The argument over the gag order demonstrated that to be the former president*’s lawyer is to enter into his conspiracy against common sense.

Day Two of the New York Trial began with a discussion of whether El Caudillo del Mar-a-Lago violated the gag order dropped upon him by Judge Juan Merchan. In terms of actual reality, in which words mean what they really mean, he tore the gag order to ribbons and dropped the pieces into the East River long ago. But even the most cosmic of liars deserves his day in court, so the forms and procedures must be followed. Which doesn’t mean that the judge’s patience is required to be limitless, or that he is required to follow defense counsel all the way into MAGA Neverland.
The argument over the gag order demonstrated quite convincingly that to be the former president*’s lawyer is to enter into his conspiracy against reality and common sense. It requires you to present arguments that make little or no sense. It requires you to sound like a jackass. It requires you, eventually, to get the judge all honked off at you. From The Guardian:
First off, however, Juan Merchan heard arguments about a request from prosecutors to hold Trump in contempt of court. They said he repeatedly violated a gag order barring him from publicly attacking witnesses in the trial. Todd Blanche, Trump’s lawyer, argued that his client was just responding to political attacks with some of the alleged violations, not flouting the judge’s order.
He further argued that seven of the instances cited by the prosecution did not violate the gag order because they were reposts of other people’s content on social media. “Reposting an article from a news site or a news program,” he said, “we don’t believe are a violation of the gag order.”
Hmmm. Intriguing.
Merchan asked whether there was any case law on it. Blanche replied: “I don’t have any case laws, your honor, it’s just common sense.”
“Common sense,” of course, would have had the defendant in the clink ages ago. This kind of statement explains why I am not a judge. Instead, Merchan let Blanche have a little more rope.
As Blanche continued to repeat that claim, the judge rebuked him. “Mr. Blanche, you’re losing all credibility, I have to tell you right now,” Merchan said. “You’re losing all credibility with the court. Is there any other argument you want to make?”
The defendant, of course, walked out of court when it adjourned and beat feet for the now-familiar bank of microphones for the daily Whine ’n’ Lies session.
Trump addressed the media in the hallway outside the courtroom, complaining that it was “totally freezing” inside, per pool. Asked about his thoughts on the gag order, Trump said it was “totally unconstitutional,” adding:
I’m not allowed to talk, but people are allowed to talk about me.
Because those “people” are by and large not convicted or indicted criminals.
I’d love to say everything on my mind.
There’s not enough whiskey in the world...
I spent the entire day watching TV and drinking beer. It was great!
Hmmmm...
I see that. I was only comparing using "entire" or no modifier. I did think of it in the context of that issue in front of the court at that time though whether "all", "entire", or nothing. If that what was meant by "to be fair" that it was only to that specific case and not the entire trump trials, then I get it. I had to go review, the english language can be quite taxing sometimes, and it's my first language. lol
https://englishhelponline.me/the-difference-between-words-all-whole-entire-each-and-every/
I recently had a request from one of the readers to explain the difference between the words: all, whole and entire. So that’s what I’m going to write about today, but I’d also like to include the words “each” and “every”.
The word “all” is used with countable or uncountable nouns to refer to 100% of many things. For example:
All of my furniture is from Ikea. (uncountable)
I bought all of my plates from ABC department store. (countable)
The words “whole” and “entire” mean 100% of one thing. It is used with countable nouns. For example:
I ate the whole pie by myself. I’m so full right now.
I spent the entire day watching TV and drinking beer. It was great!
The word “each” and “every” are very similar but have slightly different meanings. They are both used with countable nouns. The word “each” focuses on the individual parts that make up a collection of something, but “every” focuses on all the parts that make up a collection of something. For example:
Each of the stamps in my collection came from a different country.
Every stamp in my collection is very valuable.
Each person in my family is very special to me.
Every person in my family can play the piano.
In addition, we use “each” when we want to focus on the differences between things, and we use “every” when we want to focus on the fact that things are the same. For example:
I have many pins in my collection and each one comes from a different country.
I paid over $20 for every pin in my collection.
I hope this is clear to everyone. Please note that when the words “each” and “every” are followed by a verb in the present tense, it must have an “s”. Therefore, “each” and “every” follow the same grammar rules as “he”, “she” and “it”.
.
Well... I'd argue that "all" and "entire" do not mean the same thing in this case. "All" seems to me to be a different kind of modifier.
I think the judge meant "all credibility" on this issue, which was Blanche's contention that Trump had been meticulous about abiding by the terms of the gag order.
“You’re losing all credibility with the court,” Merchan tells Blanche.
— Anna Bower (@AnnaBower) April 23, 2024
That is just SO COOL!!!
Yeah, JFK Jr. flew him in from Memphis.
Elvis showed up at the trial?
To be fair, the judge did not say Blanche's "entire" credibility was at risk. Somebody ought to tell the headline writer to chill.
According to most commenters, it's not a desirable thing to have happen, but it's not the end of the world.
Well... they didn't tell him he couldn't LIE. They told him he couldn't lie about members of the jury and their families.
Yes. Blackhawks and I were. I asked Dave, and he fixed the problem.

