I'd think any willful misrepresentation to the investing public about any material fact regarding trademarks or anything else is fraud.

In the scheme of things, that's kind of minor to Seymour's other misrepresentations about having cured diseases, being able generate drugs in weeks, declaring numerous times that clinical trials were about to begin "next year", withholding negative material information, and the like.

If anyone ever has the chutzpah to sue NNVC and its board, I'm sure the trademark thing would be used as one of several dozens of examples as evidence for an ongoing pattern of willful misrepresentation.
