a continuing investigation can take up to 5 years. ( the statute of limitations.) if the sec decides to bring what is called a "continuing enforcement action", they can sue civilly for disgorgement of ill gotten gains, fines, and or officer bans. if the sec feels criminal laws were broken, they can send their info to the justice department for possible criminal prosecution. for now, being relegated to the grey market is a substantial penalty.
