The most recent court order from the judge spells out the sequence of events. The order clearly states that any confidentiality agreement - signed or not signed - has no impact on the deadlines set forth by the court.

The only thing that needs to happen for the court to immediately suspend trading and send Jeff Foley to jail is a simple confirmation of non-compliance from the Enforcement Creditor.

Keep in mind that Long Side's attorneys might be a little busy today, as they are currently taking a comprehensive deposition from NTEK's transfer agent Clear Trust.

If we assume that NTEK will fail to make the ordered deadlines, we can also assume confirmation of non-compliance is forthcoming from Long Side.

The order is clear - it isn't up to NTEK to say they've complied and no further motions will be read or considered. It is simply up to Long Side to file a statement of non-compliance to set off the consequences.