Judge Warns Trump’s Idiot Lawyer His Entire Credibility Is at Risk
Todd Blanche appears to be quickly making things worse for Donald Trump in the hush-money trial.
https://newrepublic.com/post/180897/judge-warns-trump-idiot-lawyer-blanche-credibility?
An attorney for Donald Trump’s legal defense in his New York criminal trial took a serious misstep on Tuesday that resulted in a critical warning from Judge Juan Merchan.
On the second day of the trial, attorney Todd Blanche attempted to portray Trump as an individual fully aware of the limitations of the partial gag order imposed on him in the trial, which forbids him from speaking publicly about courtroom staff, prosecutors, or any of their family members. Comments about jurors are also prohibited, as well as comments about witnesses, though comments about Merchan and Manhattan District Attorney Alvin Bragg are still on the table.
Still, Trump has already managed to violate the gag order about a dozen times, according to the Manhattan District Attorney’s Office.
“President Trump does in fact know what the gag order allows him to do and what it does not allow him to do,” Blanche told the court, insisting that his client had not violated the court order since Trump’s comments toward witnesses, including adult film actress Stormy Daniels and his former fixer Michael Cohen, allegedly came after they had spoken about him first.
“He’s allowed to respond to political attacks, your honor,” Blanche said, according to MSNBC’s Adam Klasfled.
But Merchan remembered the order of events, reminding Blanche that Trump’s disparaging remarks had in fact come before the others’.
“President Trump ‘Truths’ repeatedly, all day, virtually seven days a week, your honor,” Blanche replied.
The ensuing back-and-forth between Blanche and Merchan continued to a rolling boil until Blanche suddenly claimed that the violations at hand—which involve Trump “reposting an article from a news site” or a “news program”—don’t actually violate the order. Still, Blanche had no precedent or case law to support such a claim.
“I don’t have any case law,” Blanche said, instead calling it “common sense” and doubling down that Trump had been “very careful to comply” with the order.
That was, apparently, the straw that broke the camel’s back, after which Merchan dropped that the attorney had gone too far.
“Mr. Blanche, you are losing all credibility with the court,” Merchan said, according to LawFare’s Anna Bower.
“You say the posts are ambiguous, you say he didn’t know, but you’re not offering me anything to support your argument. You’re not giving me anything to hang my hat on,” Merchan continued.
“The fact that the prosecution did not come running in here as some as your client posted things too close to the line is not probative of anything here,” he added before telling the court to take a break.

A new poll released by Marist has demonstrated that President Biden's momentum is growing in the polls. The new poll, which observed 1,047 registered voters across America found that in a head-to-head with Donald Trump, President Biden leads by a 3% margin, at 51% versus Trump's 48%.
Significantly, when the poll brings in the likely third-parties, including Robert F. Kennedy Jr., Biden's lead grows to 5%, with him earning 43% of the vote, Trump earning 38% of the vote, and Kennedy earning just 14% of the vote.

