That's the risk we decide to take or not take here with AFFI. I just think that especially after reading through the 46 pages of the “List of Equity Security Holders” within that docket, I was impressed with the amount of Institutions invested into AFFI with some very solid positions... some of them had share positions in the millions.
The document was an old document filed 08/19/08. There was no dumping of shares because a company can't change the share structure while going through Bankruptcy. The Q just left so I doubt if any kind of organization to sell shares have transpired this quickly. I personally don’t claim to be the expert in reading through court dockets. AFFI use to trade on the NASDAQ with plenty of Institutional support. Institutions generally do due diligence (DD) much better than you, I, or anyone here within the forum. So for so many Institutions to have seen something in AFFI to take the positions they did before the ”Q” was there, maybe it is worth more than what us “Un-Institutional investors” can see right now since now the ”Q” is gone. For me, while you see the glass half empty with the "Q" coming off, I see the glass half full as still, I have no idea where AFFI could heading (good or bad), but I like the risk. I see our differences in thoughts as the variety for being the spice of life.

So you can't find a single court document that supports the removal of the Q? Interesting. That may explain why the company has said nada. To me it would be a red flag if the cause for the Q removal could not be validated by any authority. But that is only me.
What was the date on the document stating share structure?
that is a question...leaning toward adding more, WTH, it's all a gamble eh? Having less to play with after today, may as well put it here with some huge potential.

To answer your question, that was simply a motion to dismiss Chapter 11 Bankruptcy (BK) for AFFI and its subsidiary Decisioning.com, Inc. of which the Chapter 11 BK is now gone. It's not much more to it in my opinion as more has to be brought out eventually by the company to confirm its new found freedom.
I also searched through the Pacer database and there is not any updated info within the court dockets, but there is info indicating that the Outstanding Shares (OS) is still 47,142,398 shares with a whole lot of Institutional ownership surprisingly owning millions of shares out of their OS. When I get a chance, I will cut and paste some of it as it is quite a few pages of equity ownership reflected. I will just cut and paste some of the larger positions as the section of pages titled “List of Equity Security Holders” is comprised of 46 pages. It definitely makes you wonder why so many Institutions wanted to be a shareholder of AFFI. There is definitely something that all of them had seen that investors have not recognized as of yet for re-existing now since AFFI is out of BK.

Originally, AFFI was suing the Federated Department Stores, TD Ameritrade and HSBC for patent infringement as indicated throughout and below:

That statement of which you are referring was made based on limitations placed on AFFI’s patents by the court in May 2008, but in July 2008, it was later brought out that the United States Court of Appeals for the Federal Circuit (the “Appeals Court”) had remanded back the judgment that was originally made/created by the United States District Court in Columbia, South Carolina (the “District Court”) thus removing those limitations. You can’t help but wonder. What with that final ruling by the United States Court of Appeals for the Federal Circuit (the “Appeals Court”) was so powerful that it made Ameritrade just throw in the towel to stop fighting AFFI against the patent infringement charges brought against Ameritrade to simply settle with AFFI? Whatever it was, will it be that powerful to maybe make HSBC and those Federated Department Stores see that same light and simply settle with AFFI too? Or maybe they have already settled and we just have not heard about it yet?
I don’t have the answers to those questions, but we all do know that something in favor of AFFI has come of it since knowing that in July 2008 the United States Court of Appeals for the Federal Circuit (the “Appeals Court”) remanding back the judgment made by the United States District Court in Columbia, South Carolina (the “District Court”). To add, something else very positive was the “Q” being removed from AFFI’s ticker as it was taken out of Chapter 11 Bankruptcy (BK).
All of this could mean absolutely nothing as there is always risk. This could go either way; good or bad. I am also confident that the share structure is unchanged with their Outstanding Shares (OS) being 47,142,398 shares as indicated within the last 10-K filed back on 31 March 2008 simply because you can’t do anything to change the share structure when in BK status with the “Q” at the end of their ticker:

Those that bought in on the Q removal and held are all underwater. There are no legal documents that explain this recent turn of events and no statements by the company. I am sure that the run and subsequent fall has peaked the interest of regulators as it is a standard pattern of fraud. Due diligence is doing more than buying into a published yet unexplained event.

Thanks for your insight but, nothing has been released in a couple years. Information isn't readily available at this point. It's apparent that the 'Q' removal is what started all of this and I, as well as others, are curious to see what it leads to.

I agree, penny players have a one second time frame, and a one tick flipping mentality so sad really. Its no wonder that penny Ceo's don't put out much, they know what is going to happen. who could blame them? Not i.
How many here have a clue what is real in this company. Simply looking at the board history it is clear most jumped on the bandwagon after seeing the initial run last week. Prior to that NADA.
So who exactly are the sellers in this run and great news? Clearly nobody here was long. First day major volume on the followers (bandwagon buyers) and a decaying volume since. The company hasn't even put anything out.
This isn't even a gamble. The dice are thrown and you already have showing one ace towards snake eyes with the other die on it's way there.
