Not really IMO, the Judge seems to think shareholders must have a case and is letting the Co. Come to terms and give us more. If not, he may step in ( based on the facts) and make a decision. ( most Judges Hate to do that, they would rather sit back and let the two parties come up with a fair decision that both can agree to) My sister is a Judge and they prefer not to make the final decision, BUT they will when forced too....
