SOOOO....is this one step away from our stock being worthless OR is there potential for the stock to still be worth something if they pay us out, or turn it public or sell in the future? seems like the big reasons for going private were to 1) reduce reporting/compliance fees 2) avoid the scrutiny of being a public company.
any thoughts? Maybe I'm still grasping at straws since their proposal says that the common stock remains rather then cancelling them?

I'll do it. I plan on being around until I find out what happens with the commons. The good thing is If they survive the lights won't need to be turned off, and if they get canceled - the most I can lose is only 100% and I'll be around to turn off the lights. $COSIQ

Oh, and there is also the Dubai Franchising #s on pages 10 and 20.
4,650,000 - 525k - 975k - 100k = $3,050,000 left in the pot...then after reading pages 38-40, even more hands in the pot taking $.

In terms of priority in the US Bankruptcy Laws - common shareholders are the lowest priority - it goes:
1. The Government/IRS
2. Secured creditors
3. Unsecured Creditors
4. Preferred Shareholders
5. Common Shareholders
If any class Class above the Common shareholders are impaired then the common or Equity Interest is impaired.
And as you stated you can't impair part of the Common shares and leave others intact.
It should clearly state in the POR what the fate of the common shares will be.

Substantial shareholders (5% or more) may have voting rights that come into play
They cannot separate common shares - either they all survive or they all don't. By making large block holders announce their intent gives the insiders(most likely the newco) to decide whether they want that shareholder. I could be totally wrong here, but I take it as a protection measure so nobody can come in and buy up the company cheaper than the group that is winning, or won the bidding process.
The fact that they even have this provision gives me guarded hope that my continuing to buy will eventually payoff, if I'm wrong I will have my tax loss stock for 2017.

My guess is the 8k means commons will not get wiped out- However, I really don't know how things will end up going. If I knew the commons where safe I would never stop buying $COSIQ @ this current pps - lol

why are they requesting only 'substanial shareholders' to submit paperwork rather than everyone? wouldn't this mean that only the substantial SH will be transferred? I've read elsewhere that all common shareholders have to be treated the same (regardless of how many shares one has)...but isn't this request of only the substanial ones odd or is it common in these types of BKs?
8k from Dec 7th refers to "substantial" shareholders (>2.16M shares) needed to submit paperwork.
Leads me to believe commons will survive- however, that is just a guess on my part:

No they can't they would be sitting in jail.
They could choose to just transfer the substantial shareholders and wipe out the smaller shareholders. It really benefits them more to transfer small shares as well if they want to restructure the company and with them being so cheap (which is what court docs are suggesting). But I don't want to lead anyone down the wrong road it's really a gamble. Upside is way more imho. Should see .09 right away. I'm looking at this like an option trade.

Yeah I'm not going to look I'm sure there is some manipulation going on. There's no way in hell in selling before news on court tomorrow lol. I wonder how the market will react to 10m stalking horse bid w/ debt forgiveness and commons surviving. It's a gamble with a lot more upside imho. We shall see!
