I still didn't ever receive an email from Mr. Livak. I contacted Mr. Fant and he gave me his cell phone number. I will call him in about an hour. I will let you know if I get a hold of him and what he tells me if anything.

What happened to Delta is that the Madoff fiasco came along. After that disaster, the SEC decided, amongst other steps, to purge the pink sheets of any company with an irregularity in its papers or exchange registration. Delta had merged in 2001 or 2002 into an unrelated corporate entity. That original corporation had missed filing its annual SEC papers in 2001. Since that entity no longer existed in 2009-2010, Delta had no way to correct that error.
But Delta is alive and kicking. The asset controlled by Delta is a pretty good mineral asset and Alex is working trying to JV with a larger mining company. I don't know if Delta will be successful, but but check with Alex for the details here: alex.livak@gmail.com

I spoke to Doug Fant, attorney who represented DMXC to the SEC, today and he indicated that they are trying to either sell the properties and/or raise capital of $250k to relist. I indicated that I and a few other people were thinking of junking the shares. Doug indicated that he recommended I not do that as Alex has a large stake in this property and will not just abandon it. It holds out hope that this will eventually get resolved but it isn't as fast as we would have liked. I e-mailed Doug and he indicated he would provide to me Alex's e-mail and phone number to contact him. He indicated that another sharedholder contacted him recently as well. He also mentioned that his own brother has a considerable amount of shares.
I don't see any reason for Doug to tell us not to junk them. So I would recommend holding out since they can be junked in December anyways. WHen I get the contact info for Alex, I will pass it on.
if your portfolio still shows you have shares in delta, or whatever number has been assigned to it, then you should have an option to liquidate worthless shares and yes, write it off as a loss.. call your broker if you cannot find the info online

Well, I still have my 300k+ shares showing in Scottrade. If I don't see anything by December, I may finally dump the stock and take the loss. I will be pressing the lawyer who represented DMXC for input as well as trying to get a hold of Alex Livak. Every time I call the number listed, it never gets answered.
I believe we are SOL here... I do think Alex could have communicated better, hell anything publicly for that matter.. but I know it was not his fault DMXC was delisted. I seriously doubt we have Any assets to speak of at this point, seeing as how the deal for Delcer Buttes was a Share(s) deal...
I have not heard from Alex in some time, and plan on writing off my shares this next tax season if Nothing comes up!
Damn shame really.. I been a 'believer' since DMXP days...

Doug Fants called me and gave me a number to contact Alex at. However, it makes a weird ring and then asks for the voicemail code. He said he hasn't talked to Alex in about 3 to 4 months. Last time they talked, Alex was trying to have another company buy the assets or something to that effect. Needless to say, it wasn't that helpful. I am more concerned since the attorney hasn't heard much from Alex lately either...

I'm figuring this will be a write off on 2011 taxes.. a shame really, I personally put way too much into this venture. But, that's the chance I took with hopes of a substantial return.. live & learn!
Making misleading statements after the fact is irrelevant from a legal standpoint as it could not have caused us any harm. recovering from the assets is likewise a dead horse... There's a million dollar note out there if I'm not mistaken.
Sucks to be us, but I'm with Vance. This probably isn't going to be back. Shame really...

I posted this complaint with the SEC until I can get a hold of the attorney that represented DMXC last year in the SEC hearings.
This company's stock was halted by the SEC in June 17, 2010 in administrative proceeding File No. File No. 3-13943 (Release No. 34-62309). The company's stock was revoked by the SEC on August 13, 2010 in administrative proceeding File No. 3-13943 (Release No. 34-62714).
After the revoking of the stock, the company provided a couple updates on its web site in October 2010 indicating that it was in the process of performing audits and they would relist with the SEC after the completion of the audits.
The October 2010 update is the last public update provided to the stockholders of record. The company has made misleading public statements indicating that the stockholders would be made whole. The company’ website (www.deltamine.com) is now suspended.
We ask that you look into this matter and provide the stockholders of record prior to revocation any input on what we can do to recover some of our investment since there were assets prior to the revoking of the company's stock.

I am going to call the attorney again and try to get contact information for Alex. There has to be answers or we will have to do a class action lawsuit since there are "assets". If they don't relist or tell us what is going on, they misled us in e-mails and through public updates.

You guys owe me!!! For some reason I had always assumed that Lewisburg was in the eastern part of Kentucky. Imagine my surprise when I found out it's in southern Muhlemberg County, about 50 miles from where I live. So... my wife and I loaded into the van and went for a drive. We found the street address listed as Delta's home base. It's in a very nice house on Lake Malone. Unfortunately, in the middle of our trip the van started cutting out and eventually stalled. It was 100 degrees in western Kentucky today, and we spent a LOT of time walking and sweating and eventually going for a ride in a tow truck. So - despite the fact that I didn't actually glean any useful information - I'm sure you will all feel obligated to send me a percentage of your shares as soon as we get the van out of the shop - and when we start trading again.
I'm hoping for #2. But I would be OK with #4. I hate to admit this, but I'm practically illiterate concerning stocks and stuff. Several years ago - probably about 1998 - I bought some penny stock. It was a company listed as SCMI. I don't even remember what it dealt in. But somewhere along the way it relisted as HITT - aka "Hits Galore" and suddenly went through the proverbial roof. I bought my shares at .03 and all of a sudden the reverse-split shares I still had were trading for over 10 bucks apiece. One day I was watching it go up like crazy - 11...12...13...14... sky's the limit, etc., etc. All of a sudden I saw the magic word "fraud" on one of the boards. I ran to the nearest phone and sold all of my shares at $7.00 apiece. I still don't know what the heck happened from start to finish of that story, but I do know I made enough money to buy my son a nice used car. I'm hoping for much better this time around, but I've always said that DMXC is like a lottery ticket to me.
Thanks for the clarification. So have you met Alex in person? I have never been able to speak to him via phone. I relied on e-mail. Now that isn't working so I called the attorney and he provided me info. Right now is a difficult time for us shareholders but all we have going for us is hope and patience.

3) I invested in the company and have spoken with Alex many times. He seemed like a good guy and was very accessible.
4) I am angry with how he handled the unfortunate situation that occured with the delisting. He vanished... I'm know he had twins and had other family issues but who doesn't. I go to work everyday and deal with whatever is thrown at me. I don't duck into a shell and avoid the world. If Alex focused on what needed to be done last summer we would have been okay. Now it's too late to get relisted. When he was telling everyone the AUDIT was being done I wanred you all that he had NO MONEY TO PAY FOR THE AUDIT and that it was not getting done. WAS I RIGH?
5) To recap: I am not Alex, my post was screwed up and I apologize (was most likely drunk when I posted).
6) I bought most of my stock via a private and want my money back. The middle man who introduced me to Alex is another character. Where is he now???
If they reverse merge into another shell, I think the company would be wise to do due diligence to ensure the same issue with this shell does not arise. But I agree with you that 3 and 4 are the most benefit to the company and the shareholder. I am glad they are taking their time trying to discern what is the best value to all of us. Patience is a virtue, they say!

EMERGING PRECIOUS METAL AND MINERAL EXPLORATION COMPANY
Delta Mining and Exploration Inc. (“Delta”) is an emerging exploration company whose main objective is to locate and explore land with mineral and precious metal deposits in the mining rich regions of North America.
This past year Delta decided to expand its portfolio of properties to land that has the potential for precious metal and mineral deposits.
