We are forming a group to challenge the distribution that was just made for 5.5 cents. The shares continued to trade for 3 years after the Record Date in April 2010, and only shareholders that owned the shares in 2010 received $. If you look on Aviza's web site you will notice that on 11/13/2013 they informed shareholders of a liquidating dividend in the amount of $0.054903
643 per share. On 12/14/2013 the dividend was posted to my account at TD Ameritrade but at the rate of .00028 per share. I am currently disputing this amount with TD Ameritrade but I want to make other stockholders aware of this issue as you may also have been underpaid

The U.S. Bankruptcy Court confirmed Aviza Technology’s revised Plan of Liquidation. The Plan provides for the consolidation of all assets and all liabilities of ATI, Aviza and TTI into a single estate as of the effective date of the Plan. The consolidation of the estates eliminates any inter-company claims between the three Debtors not previously cancelled as well as the guaranties of the obligations of one Debtor by either of the others. Consolidation also ensures that multiple and duplicative claims filed against more than one Debtor will not improperly receive more than one distribution. The Court approved the sale of certain of the assets of the Debtors and the assets and stock of certain of their direct and indirect subsidiaries to Sumitomo Precision Products. The purchase transaction closed on October 16, 2009, and the consideration, valued by the Debtors at approximately $60 million, included cash, certain promissory notes and the assumption of certain liabilities. The Debtors’ Plan will be implemented by distributing cash received from the promissory notes, liquidation of the Debtors’ remaining assets and the wind down and upstreaming of cash by direct and indirect subsidiaries of ATI to the Debtors.

Aviza Technology Receives Delisting Notice from NASDAQ
SCOTTS VALLEY, Calif.--(BUSINESS WIRE)--Aviza Technology, Inc. (NASDAQ:AVZA), a supplier of advanced semiconductor capital equipment and process technologies for the global semiconductor industry and related markets, today announced that on June 10, 2009, it received a Staff Determination Letter from The NASDAQ Stock Market stating that the company’s common stock is subject to delisting from The NASDAQ Stock Market in accordance with Nasdaq Listing Rules 5100, 5110(b), and IM-5100-1. The letter was issued as a result of the company’s previously announced filing for relief under Chapter 11 of the U.S. Bankruptcy Code on June 9, 2009.

The company does not intend to request a hearing before the NASDAQ Listing Qualifications Panel to appeal the decision. The letter set forth the NASDAQ staff’s determination to delist the company’s common shares, suspend trading in the company’s common stock at the opening of business on June 19, 2009, and file a Form 25-NSE with the Securities and Exchange Commission removing the company’s common stock from listing and registration on The NASDAQ Stock Market.

Aviza Technology and its subsidiaries, Aviza and Trikon Technologies, filed for Chapter 11 protection with the U.S. Bankruptcy Court in the Northern District of California, case number 09-54511. The Company is represented by John Walshe Murray of Murray & Murray. Aviza Technology states that the filing was made "[a]s a result of the global economic recession" and dramatic decline in the "demand for semiconductor manufacturing equipment." Prior to the commencement of the Chapter 11 case, the Company executed a non-binding letter of intent to sell certain of its assets and businesses to Sumitomo Precision Products Co. (SPP). SCOTTS VALLEY, Calif., Nov 06, 2008 (BUSINESS WIRE) -- Aviza Technology, Inc. (NASDAQ:AVZA), a supplier of advanced semiconductor capital equipment and process technologies for the global semiconductor industry and related markets, today announced the introduction of StratIon(TM) fxP, the world's first 300-mm ready Ion Beam Deposition system. The first system was shipped to CEA-LETI-MINATEC in Grenoble, France, one of Europe's foremost applied research centers in electronics and Spintronics. The StratIon fxP will be used to develop next-generation magnetic tunnel junction (MTJ)-based devices for applications including Magnetic Random Access Memory (MRAM), hard disk drive read heads or RF components. The system will also be used for the deposition of metal gates for advanced CMOS processes. In addition to the system shipment, Aviza and CEA-LETI have signed a three year joint development program covering the development of MTJ deposition processes for future MRAM and Spintronics devices.
The StratIon fxP system uses ion beam processing for the deposition of metal and dielectric thin films, and is the world's first ion beam deposition system for 300mm wafer manufacturing. Designed for high volume manufacturing silicon fabs, the system is based on production-proven hardware and software platforms and can be configured with three standard chamber types: preclean, oxidation and deposition. Additional Aviza deposition chambers such as atomic layer deposition (ALD) and magnetron PVD can be seamlessly added for additional flexibility. StratIon fxP offers low cost of ownership, high throughput and a smaller fab footprint compared to currently available systems used for MTJ deposition.

Smoothness is a critical parameter in MTJ stacks, where the thinnest films are less than 10 angstroms. Spintronics Technology for Broadband Applications

Device scaling poses critical challenges for flash memory manufacturers, such as excessive electrical leakage at the 65nm technology node and below. Flash memory may fail to scale beyond 32nm technology and memory makers continue to look for alternative architectures.

MRAM offers a combination of non-volatility, near unlimited endurance, small cell size and fast read/write times, making it well placed to succeed flash memory in both discrete and embedded implementations. FISCAL YEAR 2008 FOURTH QUARTER FINANCIAL HIGHLIGHTS

-- Fourth quarter shipments were $35.5 million.

-- Fourth quarter net sales of $35.5 million were within the range of the Company's guidance of $35 million to $40 million for the quarter.

The company's ALD systems include Celsior fxP, a single-wafer, multi-chamber cluster solution configurable to both 200 millimeter (mm) and 300 mm wafer sizes; and Verano 5500, a batch wafer processing solution for 300 mm wafers. It also offers Sigma fxP, a system used to sputter uniform layers of pure metals or metal alloys, and metal compounds, such as oxides or nitrides; Delta fxP system for applications in shallow trench isolation, pre-metal dielectric, inter-metal dielectric, and final passivation layer; Delta i2L cluster system for processing wafers up to 200 mm in size; 1500 atmospheric pressure CVD (APCVD) systems for processing 200mm wafers addressing design-rule fabrication capability of 0.15 micron; 1000 APCVD system offering either hybrid or TEOS-reactant processes; and 999R APCVD and TEOS999 APCVD systems for production lines employing between 100mm and 150mm wafers. Aviza's Etch systems include Omega fxP that offers up to six process modules plus in-line stations to allow for the alignment and the cooling down of the wafer; and Omega i2L that features plasma source technologies in a single-chamber format. Its thermal processing systems include RVP-300plus for processing 300mm wafers; RVP-550, a flexible batch heating system to process loads up to 100 wafers; RVP-200 and AVP-200 for processing 8-inch and 6-inch wafers; and VTR systems for processing wafers from 100mm to 200mm. Aviza was incorporated in 2003 and is headquartered in Scotts Valley, California.
