Hello, everyone, apologies for taking so long to post. From the Clark County eighth website, things did not look right to me, and I needed a lot of clarification. The court website does not describe clearly with necessary detail about what's going on. After talking with a clerk for the judge, and then getting clarification from one of the attorneys listed, and doing some research,, I've gotten a better picture of what's going on.
Hi Martin 958, Frank is doing well, and he mentioned he thinks really well of you. Glad you received my prior message even though not doing the paid subscription here. I realized just before you posted last year, that you were the friendly contact from England. Thank you, and Mr. Underhill is thankful for you being a thoughtful and caring guy!
About the case in Nevada courts: One of the attorneys listed as counsel (Gewerter) has been given an order of suspension by the Nevada state ba The other attorney listed as counsel does not actually seem to be retained, but he does seem seems to be of excellent character.
The next steps might take some time, we'll see!
I do not think that this will be a great year for mining development with the coronavirus situation, but longterm I think Helix is in the game.

Hi J. I use limit orders and make them GTC (Good Till Closed). With GTC the order stays open until it is completely filled. This saves money on the broker fee if it takes more than one purchase to fill the order. My most recent order took 2 purchases and 5 days to fill but was worth the wait.

I hope, as you all do that the price goes up much higher this year, and I hope that we all do well. I had promised to post, if it was me, that got a boat load of shares cheaply; so that you would know that it was not someone "naked shorting". I have been away for quite awhile. Been busy, also lost money in other stocks (bio stocks), so haven’t been quite the cheery person lately, lol. (FYI to all, stay the heck away from biostocks!!!) If I wasn’t impatient (and stupid), I should’ve just stayed out in PM stocks, and I would’ve made out very well. But I wandered, like an idiot, and it cost me Dearly! Hellix, is my only PM stock right now. Still have faith. Anyway, is there anything new, updates, status, on that lawsuit? Any progress for Hellix? Does Frank have a fighting chance for an actual comeback / success going forward?
Also, Martin, can I please have Frank’s contact info again? You were gracious enough to email it to me, but long story short, I deleted that email due to too much spam and garbage, and didn’t write that info down before I did so. My bad. Thank you.

Update, Frank and attorney are working diligently, as the court posted for Case # A-19-800252-C "10/28/2020 Amended Complaint" --not sure if there will be another hearing or if the judge is reading the amended complaint before making any decisions regarding the amended complaint. Not sure how long this process will take, keeping hopeful.
Wow, today someone bought 50k shares at .04. Thanks for the $ 2000 vote of confidence. Hellix hasn't seen .04 in a very long time. Lets see if the naked shorts comes back in to slap it down again. All the big damage was done years ago when the shares were aggressively naked shorted and badly diluted to the tune of hundreds of thousands of shares. These days the naked shorts are knocking it down with minuscule amounts of shares by comparison. We have in recent months drawn down on the dilution pretty good and at ridiculously low prices to boot. Now all we need is some more good news from the court case to keep the momentum going.

I got a reply from Frank this morning and it seems he is making progress.
I wouldn't like to copy and paste his message here due to ongoing situations in the courts, but I believe he has further meetings with his lawyers re: Hellix, so we will have to wait and see what is next.
But sounds positive for us investors.

this is very encouraging. i subscribed to the" international forecaster "for years and followed Bob Chapman well maybe too much. He said Hellix was speculative so he is not to blame. i have held my shares since then. I am praying that the Sr. Underhill will have the health and longevity to see this project through.
Hi Everyone, I'm new to this board but I was an investor in Hellix before I threw in the towel.
I read all the postings and find this new lawsuit development really interesting. Here is the saga as I understand it:
Underhill Sr. continues to be the President of Hellix and took the company into hibernation mode to save cash and is waiting for the opportune time to sell Hellix to a major. He waited so long that most investors gave up assuming he became too old, wanted to retire, but his son wouldn't take over so he sat on his shares. Then the naked shorting happened and Hellix became worthless (per the stock price). And then Underhill sued Brenner for financial harm. Making everyone rethink the assumption that Underhill Sr. doesn't care about this company or harm done to the stock price.
Also, there is the real concern that Sr. could pass away, leaving a large number of shares to his son, Underhill Jr, perhaps even a controlling stake. And Jr. isn't of the same caliber as Sr. (just take a look at his LinkedIn page: https://www.linkedin.com/in/frank-underhill-1a262621/) From what I gather, Jr. doesn't want to be involved with Hellix. If this came to pass, it would be really opportunistic if a small group of investors bought ALL of the Underhills shares in a private sale and gave the company a new life.

Motion granted for relief from the summary judgment that had been previously granted, and Mr. U. gets to amend the complaint against the defendant Walter Brenner. I am so happy for Mr. U., and for honest shareholders who hold on and do not play games with the stock.

8 days, just posting beat wishes for Frank, and that he prevails at the September 30 hearing. If anyone is in contact with him, and can ask him if he thinks it would be helpful for a shareholder to write a letter for the judge to read, that shareholders support Frank and will be better off that Frank prevails, then I would be willing to write such a letter.
Hello Mining Hound, I don't know those sorts of details. I would presume if he's going to court he would have all the relevant documents he needs.

