The judge said "certain material misstatements and omissions were
indeed made by the ARIAD Defendants" but that they didn't meet the legal criteria needed to overcome dismissal. He didn't say they were innocent.
Do you really want to vote for management that, according to the court, misrepresents and obfuscates?