I hope Melania doesn't have plans of her own for a political career.
One of the weirdest things about her is the way she copies his signature.
I don't know that it is. We were worried about the future of democracy in the '60s, too. Not for nothing did we call Nixon a fascist.
And Olivia Julianna needs to give some thought to her own reproductive autonomy. She's at an age at which she ought to value that a great deal. If she does, she'd better vote, and convince her fellow Gen Zs to do the same.
Ok. That didn't occur to me, but you could be right!
Not actually sure it will cheer him up though....................
A message to the attorneys in today's NY AD criminal trial - Please Please Please Please allow your client/defendant to testify in court during the trial. It would be a great move for the U.S. and Democracy!
What prosecutors can and can't ask Trump if he testifies
From CNN's Kara Scannell, Lauren del Valle, and Jeremy Herb
If Donald Trump decides to testify in his criminal hush money trial, these are the cases Judge Juan Merchan will allow prosecutors to use to cross examine Trump:
Merchan will allow Trump to be cross examined on the civil fraud verdict that found he violated the law by fraudulently inflating the value of his properties and was ordered to pay more than $464 million in penalties, including interest.
The judge will also allow prosecutors to ask Trump about the two violations of Judge Arthur Engoron's gag order during the trial last fall, in which Trump was fined $15,000.
Prosecutors will be permitted to ask Trump about both E. Jean Carroll verdicts in federal court where juries found that Trump defamed her when he denied her rape allegations. Trump was ordered to pay $83.3 million for defaming Carroll.
And, Merchan is allowing prosecutors to elicit testimony from Trump about the settlement he reached with the New York attorney general that led to the dissolution of the Donald J. Trump Foundation.
This is what will not be allowed:
The judge is not allowing prosecutors to ask Trump about the ruling in Florida when the judge sanctioned Trump for filing a frivolous lawsuit against Hilary Clinton.
Merchan also ruled the 2022 Trump Organization tax fraud conviction is off limits for prosecutors if Trump testifies. As he issued his decision, Judge Merchan noted that the law gives a trial judge "wide range of discretion" in deciding what to allow to be used in cross-examination of a defendant.
Trump sat back in his chair and did not visibly react as the judge read his decision on Friday.
The ruling arrived after the judge held a routine hearing – called a Sandoval hearing – on Friday to address Trump’s criminal history and assess how much prosecutors could ask if he testifies. As a reminder, Trump told reporters outside the courtroom on Friday that he wants to testify.

Yea, I saw that. Wow, such originality and thoughtful words. Without spending more time than I care to do, I suspect her underlings switched a few words around on some copied quotes. Probably getting a little more aware of not just having Melania directly plager Obama's speeches, but again there may be quotes out there that are exact word for word. I believe one of JFK's speech had some of those similar statements, as well as many others. Pretty stock stuff. She couldn't even memorize that short bit, had to keep looking at the paper and probably didn't even spend the time to practice dry runs.

Representative Marjorie Taylor Greene, a Georgia Republican, was mocked on the front cover of Sunday's New York Post, once Donald Trump's "favorite newspaper," due to her opposition to U.S. aid for Ukraine amid the country's ongoing war with Russia.
The cover, which depicts Greene, a Trump ally, in a Russian fur Ushanka hat with the headline "Nyet, Moscow Marjorie." The tabloid's front page was then shared on X, formerly Twitter, going viral.
"Sometimes the NY Post Gets it Right!" Representative Tom Suozzi, a New York Democrat, wrote in an X post, which had over 890,000 views as of Saturday afternoon.
Far-right activist and media personality Jack Posobiec posted to X: "BREAKING: NY Post openly mocks MAGA, calling them 'GOP rebels' on the side of Moscow." His post had over 295,000 views as of publication.
Newsweek reached out to Greene's office via email Sunday morning for comment.
