$NLST No minutes or orders have been filed from BOC pretrial conference yet. Regardless of what the parties argued for and how they argued... I’m ok with letting them work out issues without diving into the weeds. Mostly interested in the judge’s decisions on pretrial matters and how the trial plays out.
At this point and considering all the pending aspects relying on the outcome, in addition to what we’ve been through on the BOC matter, we just want the result... the rest is trivial. As informative and interesting everything else can be, as it pertains to this case/issue—BOC—only the verdict will suffice for me.
Keep in mind that Netlist can appeal if the judgment/verdict/outcome is adverse. Not sure how much desire there is to watch Samsung attempt to manipulate and misrepresent every aspect to the jury—which will be hard to tolerate and swallow, causing severe frustration—which I don’t plan on entertaining. Perhaps going off the grid till conclusion seems like a wise choice.
Well, fine. I already said I could be mistaken. But - my opinion is that your posts have been thinly veiled in the negative, for the most part. Here is the gist of them:
WRONG!! I have said nothing negative about the company just the timeline to reach the end goal and the PTAB’s invalidated rubber stamp and not wanting to see that negativity highlighted in some chart.

For what its worth my thoughts are the new specialists on USPTO and CAFC matters would not have signed on to fight for netlist if they thought everything was actually legit with there decisions. That leads me to hope there is no chance for samsung and micron to weasel out of all this unless they are paying judges and everybody else under the table. Interesting and exciting times ahead

$NLST To say that our special matters attorney—wrote POP/Director Review request in 912 IPR regarding Real Party in Interest issue, which was granted but later ruled not RPI—and appeal expert Phillip Warrick is connected is an understatement... and ironically, he actually represented the USPTO and its Director in court on appeal cases at the CAFC. If he’s good enough for the USPTO and its Director in cases at the CAFC, he sounds like an astounding pick to represent Netlist at the CAFC for our appeals, along with our other recent CAFC appeal and PTAB specialist hires—one of which was a USPTO patent examiner (Michael Heim) and other is in the top 2% in appeal wins at the CAFC (Blair Silver).

Few changes/developments since 4/26, also reflected Samsung/Micron appeals of PTAB validated patents—will be first CAFC appeal results we get—which should stick considering PTAB’s hindsight obviousness nonsense… safe to say if they could’ve they would’ve invalidated. I would think German case 735 patent invalidity ruling will be appealed as well, perhaps awaiting 660 decision first.
Samsung’s 523 appeal is in late stages—filed July 3/2023—and currently in the process of scheduling Oral Argmnt. Parties provided scheduling conflicts for the first week of the months July-Dec—when CAFC hears cases—Netlist available / Samsung unavailable Aug. Micron’s 314 appeal was filed Dec 29,2023.
Phillip Warrick—big gun from DC/Irell office who has assisted in special matters on certain aspects in Netlist’s litigation—is lead and will argue for Netlist on 523 appeal. I suspect he'll work other appeals with our new appeal specialists. His Bio is impressive! More in next post.

not a dumb question, but all these scumball companies are in bed together so the only time their gonna throw you under the bus is if there gonna get squashed first, and the very next day its business as usual. the ones that use the product you are supplying are the ones that will go with you as long as you can stay valid. if they can get it legally cheaper they will. some companies are crooked and some companies will pay you. sk and nlst are licensed, i hope to God they renue that contract... sorry for the ramble, i'm sleep deprived.............

$NLST Very important Samsung pre-trial today.The guidelines for the trial,and what can and can’t be argued at trial will be decided today starting at 2:00 pm Pacific time.What is very interesting is Michael Yoder is still on the list of lawyers to be present!Could be a clerical error,but worth noting. I wonder if Yoder has made a remarkable recovery like with Covid. I guess we will find out soon if he is present today or just a clerical mistake!

jedec members have taken the piss out of Netlist, kept them at a distance and gutted them
I believe that with the DDR4 Trial a small piece of justice can be achieved for Netlist. (‘537 + ‘912 won an appeal before cafc, after ‘537 …..patent ‘215, ‘314, ‘417 was published)

Durango24k $NLST I thought Michael Heim was fantastic. You could his level of knowledge was superior, not only to Theodore's, but he seemed to have a level of command that even Galligan or Jurgovan had to recognize. I found Michael Heim's explanations easier to understand than that of Theordore's word salad.
Listening to all this, I couldnt help but think that "when it comes to the actual patents, why is it so difficult to establish that a product that uses this particular patent usage, how well would this product designed by the infringers, how well would it work without this patent?" Is it always the default answer of "obviousness". Seems preposterous. I thought Michael Heim explained the differences between JEDEC & Perego quite well.
It's amazing the lengths mankind will go make and protect money. Even the length to design this ridiculous exercise of making a patent owner have to justify the very designs that have advanced a particular industry the way Netlist has.

Stokd $NLST These judges are now in a tough spot thanks to their own doing on the 912 and thanks to our new attorney. He schooled them on the patents, and whichever way they decide the 215 & 417 will carry implications on their prior/recent decision on the 912—being patents are connected. So, if they validate any of these two, they will most likely contradict aspects of their invalidity decision on the 912... and if they invalidate these two they will err and provide more reasons for their 912 decision to be overturned by the CAFC. IMO

Stokd $NLST Samsung's attorney is a one trick pony... when asked to further explain by judges, he just repeats himself at a slower pace, when that doesn't work he goes with misdirection.
It also seem that PTAB judges are desperately looking for any reason to invalidate the patents... when they should be impartial, or at least put in as much effort and desire to prove the patents valid.
They may as well be representing Samsung because they continuously argue on Samsung's behalf... it's obvious and twisted.
But I think they met their match and can't seem to trip up our new attorney who was a former USPTO patent examiner.

Also filed in Micron 294 yesterday was notice that mediation will take place May 8—"On April 26, 2024, the Court entered a sua sponte Order requiring the parties to make additional effort to mediate this case by May 13, 2024. The mediation is currently set to be held in person in Dallas, TX, on May 8"—and due to both parties lead counsel being busy with other engagements, designated backup counsel will act as lead for purposes of mediation, but—"This substitution of lead counsel will in no way diminish the effectiveness of the mediation session for any party, as client representatives with full authority will be present."
"Accordingly, the parties respectfully requests that the Court excuse Mr. Sheasby and Mr. Melsheimer from the mediation and allow Mr. Strabone and Mr. Enzminger to temporarily act as lead counsel for their respective clients at the mediation."
