I agree on your post, let's not get dragged away.

so the SEC could agree with me and say that Kevin's failure to file was directly responsible for an unreasonably low price.

It's kind of funny because GERS stopped filing all of a sudden, and before and after that, GERS SP dropped all the same. But after the last RS, dilution stopped and the SP stopped falling and even went up since then. So that action by KK didn't drop the price but even gave it momentum to move higher. One could say despite the lack of filing, but it certainly didn't move down because of the lack of filing.

Whatever the rules are, KK knows them and will work them to his advantage.



I'm sure about that. There is a reason he stopped filing. It isn't just that he didn't feel like it. That reason could be negative for shareholders, but could be positive to. Whatever it is, I'm sure it's well thought trough. And I'm sure he also calculated in the consequences. I really think he isn't willing to avoid them because someone who just started buying shares, long after the filing stopped, complained to the SEC. Also long after the otc site said "STOP! Pink No Information. Company is not current in its reporting obligations under Section 13 or 15(d) of the Exchange Act"
