Seriously Pyrr, you're debating semantics. At every investor conference leading up to the German 51 data reveal, LP repeated the same message from the September CUA slide. It is not a lie to continue with the same truth message from September 2014, which at the time it was the truth.
Oppenheimer Q&A portion in December 2014:
Moderator: I'm wondering if a, anybody has any questions?
Conference attendee #1: Linda, on the 55 patient, that information arm, are you going to release any more data? And in particular, the breakdown between Rapid Progressors and Pseudo Progressors (psPD)?
Linda Powers: Umm, we haven't determined that yet. We may submit. Umm, we, we... If we do that, we'll do it in the form of submitting an abstract for a scientific conference, that type of thing.

It was clear to me that we wouldn't receive a breakdown or update on those patients until that Germany conference. As such, the only thing she could do is speak about the ePDs as the patients who failed trial enrollment failed due to suspected ePD conditions.
And, there is no way for you to honestly call it to a lie even today. We do not know (you admitted to this already) where these patients KPS measurement may have been since they failed screen; so yes, even now, every one of those 51 patients could have had symptoms that made it difficult to care for themselves <70 due to the suspected ePD.
