One thing we need to remember is a move to Naz would require a board in place, and a move to Naz would open the stock up to the hedge funds that could short it and manipulate even worst than its being right now IMHO. That being said it maybe able to handle that given the position its in right now with SKH.
Unfortunately unless the venue is moved to a state that isn't deep blue, Google and the others have the time, money and resources to drag this out forever.
That is why NLST needs to move on with business at hand (upgrading to Nasdaq) and not rely on the litigations so much.
Then if there is finally a verdict that would be icing on the cake. This company is strong enough to stand on it's own.
And, you are correct about reaping the benefits while we are still young(?).
Agreed, unfortunately, as we know from some other ones you and I have been involved in, the legal system in this country is very inefficient both in quality and timeliness. It seems commonplace for slam dunk cases to get thrown out on technical nonsense or delay after delay with ease on the opposition's side. Hopefully NLST gets through this hurdle soon and really open up the throttle on the way up. A move to the NAS would be very big for the share price, but LT holders have a lot more to gain after that.
Just wish the process could be speeded along. Nobody's getting any younger.
I'm not to worried about exposure on NLST. That will take care of itself - the main hurdle is getting through these lawsuits and getting legal recognition at a broader level. Their product is currently unmatched and in high demand which gives their earning power limitless potential at the moment once companies stop stealing their product without paying for it.

I agree completely. But, there are only a handful of companies that prosper on the OTC (l'oreal, Unilever, Nestle.....). These are a known commodity. People buy their products every day. Not so with NLST. NLST needs more exposure on the big board.
In response to Jimmy Joe....I'm glad that Chuck is content to be on the OTC living the good life waiting another 100 years for the litigations, but both can be done. Yes, strange but true, NLST can uplist and still continue the lawsuits.
NLST has real potential even on the OTC. The Naz just gives it that much more upside and more importantly STAYING POWER. People who are optimistic about this company (as easy as it is to be optimistic here) should be grateful that continue to get buying opps at these prices. I'm becoming very leveraged on this company which is normally a no-no, but this is a grand opportunity considering the position of NLST in it's market and potential windfalls from pending lawsuits.
Google deserves nothing, they would be paying for it. As for the right price, that is for the people that have privy to the books to figure out. Until NLST upgrades, nobody is really going to see all of the discovery irons in the fire~. No matter how many irons are there, until some major deals are made NLST will be an OTC stock spinning it's hot irons~.
Chuck does not want to do that right now. He's content just being on the OTC for now.

I still don't understand why it would be such a bad thing to be bought out at the right price. Again, at the right price. The settlement with SKH was a good thing. Maybe NLST could have held out for more, but it helped the company go forward. Maybe try and settle for a little less in order to continue to move forward. Sometimes taking a little less now might help reap benefits later. These litigations have been going on forever and will probably continue to go on forever. That may have been a caveat for a start, but to rely on that is silly. NLST needs to move on with their business at hand and if something comes from the litigations, excellent. Don't give up on the litigations, but don't let it control your company. It might take another hundred years until a verdict.
Time to show Wall St what this company is all about and uplist to Nasdaq. The lawsuits will still be there.

Considering the PPS is in the low 3s, maybe Chuck should have settled/partnered with Google sooner and upgraded to Nasdaq. So your comment about NLST/Google doesn't hold weight very well right now. Sometimes it's worth it to settle for a little less in order to be seen by a wider audience and move forward with the excellent products NLST has to offer. Too much relying on litigations with companies that have numerous resources to battle litigations and liberal judges in their back pockets. Time to settle for what they can get and move onward and upwards on their own merits.

No, you misinterpreted. The very least NelList will get are licensing fees with possible royalties.
If they get nothing as in an award for damages how do legal fees out strip licensing/royalty fees~? They don't.
Those licensing fees gathered over a decade will still amount to a couple of $Billion.
All three of these companies colluded against NetList. Look at the EU situation.

Netlist total loss would be getting nothing and having spent tons of more money on legal costs to get to the nothing decision along with not being legally recognized and Google and Samsung continue using their patented tech without consequence or benefit to Netlist.
As stated this is a very unlikely scenario, but nonetheless a scenario. My post clearly states the company is growing rapidly regardless of those court proceedings. Fortunately some of us are realistically optimistic.
NetList cannot take a total loss in any of these cases whether it is Google or Samsung or Micron. Least owed is licensing over years of patent usage.

But of course due to the extreme short pressure on this stock, a little announcement about 1.2 million shares to be registered in reference to employee compensation - the stock price does dwindle.
I would say Netlist does need to do something more with PR in effort to stop the constant bleeding from tough short pressure on this ticker. There hasn't been a whole lot of direction given from the top lately. Only influence on this stock lately has been reaction to delays in court proceedings. Hopefully someone at the decision making level will realize it's important to communicate with shareholders in effort to maintain share price - which obviously matters as they are all shareholders themselves and also compensation packages include shares.
I fail to see downside in this ticker unless they face total loss in the Google suit. NLST has already shown it's potential with the continued YOY growth in revs and profit. They are clearly taking a more dominant position in their market as they are finally recognized legally after the SK Hynix battle. They turned SK Hynix from a enemy to a partner and have only grown tremendously since that partnership began. I think we can all agree Samsung is strung up by the balls right now and Google is on their way to the same position based on the most recent updates. Glad we continue to get these dream prices at a $750 million MC when this thing has upside of $10s of billions over the next 1-2 years.
The share value will plummet over 1.2 million shares when the current AS is 231 million? Lol yikes the feel bad stories in this place are a little dramatic at times.

