HUGE NEWS: ClearOne files patent infringement suit against Shure, Biamp and QSC
27 April 2017
ClearOne files patent infringement suit against Shure, Biamp and QSC
As first reported by Lindsey Adler in SCN, ClearOne, a global provider of audio and visual communication solutions, has been awarded a patent on a system and method for combining echo cancellation and beamforming microphone arrays. Following this, the company moved to file suit for infringement against Shure, Biamp, and QSC, as collective defendants.
ClearOne first developed its beamforming microphone conferencing system in 2010, according to the company, designed to replace up to a dozen individual mics with a small beamforming array. The Beamforming Microphone Array audio conferencing system was brought to market in 2012, combining beamforming, AEC, and adaptive steering. The second generation was introduced in June 2016, operating on new peripheral bus architecture, allowing it to connect with ClearOne’s Converge Pro 2 DSP mixers.
The U.S. patent (No. 9,635,186), entitled “Conferencing Apparatus that Combines a Beamforming Microphone Array with an Acoustic Echo Canceller,” was issued 25 April 2017. The subsequent legal complaint was also filed 25 April.
At ISE 2016, Shure debuted the Microflex Advance portfolio of networked ceiling and table array microphones, audio interfaces, and control software for conferencing. The MicroFlex Array includes steerable coverage, enabling up to eight lobes of pickup, configurable in three dimensions. The solution began shipping in August 2016.
Biamp and Shure created an integrated compatibility between Biamp’s Tesira audio processors and software to support Shure’s MicroFlex advance solutions. QSC has partnered with Shure to integrate the Q-SYS Platform with the Microflex Advance.
ClearOne is seeking injunctive relief, meaning Shure, QSC, and Biamp would need to stop selling and promoting these products. Once a motion for injunction is filed, a judge would need to rule.
Alexander C.D. Giza, of Hueston Hennigan LLP, the firm representing ClearOne, stated: “ClearOne and its inventors and engineers have invested millions of dollars and hours of effort in research and development on this important technology. As a result, they manufacture industry-leading beamforming and acoustic echo cancellation audio conferencing systems. And as of Tuesday, they have a US patent on this invention. ClearOne is entitled to have its patent and innovation respected by the industry.”
Mark Brunner, Shure, VP of global, corporate, and government relations, confirmed that Shure received the allegations. Shure strongly believes the allegations are without merit, and they intend to defend themselves in the matter. While it’s Shure’s policy not to comment on ongoing legal cases, he said that Shure has initiated litigation to defend Shure’s rights and products.
Amanda Roe, Biamp, global public relations manager, told SCN: “We are aware of the lawsuit and are currently analysing the matter in order to respond accordingly.”

CLEARONE INC. (CLRO) SET TO ANNOUNCE EARNINGS ON TUESDAY

If clearone can push there new video over Ethernet tx /rx kits this company will skyrocket.
They were the leader in Digital Signal Processors but feel way behind on that.
Their next big move could be there new video over Cat solutions.
Can anyone give me any details on this company? Why is the stock price so low with such good fundamentals and continuous growth? I listened to their latest conference call and the questions seemed to point to that same fact. They also have 50 million cash that could bring a buyback/dividend... is it just the lack of media attention? Any info would be greatly appreciated!
Out 1,300 CLRO @ 7.50.

