While I'm not a fan, I'm not sure that's true. OTC Markets went through a bad patch in which it moved a few dozen stocks from the Greys to Unsolicited. TVCE was done earlier than most, but not all.

I eventually called and asked about it. They realized their mistake--the stocks should have been moved to the Expert Market, which is just the Greys with electronic execution--and fixed it.

Imo JC is the one who got this trading unsolicited solely to dump his shares on the unsuspecting by creating hype on the board. I'm sure he did very well. After he was finished it went back to grays, leaving most here holding the bag.

this is an ongoing saga. the sec is proposing rule changes to uele 15c-211. judging by otcm's comment letters, they are opposed to certain elements and it seems like some of their recent actions are trying to prove their points. eventually this will be worked out.

Of course OTC M would never compensate those who were suckered into this fack up. But FINRA or the SEC could or should take them to task. As their mistake was the only reason this ran.

Exactly, but that is what they DID do. When the mistake was brought to their attention, they fixed it. But in the case of some issuers, of which TVCE was one, the stocks traded on an unsolicited basis, with published quotations, for some time.

Janice already provided very good information on what happened and the implications of unsolicited quoting.

This traded for a couple weeks as Pink. It traded as unsolicited. It was not labeled as trading unsolicited as that policy has apparently changed at OTCM. It shouldn’t have gone Pink but OTCM did just that. Once they were asked why and questioned, they quickly back tracked.

No Form 211 involved.


My point is because it was OTCM's screw up, a lot of people lost money assuming certain criteria was met. imo, they are liable for that in some way. The average investor would have difficulty seeing that it was a screw up on OTCM's part. It had nothing to do with a "billionaire" or statements from the company. It is all on OTCM.

no, they can not move tiers other than from grey to the so called "expert" market. in order to move to the pinks the company would have to find a sponsoring market maker to submit a form 211 to finra. if that form 211 became effective then finra would show the change to pink on the daily list. otcm has nothing to do with it.

They aren’t regulatory. Correct.

They can however move tickers between venues that provide more liquidity. Also, they have policies that imply certain conditions were met to make those moves. If you make the venue move, average investors assume OTCM followed their own policies and certain criteria was met. Some of the documentation needed to meet that criteria is not readily available to the public. There in lies the problem.

otcm is not a regulatory agency. they have no power to stop trading. the skull and crossbones is all they can do. people ignore that at their own peril.

This still has nothing to do with a “billionaire”.

Chasing a “billionaire” is not a substitute for doing your own DD. He can be had like anybody else.

It’s easy to turn 25% - 50% profit on hyped tickers that are running. Unfortunately, a lot of OTC investors think they found the next big one and have FOMO, trying to wait for 100%+. 99% of the tickers just crash right back down the next day.

Perhaps buy back the shares of those that were misled into buying? Buying what a supposed BILLIONAIRE was buying as well because he must be in the know?
Some learned an expensive lesson with COWP AND COWPP suspension. Fortunately.
Maybe they could post what they are holding and you can buy them back given your desire to own the float?
They aren’t BILLIONAIRES. They are hard working people with house payments and families to feed. Ever think about that?

As has now been proven, there was never a Form 2-11 filed.

There is zero chance this will get off the grey market, as it was incorrectly moved to the pinks. More importantly, it was relegated to the grey market years ago, when it was suspended by the SEC. It can not return to quoted trading unless and until a MM files a Form 2-11, pursuant to Rule 15c2-11. As this company is long gone, that will never happen.

I was right that no MM had filed a Form 2-11, which meant that OTC M had screwed up by allowing it to be quoted.

Nice that early traders might have made some coin, but there's lots of bagholders that have every right to be pissed off.
