In defence of Rope, my "own personal views" on the so-called GPSI related lawsuit is listed below but you can ask and think for yourself after reading:

1) Why did they list "JDK LLC, a Colorado limited liability company" as a Plaintiff but failed to list "GPSI" as a Defendant?? Instead they list "Max 1 Financial LLC, a Colorado limited liability company" as a company Defendant. And they list Ron and others as individuals plantiff..

Clearly, GPSI is not targeted here as a Business Entity for this lawsuit.

2) What is even more interesting is Defendant Ron Hodge, Gregg Hodge and James (the non Talbots) are NOT represented by "Reid John Allred" and in fact, not represented at all?? Ironically, all the Talbots and Max1 are represented by the same "Reid John Allred"!!

Clearly, the MAIN targets are Talbots and Max1. BTW, we all know about Max1 past track-record and just google yourself.

Just like Rope mentioned "Anyone's name can be added to a lawsuit and there are no penalties to the Plaintiffs for doing so.". This seems like Ron, Gregg and James are conveniently casted in with a large, wide net since there is no extra charges for naming more defendants anyway. In fact, doing so looks kinda of desperate.

"Plaintiffs filed the Complaint on March 9, 2015 alleging that Defendants Gregg K. Hodge, Paul A. Talbot, Frank O. Hofmeister, James E. Sylvester, Max 1 Financial LLC, and Brooke Talbot perpetuated a comprehensive and fraudulent scheme that defrauded Plaintiffs of millions of dollars pursuant to Civil Racketeer Influenced and Corrupt Organizations. Plaintiffs assert fraud and additional state law claims and request damages in the amount of $1,600,000, along with various equitable remedies. This Order concerns Paul A. Talbot ("Mr. Talbot") and Brooke Talbot ("Ms. Talbot") (collectively, the "Talbots")."

Again, I did not see GPSI listed directly above as Defendant and only see Max1 as the only company in the Defendant list.

What is even more interesting is that Ron Hodge's name is "completely missing" as Defendant in this particular link above. Why?? Because the link to Ron is probably very weak. Only, Gregg Hodge is in the list as individual. What is clear is Talbots names and Max 1 are always in the Defendant list...

"Plaintiffs have been unable to personally serve the Talbots. Two process servers have provided affidavits attesting to two service attempts at the Talbots' residential address, two service attempts at the Talbots' business address, and one service attempt at the Talbots' "other" business address. [#40-1; #40-2 at ¶ 2]. The Talbots' full-time residence is barricaded by a gate and the manager for their known business refused to accept service. [#40-1]. Counsel for Plaintiffs, Mr. Meretta, attests that Lawrence Horwitz has represented the Talbots in settlement negotiations in this matter, though he claims to not directly represent the Talbots as individuals.1 [#40-2 at ¶¶ 3, 4]. The Talbots have rejected Mr. Horwitz's efforts to arrange for their voluntary acceptance of service of process."

"1. Mr. Horwitz represents a publicly-traded entity, General Payment Systems, Inc., on whose board Ms. Talbot purportedly serves. [#40-2 at ¶ 3]."

From the above, it is clear that the Kolassa and JDK failed to reach Talbots' high-gated private residence. Here we can all imagine why Talbots have a high-gated private residence (for very good reasons). Hence, Kolassa and JDK had started writing to Talbots related business entities to reach these Talbots, in which #40-2 happens to be GPSI.

And so Mr Horwitz unfortunately have to get involved because he represents GPSI. To make it clear to the court, Mr Horwitz clearly told the Court that " he claims to not directly represent the Talbots as individuals".

Why?

Because " Mr Horwitz unfortunately have to get involved because he represents GPSI" and "Kolassa and JDK" written to GPSI to get hold of the Talbots!!!

And to take the easy way out, Mr Horwitz had requested the Talbots to just simply accept the "service of process" so that Mr Horwitz and GPSI are off the hook. But "The Talbots have rejected Mr. Horwitz's efforts to arrange for their voluntary acceptance of service of process."

Given this rejection, clearly we can see that Mr. Horwitz did NOT represent the Talbots as individuals as he told the court. Otherwise, Mr. Horwitz and the Talbots are really having some serious miscommunication issues as a team. And Mr. Horwitz can go to Jail for lying to the Court....

Nothing new on the link above because I have covered them earlier above.

In summary: The Talbots and Max1 have done something terrible (no idea what it is though) to the Kolassa and JDK. Plaintiff (Kolassa and JDK) failed to reach Talbots high-gated private residence and instead wrote to GPSI in which Talbots serve as Board Member. And so, Mr Horwitz, Ron and Greg were dragged into the fiasco and named as individual defendant with very weak link to this fraud case.

Even if Ron and Gregg were involved as individual here, GPSI is NOT involved at all. May be, this will motivate Ron and Gregg to release all GPSI outstanding news so that GPSI PPS rocketed to the sky. So that both Ron and Gregg can sell their GPSI shares to pay damages to the JDK and Kolassa. And that will be one hell of a Good News for all of us here. smile

It is Summer and it is high time for Jail deal to be completed and news to be released!!!!
