That's a good point - if the ruling is favorable the patent infringements could go beyond Apple. If it is unfavorable, time to move on! Eliminates uncertainty.

Backpedaling here, I think the PTO needs to issue a final ruling on this, regardless if ANDR and Apple settle.... The PTO should care less on that matter...There needs to be a clear understanding of what patents ANDR are valid, if they choose to go after other infringers... At least the PTO decision (good or bad) will finally lay the framework what ANDR patents include.

Let's not forget, Doug Andrea needs another 30+ years so his kid can milk the cow the way his Dad did for the past 30+ years. Drug needs a big cash settlement or a royalty payout so his kid has the same cow like his Dad, his Grandfather and his Great-grandfather had. Which may help us too!

We may not know the terms, but we will see Doug Andrea taking his victory lap and getting a bonus. When we get the very next quarter's financial statements it should have the monetary benefit in the ANDR P&L and Balance Sheet.

If there is a settlement with Apple we will never know for how much or any terms.. Same as all the other settlements they made in the last 7 years.... Total BS.. cant believe the SEC allows this for the shareholders (ie, owners of the company), but they do....

my guess is that the PTO ruling is on hold, being that ANDR and Apple have notified them that they are working on a settlement deal.
I don't think Apple wants a ruling on this..... makes them look bad... Apple settled with KOSS through a 3rd party to wipe there hands of it.
Good or Bad, there should be a final PTO ruling, however I assume ANDR legal will advise them to settle.....

This was on April 22, 2022 - The Federal Circuit on Friday sent part of a Patent Trial and Appeal Board decision that went in Apple's favor back to the board for a second time, saying a portion of its analysis to invalidate four claims in an Andrea Electronics Corp. audio enhancement patent was flawed.

Expect ruling from US Patent and Trademark Office soon regarding the above.
Apple can wait for ruling or settle ahead of ruling.

Within the next 2 weeks if there's no settlement between Andrea and Apple does that mean a judge decides on the merits of the case or the merits of case and monetary awards/damages?

Actually a licensing agreement with Apple would be better, because that would lead on to Google, Amazon and others...... but that will never happen, because the legal team wants the buckets of shrimp, lobsters and oysters NOW!

If there is a settlement, I would only assume and expect ANDR lawyers to pressure the Doug Man to settle for the smallest amount, as long as the legal fee's and some peanuts for Doug (not shareholders) are in the deal.

We wont' know the amount of the settlement either, because that is supposedly confidential... Not sure why, but that's how it goes

I suspect any amount of a settlement between Apple and Andrea would surpass $14 million due to the fact the patent infringement is with the Iphone not Airpods. Would you agree? That assumes the PTO ruling is favorable to Andrea.

lets see.... looks like Koss and Apple settled their case for 14 million, related to patent infringement on ear buds.... 14 million is chicken feed for Apple... assume Koss didn't want to spend the legal fees for the next 8 years.

Well the good thing about all this, is that all of the attorneys will be paid in full. I would guess that between Andrea and Apple legal team fees to date would be over 5 million..... Current market cap of ANDR is 1.5 million...... What is wrong with this picture....

Good question - based on history - this is in the legal proceedings section of 10Q -

The Federal Circuit held an oral argument on October 1, 2019. On February 7, 2020, the Federal Circuit issued its decisions on Apple’s appeals.The Federal Circuit affirmed the PTO’s findings in one of the ongoing IPRs. In the other ongoing IPR, the Federal Circuitpartly affirmed the PTO’s findings, but also partly vacated the PTO’s findings, and remanded the case back to the PTOfor further proceedings. On remand of the ongoing IPR, on October 28, 2020, the PTO found that claims 6-9 of the Company’sU.S. Patent No. 6,363,345 are invalid.

Based on that - could be 10 months or longer!

1. Apple waits out the PTO ruling - (and appeals again). It just keeps going on and on and on.
2. Apple settles before the PTO ruling with some sort of deal.
3. Apple waits out the PTO ruling, if its unfavorable and can't appeal settles with some sort of deal.
