The lawsuit is being investigated by the Sixth Anti-Corruption Prosecutor's Office and was suspended since February 4, after a Coclé guarantor judge accepted a request from Fifer's lawyers to reach settlement with the CSS.
Fifer has been unable to leave the country since August 2016.

it is more easy as you think, the Company Petaquilla is - if the mine is open - the carrier of the mine because they have the license for exploitation than (in this case from Panama Government), so they can also give this license to an sub-Corporation for example. The owner of Petaquilla shares stay as owner. Petaquilla shares are currently not tradeable, only out of stock market. But if Petaquilla rise of ash..., the shares are will be back very soon on stage! Because Petaquilla and his biggest sharehoulders, for sure will come back on normal stock market! That is the pressure of big Money.
I wish I could give you a solid answer, but I can't. I know I hold an empty bag. If PTQ rises from the ashes I have no idea what happens to the previous bagholders. Maybe someone else could answer this question ?

You are welcome Snirre but I am only posting what I read. This mine would have done well if a) the country as a whole was not corrupt...and secondly....b) to make it worse, the guys running the company were also corrupt. Go figure. We got it two fold up the butt.

The way the article read is that something has been worked out but the details have not yet been released.
As for the mine and the fate of PTQ....who the hell knows. There was an article stating that they wanted to revive the mine but your guess is as good as mine if that actually happens. And if it does, which company will do it ? Will PTQ rise out of the ashes ?

Prosecutor asks 7 years jail for ex-governor

MOVES BY lawyers for former Coclé Governor Richard Fifer to evade trial were rejected on Wednesday September 14, and the prosecutor is calling for a seven year sentence.

Judge María Isabel Pedreshi set the trial for Nov. 29.
Sixth Anti-Corruption Prosecutor Aurelio Vásquez has requested a sentence of seven years, and asked the judge to continue the order for Fifer to remain in the country.
Vásquez said there are 24 witnesses in the case and a substantial amount of records that will be introduced into evidence.
Defense attorneys presented two motions, one to dismiss the charge and another to suspend the hearing.
The lawyers made the argument that Fifer was not the head of the company when the payments were supposed to be made, which was October 2013 to January 2015.
Lawyer Tomás Gondola said that the defendant was seeking a suspension in the case so he could arrange payments to Social Security.
Representatives of Social Security testified at the hearing that no arrangements for repayment have been made by Fifer.
Both motions were rejected.

The Social Security Fund (CSS) announced yesterday at a press conference that there is a payment arrangement with companies Petaquilla Gold, S.A., Panama and Infrastructure Development, S.A., whose president and legal representative is the entrepreneur Richard Fifer.
The Sixth Anticorruption Prosecutor investigates Fifer for allegedly withholding employers contribution, process that had been detained since last February at the headquarters of the National Police in the capital.

The former governor of the province of Cocle and president of companies Petaquilla Gold, S.A. and Panama Infrastructure Development, Richard Fifer, asked the Social Security Fund (CSS) the exact amount that both companies owed in respect of the workers' share employer, for which follows a judicial process that keeps him under preventive detention.

Fifer remains detained since last February by orders of the prosecutor sixth Anticorruption Aurelio Vasquez, who followed a process for the alleged illegal detention of employers contribution through these companies.
In his note, Fifer says it was not until last June 27 when he was informed for the first time, what forms of payment of such debt would be, so it has decided to accept the payment proposal, but that financial institutions and banking will require the exact amount of debt to cash in financing a loan to pay this commitment.
Notes that "it is worrying that in the absence of the amount of the debt, we keep in custody for an offense because of it not warranted and that this situation is detrimental to the workers themselves who are not contributing and that it undermines the very legal safety of employees and the companies I represent. "
Meanwhile, the director of the CSS, Estivenson Giron, Fifer said yesterday that it has is to "pay" their debt. "I have understood that he knows what you owe, and our address Revenue has certified him his debt," he added.
According Giron, Fifer owes approximately $ 6 million.

Escorted by two agents of the Directorate of Judicial Investigation (DIJ) and carrying a black bag on his hands, covering his wives, entered yesterday the Court of Guarantees of Cocle, Richard Fifer, former governor of the province, to face the intermediate hearing for the alleged withholding of worker-employer contributions to the Social Security Fund (CSS) of companies Petaquilla Gold, for $ 3 million 199 thousand, and Panama Infrastructure Development (PDI), for $ 3 million 331 thousand.
By the Attorney General Anticorruption prosecutor sixth, Aurelio Vasquez, and a group of workers was mentioned companies.
At 9:12 am, the investigating judge, Albelys Herrera, opened the hearing and asked the parties to identify themselves: first did the prosecutor Vásquez, then the attorney CSS, Humberto Ledezma, and then Fifer, who he had no legal representative.