Federal Court Orders Judgment in Favor of ClearOne for Approximately $9.7 Million in Trade Secret Misappropriation Case
Judgment includes exemplary damages against all defendants, for willful and malicious misappropriation of ClearOne's trade secrets
SALT LAKE CITY, April 21 /PRNewswire-FirstCall/ -- ClearOne (NASDAQ: CLRO). A Memorandum Decision and Order (the "Final Order") was issued by the federal court yesterday, in favor of ClearOne Communications, Inc., awarding it approximately $9.7 million in joint-and-several and individual judgments against the defendants. The defendants include Biamp Systems Corporation ("Biamp") and a group of defendants sometimes termed the "WideBand Defendants," which group consists of WideBand Solutions, Inc. ("WideBand"); three of WideBand's principals - Dr. Jun Yang (a former ClearOne employee), Andrew Chiang (previously affiliated with an entity that sold certain assets to ClearOne), and Lonny Bowers; and a company owned primarily by Yang, named Versatile DSP, Inc.. In addition, the court adopted and upheld the jury's finding that all defendants had acted willfully and maliciously in misappropriating ClearOne's trade secrets, and awarded exemplary damages against each of the defendants.
The Final Order was issued in the case which was presented to a jury in October and November 2008 (the "Intellectual Property Case"), bringing claims for, among other things, theft of ClearOne's trade secrets. On November 5, 2008, the jury returned a unanimous verdict in the Intellectual Property Case in favor of ClearOne and against all of the defendants, awarding ClearOne millions of dollars in damages, and finding that all of the defendants willfully and maliciously misappropriated ClearOne's trade secrets.
By its Final Order, the court resolved various post-verdict motions filed by ClearOne and the defendants, including the defendants' arguments that they should not be subject to exemplary damages for willfully and maliciously misappropriating ClearOne's trade secrets. The court rejected the defendants' arguments on exemplary damages, finding "that an award of exemplary damages against each of the [d]efendants is appropriate."
As to defendant Biamp, the court ruled that the finding of willful and malicious trade secret misappropriation by Biamp was supported because "Biamp deliberately ignored numerous warning signs suggesting that the AEC technology offered by WideBand was not WideBand's to sell. Given all the facts presented to Biamp at the time, it could not have held a good faith belief that its use of the WideBand code was valid," and that Biamp earned over $1.5 million "by purchasing the WideBand technology at half the price offered by ClearOne and then selling the technology at the same price it charged when dealing with ClearOne." The court also wrote that "having reviewed the testimony of Biamp's witnesses...the court finds that the jury (who has the sole responsibility to assess witness credibility) reasonably found by clear and convincing evidence that Biamp's behavior was willful and malicious." For these and other reasons, the court concluded that "an award of exemplary damages against Biamp is appropriate to punish Biamp for ignoring its due diligence duties in order to profit at the expense of a competitor and to send a message deterring other companies from engaging in similar conduct."
As to the other defendants, the court found that there was evidence of deliberate copying of ClearOne's trade secrets, including evidence that "showed that secret elements of the ClearOne Honeybee Code were found on the WideBand Defendants' computers and that users of those computers attempted to hide that fact." The court also noted that the "evidence showed that none of the WideBand Defendants held a good faith belief that the copying and use of ClearOne's Honeybee Code trade secret was proper." And, although the court ruled that the "most egregious instances of a lack of good faith are found in the behavior of Jun Yang and Andrew Chiang," it also held that "the other WideBand Defendants (Lonny Bowers, WideBand Solutions, and Versatile) are no less culpable."
The court ruled that ClearOne's fiduciary duty claims against Chiang and Yang were preempted by the Utah Trade Secret Act, and therefore set aside the jury's verdict for breach of fiduciary duty and punitive damages, but noted that the findings of breach of fiduciary duty and the award of punitive damages on those claims supported the exemplary damages awarded by the court for theft of ClearOne's trade secrets against these defendants. The court ruled that ClearOne was not entitled to prejudgment interest. The court denied a number of other motions filed by pro se defendant Lonny Bowers, and noted that any post-judgment challenge to the sufficiency of the evidence by Biamp had been waived by Biamp's failure to raise the argument during trial, and would not have succeeded even if not waived, based on the overwhelming evidence in the record. ClearOne intends to request an additional award of costs and attorney fees against the defendants.
While ClearOne intends to vigorously pursue collection of the damage awards, collectability of the judgments cannot be guaranteed. Furthermore, the jury's verdict and damage awards are subject to appeal by one or more of the defendants.
At trial and throughout the Intellectual Property Case, ClearOne was represented by the Utah law firm of Magleby & Greenwood, P.C.

