Yes I know the assumption that the IR was the reason. Whatever the reason it is not really relevant to anything now except it is a road block.
Only thing I question is that if the IR location was the reason for the CTO why wasn't it removed a year ago?

the British Columbia CTO is due for removal at any rate on this minor technicality. Generally speaking the Province Regulatory Agencies have been a toothless tea and crumpet party issuing their bureaucratic garbage for years.

I agree totally. But garbage or not it must still be cleared prior to a listing IMO
