Discovery by Govt has been slow. In slowing up the discovery process, Govt has entered pleas to Stay and Dismiss.

Plaintiff’s have had to deal with foot dragging by Govt and have asked for an extension to discovery. Plaintiffs need discovery to refute Govt’s arguments to dismiss. Thus, the reason they, Fairholme, asked for an extension. To imply it’s Fairholme delaying the process or instigating delays is ridiculous.

Perry lost in Lamberth’s court in Summary Judgement without discovery. Fairholme doesn’t want that to occur with them.