When a company looses respectability good prospects matter no more...
Sadly,
Gaougogl
ClearOne filed yesterday
...and is now current. - I'll try to post a link later...
Trades so far this morning all at 4.00...
Closing in on the end...
...ClearOne Communications will be current by end of June 2006, as they make their third filing for 2006.
What happens next then is in - in my opinion - that they will be listed on the otcbb, almost instantly (that is my understanding and I am willing to change view asap if facts are different).
It seems right now as if clro has difficulty 'defending" a higher value than say, 4.50...even in many months to come. So my interest will weaken if not disappear altogether...maybe it will become a good trading vehicle once stock gets listed on the nasdaq....it is company's stated goal to get listed on the nasdaq asap...
Take care - Good fortune - if you're holding clro....
I'm long CLRO
...and have no doubt company is now well on its way back to "respectability", a nasdaq listing (returning) and a higher share value. So I'm excited about any advancement as far as products and what not concerns. Unfortunately this latest thing doesn't convince me and it seems the market quickly decided it was no big deal.
Part of the reason is here:
"...The Chat 50 USB Plus is scheduled to begin shipping in April 2006; the Chat 50 Global Traveler will be available in May 2006. The products will be available at leading dealers in the US including Hello Direct, PC Mall, Mac Mall, GBH, PC Connection, and others. It will also be available at dealers in selected countries worldwide. .."
I have nothing against any of these venues but don't believe they would be enough...marketing, marketing, marketing...will decide the fate and the above won't cut it, as I see it. Still, company has many products, a great reputation for products and service, so we should continue to see higher value ahead.
GO CLRO!!!!!!!!!!
Company has been trending higher since the drop in August after the filings....
Now the goal is year end filing for 2005 which has been promised at or before end of March (2006) - so stock is likely to firm up in anticipation. After that, company has promised to file "as soon as possible" for each quarter of 2006 - and then company would become current and eligible for another exchange...........it's reasonable to expect stock to double from here (about 2.60-2.70 now), but expecting more than that wouldn't be prudent at this time.
...company files 2004...

It is time to remove Bagley
In one and a half month ClearOne Communications have lost half of its value. And that loss didn't start from a high level.
When everybody thought it reasonable to expect that ClearOne would finally release all numbers and file to become current and eligible to trade on an exchange other than the Pink Sheets, ClearOne refuses to do so and one has to ask why.
Is ClearOne not doing any book keeping at all? - One could get that impression in view of court decision the other day, when the judge accepted (!!!) the claim by ClearOne's lawyers that the records requested did not exist....
This is too much...it's time to start openly recognizing that ClearOne is dominated by a person with a criminal record and that the rest of the management team is not able to stand up to this individual for whatever reason - the size of his stake in ClearOne would be the most obvious, but who knows what else there might be...
The SEC now assumes that the threat of ClearOne losing its registration should compel company to produce records on or before October 15, but why is company resisting? What is the operating motive here - why is a perfectly fine company apparently being destroyed from within?
Enough is enough - shareholders should unite to remove the Chairman of the Board of ClearOne Communications - Mr. Dale Bagley.
ClearOne Communications filed today
http://biz.yahoo.com/e/050818/clro.pk10-k.html
Jule 28, 2005 - the day CLRO broke the pattern
with five to ten times the usual volume and a sharp rise in price. - Something became known to some and most likely it had something to do with company filing in the not too distant future.
It is my prediction and has been, that BEFORE company files...stock will be at five or higher.
Eventually of course, if valued like their closest competitors, CLRO will be in the 15 - 40 range depending on how their revenues have developed over the last two, three years.
...nobody has found the board...
..ok..well, since last post months ago, company drifted lower and lower until it had drifted too low and started to drift higher. Most likely co touched intrinsic which provided a hard bottom...but it's a fair guess that we're well below book value and that a ten bagger from here is not out of the question....
Buy now and laugh later...

ClearOne Communications
First post - if you find out about this company around March 2005, you may be in luck, since at this point company is most likely severly undervalued, plus, its days on the "pinks" may be numbered. - Although company is not free to say much about the future, due to SEC imposed limitations, there are signs that this "silent period" may be nearing an end. - Currently trading around 3.50 on low to very low volume, this most likely represents quite a bit less than book value. Company is also assumed to have plenty of cash. A global sales network and a terrific reputation for its products and services plus a technological partnership arrangement with Arkon, British Columbia, adds credence to the suggestion that company should be valued far higher than it currently is. - You just found yourself a "hidden gem."