IRVINE, CA / ACCESSWIRE / August 3, 2022 / Netlist, Inc. (OTCQB:NLST) today announced that the United States District Court for the District of Delaware (the Court) issued an Order granting in part Netlist's motion for dismissing Samsung's First Amended Complaint and denying Samsung's request to file a Second Amended Complaint.

The Court issued a written opinion supporting the Order, and dismissed Samsung's Counts IV, V, VI, VII, X, and XI from the case. The partial dismissal means Samsung cannot pursue a separate action on the patents Netlist first asserted in Texas, and now cannot carry out its alleged obligation to protect Google from the ‘912 Patent in Delaware. In addition, Samsung voluntarily withdrew its Motion to Sever and Stay the case that Netlist brought in the Eastern District of Texas.
Jayson Sohi, Netlist's Director of IP Strategy, said, "We are pleased Judge Andrews dismissed half of the pending claims from Samsung's Delaware lawsuit, including the ‘912 claim. We look forward to continue defending our intellectual property rights in the remaining portion of this case."
Separately, following the Order, Netlist filed a complaint against Samsung in the Eastern District of Texas for Samsung's infringement of the ‘912 Patent.

Okay. And then, Chuck, last question on litigation. A lot of moving parts in several cases. Can you just maybe highlight for us or summarize what some of the key catalysts coming up in the next few months are so we can know what to watch for in all these key cases?
A –Chuck Hong
Yes. I think the Google -- we have currently 3 major cases; Google, Samsung and hynix. And as we stated in the script, Google is currently stayed for a 90-day period, probably another 2.5 months before the case management conference in the Northern District of California. At that point, there will be decisions made and case schedules set out for the Google case because now that the intervening rights has been established, which means we can look backwards on past infringement, there’s obviously a go-forward infringement as well on the part of Google.
But we will get clarity then. I think the Northern District of California judge stayed the case in order to give time for the Delaware case to – for the judge there to take action because Google and Samsung were claiming that their cases are related. And the order, the ruling that came from Judge Andrews of Delaware last night clearly stated that the cases are not related. In fact, he dismissed and threw out all of the claims that Samsung made in relation to the 912 patent, which is at the heart of the action against Google. So that brought a lot of clarity. So I think based on that ruling last night, we will see more clarity out of the Northern District case against Google.
Samsung is on fast track to get to trial in about 9 months. There will be a claim construction, which will set out the key terms of the case, which is usually a very important event in a patent infringement lawsuit, and that will happen in October. So we’re very busy working on that, working on discovery. Right now, that is where bulk of the activity is occurring.
So that’s – in yesterday’s ruling out of Delaware, made also clear that the Samsung case against – the Samsung case in the Eastern District of Texas will remain there and that it has nothing to do with what’s going on in Delaware.
And then lastly, the Micron case has been – the Western District of Texas case has been stayed. However, there is a case now that’s been filed in front of Judge Gilstrap in the Eastern District of Texas, which will – I’m sure we’ll see a case schedule on that in short order.
And then we’ve got action against all 3 parties in Germany, effectively covering most of Europe because this is a European EU patent. And there where – we would be seeking – we are seeking injunctive relief against Micron as well as damages, dollar damages. So a lot going on, and we’re seeing – we’re making steady progress. We’ve got a very good team. I think the patents that we have today that’s being asserted against these 2 parties are probably the best patents that we've ever had.
All three actors are being sued in the EU with Micron as the lead actor. Sammy and Google right there with Micron. German court is much like Andrews in Delaware and Gilstrap in Texas. That according to Chuck in the CC. Courts seem to favor NetList in all litigations.

IR has nothing to do with anything. Chip sector is softening somewhat, but NetList has a better relationship with SK, so take that for what it is. Only getting better.

Discovery continues. Will it be worth it~? Yes, it will.
Is there reason for no BoD~? I think there is, and I'll leave that decision up to Chuck Hong. He's doing pretty darn good IMO.
Samsung patent infringements different from Google. Samsung tried to argue they were the same. Andrews shot that down.
Best advice I can give is to wait for a catalyst to make this pop to $6-$10 again, take profit and reload.
Once the dam breaks it will be lights out for prices this low.

Me too gdog, but I guess "it is what it is" and so it goes with these patent lawsuits. Maybe Netlist will make us all rich someday and it will all be worth it. I again agree with you that we need to be on the Nasdaq. I think going to the big board would take a lot of these stings and bites out of this roller coaster stock.