Looks like the thief (Fifer) is trying to pass the buck off to someone else (Esquivel). He's nothing more than a common snitch that will throw anyone under the bus to protect his ass.

The intermediate hearing to be held on Monday July 11, 2016, Richard Fifer, entrepreneur and legal representative of Petaquilla Gold, was postponed until next August 4.
The rescheduling of the hearing date is given in the context of the resignation of the attorney Fifer and notification to the authorities, a new lawyer handling the case of the employer.
Fifer is summoned to the audiciencia due to the process followed by illegal withholding of dues Social Security Fund (CSS), in the amount of $ 3.1 million.
The information was confirmed by people close to the defense of the president of the mining.
Fifer remains detained in Panama City, but the hearing will be held in Penonomé, under the accusatory penal system (SPA).
In this case, the employer has repeatedly stated that it was not the legal representative of the mine in the period in which they stopped paying dues, August 2013 to September 2014; and then the company was in charge of Rodrigo Esquivel.
This media learned that the CSS agreed to review the last six forms of September 2014, attributed to the employer, and are subject to judicial investigation.

Petaquilla Minerals Ltd is a growing, diversified gold producer committed to maximizing shareholder value through a strategy of efficient production, targeted exploration and selected acquisitions. The Company operates a surface gold processing plant at its Molejon Gold Project, located in the south central area of its 100% owned 842 square kilometre concession lands in Panama - a region known historically for gold content. Petaquilla Minerals Ltd. ("PTQ") intends to distribute to its shareholders one share of Panama Development and Infrastructure Ltd. ("PDI") for each four shares of PTQ held on the record date for the distribution. Distribution of PDI will be effected by way of a Plan of Arrangement or some other tax-efficient mechanism. Transaction is subject to all requisite shareholder and regulatory approvals. Petaquilla Minerals expects to announce the record date for PDI spin-out by the end of the year.

Molejon Resource estimates
Based on the pre-feasibility level design work completed and reviewed, the authors believe there are approximately 15.3 Mt of gold and silver reserves that can be produced averaging 1.30 g/t gold and 2.05 g/t silver and recovering approximately 586,000 ounces of gold and 711,792 ounces of silver. In addition, the pit contains 36.8 Mt of aggregate reserves which should yield approximately 29.4 Mt of saleable aggregate products after crushing and screening. Behre Dolbear believes that the mine will be able to produce the projected 643,000 ounces of gold and 1,008,693 ounces of silver.

Forward Gold Purchase Agreement
On September 22, 2010, the Company entered into a Forward Gold Purchase Agreement ("the Agreement") with Deutsche Bank, AG ("Deutsche Bank"), in an amount of $45,000,000. Under the terms of the Agreement, the Company has sold to Duetsche Bank, a Contract Quantity of Gold being 66,650 ounces.
In addition, should the gold price be in excess of $875 per ounce, the Company will receive from Deutsche Bank, an additional gold payment amount equal to the product of the monthly quantity of gold delivered in that month and the amount by which the gold price exceeds $875 per ounce, limited to $415 per ounce.

Panama Project
The project area is located in the District of Donoso, Province of Colon, approximately 100 kilometers west of the Panama Canal on the Caribbean Coast. Petaquilla Minerals' land holdings are situated in the perfect position to ship concentrate at low cost to Europe, Asia, and North America.
The combined project area comprises 795 sq km on tide line. The plant site and open pit is serviced by a new road built to a 70-tonne specification.
Project tenure is secured by 'Ley Petaquilla', a project specific mining law that gives the two companies secure ownership, in three renewable phases, for a total of sixty years.

Petaquilla Portugal Project
Almada Mining SA in Portugal.
Almada Mining SA is located in Portugal and is 100% owned by Petaquilla Mineral.
The Bania mine is on 5.12 km2 land and the total exploration rights area of the Banias project is 117km2.
This area was mined during the Roman empire. No resource estimate has been done but samples from the mine yielded as much as 523gr of gold per ton. Of course the average will be a lot lower than that (around 5 to 10 g/t) but most of it is "free" gold so no need for a mill. A bunch of shaking tables will do it.
18 holes over 5,000 meters are being drilled to get a resource estimate.
The mine is approved for a trial period of 150,000 tons a year for 3 years. Yes, get you calculator and use 10gr per ton just for fun.
Capex is about $5M and the mine could be in production 9 to 12 months from now. One nice thing is that there is no need to dewater the mine.
The company has another project in Portugal it is the Jales project 120km away. I do not have a lot of data about that one. Bania is the one to concentrate on right now.
