Berman approached Seth, not the other way around.
Let's call it a "draw"! It's pretty reasonable to assume Keith Berman would say just the opposite! Keith Berman would probably suggest that he had "figured out" Seth Shaw, thus walked from the deal! Who knows?

IMO...The whole discussion of Shaw vs. Berman is kind of like arguing, "who is least bad?"