This coming Sept. 30 is the next hearing. I hope that Mr. Fr. U. is able to argue that because it seems that W. Brenner harmed the company, that this is a valid reason why Frank Underhill should prevail.
Martin958, are you able to confirm from Frank that he’s got the all the pleadings downright on his own, or has a lawyer assisting him? This would be nice to know while praying over the next 4 weeks. Does he need,or would he like a shareholder letter of support?

this is my first post, although I have come here to read from time to time. I picked up 3395 shares for .01 today, and 20001 on 8-25-2020 at .0068 . I have owned shares since 2011; listened to Bob Chapman on the radio and took some of his advice. In my opinion,a true American hero; may God rest his soul. I have often seen shares sell for under my bid. I trade in TD Ameritrade; have complained to them and been told that there is nothing they can do since it OTC.
I am not a naked short person, only trying to cost average my per share price down, which is finally below .05 cents.I had purchased in 2011 at about .80 cents. Truly hope that the stock recovers; will remain here as a fly on the wall, but ,I will let you know if I buy a bundle at below .01. Hi Martin958. Thank you for asking. I never knew that Brenner caused Hellix trouble, until you shared the court case. Then I looked to the report where Brenner was banned by the stock commission for not being forthcoming about his activities. I was too sad when Bob C. passed, that I did not look to see what was happening to Hellix.
I must be humble in that I am not a businessman, not a broker, and not an attorney, so I would not be the most helpful, by myself. But if a letter on behalf of shareholders would be of help, then I could write a letter to the judge, based on the information at the British Columbia Securities Commission, and ask that the judge make a ruling that would benefit Frank and the shareholders. I am sure the majority of shareholders want Frank to prevail. I might ba able to find a former business law professor and ask if he would review such a letter.
I do have experience as a development officer for a small private school, so if Frank needed a volunteer intern, I might be able to help with paperwork. If he would like promotion work, then we can start in Bob Chapman’s newsletter.
Next, I think the case is important and should be covered by Kitco and other mining news sites. But I would only want that publicity if I knew how the case was going, and the publicity would help.
I am used to writing and researching human rights and constitutional law, but with an attorney’s help, I think I could draft some good support letters.

If Frank prevails with title to property he needs to take steps to stop the naked shorting. If he doesn't they will continue naked shorting Hellix leaving all of us high and dry once again. Unfortunately the latest motion was against Frank
Hi, I had a lawyer read over the court postings and unfortunately the first motion granted onfavor o& Frank U. was vacated, and the most current partial summary judgment was granted against Frank U. I do no5 think Frank U. has representatio at this time. As the most recent summary judgment wa# against Frank U., that does not mean all is lost. Maybe the court found that Frank or Hellix owed Brenner money for title to the property. Hopefully full title of the property will end up with Frank U. and Hellix V.
Martin958, if you could ask Frank U., if he needs help and would let us know, that would be great, really want Frank U. to win, and to make sure that all good arguments are set before the judge in case an appeal needs to be made.
Hi Ranchu. The first issue is that this is not a criminal case its a civil action. If Brenner were to have shown up he would have been subjected to questioning from Frank's lawyer. The questioning might have revealed criminal conduct on Brenner's part which Frank could have further pursued. Brenner and his lawyer knew what they were doing and the decision was made to be a no show. Naked shorting is hard to stop unless you enlist a firm that specializes in stock fraud. They are very good and very expensive. In my opinion if Brenner wasn't culpable in other ares of Hellix fraud he could have shown up and simply plead no contest. However to avoid incriminating himself he became a no show. Depending on the scope of Franks complaint he may just get all he asked for in his complaint. The case designation has the words "title to property" in it. Im just guessing but maybe clear title to the property is the major objective Frank seeks to obtain. Brenner may have been standing in the way and why the drilling permit never materialized. Hopefully Franks prevails in the most important issues and can move forward soon. -Lamont
More importantly, what happens to Brenner with the default of this trial?
Many people who do that are already well-seasoned to the consequences, which is simply a wrist-slap fine especially for financial crimes. And maybe that's why HLLXF is still being shorted, knowing that he goes scott-free much like the major banks have for decades.
Thanks for the verification Martin. When you don't show up in court it looks real bad thus the partial summary judgment against Brenner. Hopefully any remaining issues will be concluded soon and Frank can move on. Time will tell. Thanks again.

Hi Lamont, well researched. Frank did clarify that point to me in an email:
"when the sec went after his sec vs brenner--- you may look it up---becsec vs walter brenner---he fired his layer i beleive and the judge made his lawyer continue to represent him and brenner never showed up for his hearing---"
So I can confirm this much if what I am being told is right.
Thanks a million mining hound !!! You are the bearer of very good news. This means that Brenner did not answer the complaint against him. In other words he was a no show. In the US a summary judgment is called a "default judgment" and usually results in the plaintiff getting most if not all they ask for. Summary judgments are awarded to give plaintiffs a speedier remedy rather than having to wait to the full conclusion of a case. Looks like Frank has been awarded a sum of money. A partial summary judgment means the judge is still working on a remaining issue in Frank's complaint.

Hi everyone, checked Case # A-19-800252-C at clarkcountycourts.us after talking with the clerk a while ago. It looks like there was a "partial summary judgment" ordered on 07/18/2020, a monetary judgment, with regards to quiet title claims.
I am not sure that the attorney listed is actually helping out Frank U. in this case., Martin958, thanks for being so kind to Frank U. Would you be willing to ask Frank if there is a law firm or lawyer assisting him, and if he would be willing to share with us the attorney assisting him? I am interested because I like reading lawyer's briefs. Also, if Frank would be willing to let us know if the partial summary judgment order is favorable for him and for Hellix V.
