for technical ref, here's a definition of "net loss," which generally implies you don't have the money to pay your debts, which is why you accept debt instruments like Asher's in the first place.
(well, hopefully not like Asher's unless you're naive…)

actually, i do know, also stated in my prior post, quoted from the 10-Q:

as to why they didn't pay Asher back, i refer you to the "net loss" bit above, and the company's naiveté in accepting toxic debt funding, whose severe consequences didn't really kick in until Sept 2012, when it was already too late.

nutshell, despite being warned away from toxic financing by several posters here, Alan and Billy decided to risk it, probably thinking they could boost revs with wider distribution before Sept 5th.

well, didn't turn out that way.
