against them as possible.
There is no doubt in my mind after owning it for 30 years and seeing what is in this litigation, Jean also sabotaged S800 from growth, business ventures with existing customers, disrupted supply base, etc. I'm willing to bet she succeeded in many or all of these actions.
Hopefully judge sees this as well, and BYOC can come out of this with minor bumps and bruises, and company can wash it's hands from this bitch once and forever.
I have myself surmised this, but here in America you have sarbanes oxley and having financials PCAOB audited or at least suppose to be set up in order to be audited to that standard, so that kinda blows that theory out the water. But I definitely like and have thought that myself, in some way.
But as someone we all know well here, things are not always as they seem in the OTC or as regulated.
Let's hope the judge is on BYOCs side of things and is looking to end this lawsuit.
Perhaps BYOC feels they have sufficient evidence to not have to counter sue and waste more time. They may want to move on with other things such as Electric Built, and this is hindering that.
As for the 2nd litigation with that new document... that likely hinders on the outcome of the current one, as it deals with Jean making a decision that she shouldn't have made since she didn't own S800 anymore.
Hopefully we get some outcome this week, whether Good or bad. We definitely agree she is out to make this as painful and drawn out as she can, for whatever reason or to hinder future growth.

But It also just feels like the judge also sees thru her BS and is ending it, one way or another.
